RE. Affinity at Federal Way Folder # 17-105622-000-00-SM; Waiver for South 316`h Place
Dear Mr. Reider:
The City of Federal Way has received your waiver request dated November 20, 2017. After evaluating
the existing conditions along the referenced street, The City's Comprehensive Plan Map III — 3
Functional Classification of Existing and Planned Streets and Highways indicates a public right-of-way
Type "Q" to be located in close proximity to this project, review of the Federal Way Revised Code
(FWRC) provisions (Section 19.135.250; 19.135.280(2); 19.135-280(3)), and direction provided by the
City Council, the Public Works Department makes the following determinations:
1. Reduction of the sidewalk along South 316th Place (private road) from 12-feet wide to 8-feet
wide (FWRC 19.135.250).
FWRC 19.135.090 requires that private roadway improvements meet public roadway
improvement standards. FWRC 19.135.210-250 require sidewalks within the City Center to be
12-feet wide in addition FWRC 19.135.205 requires reasonable and appropriate accommodation
for pedestrians, bicyclists and transit passengers of all ages. All ramps and transition wings must
meet current ADA Standards.
The Public Works Department hereby denies your request to reduce sidewalk from 12-feet to 8-
feet wide.
2. Reduction of intersection spacing along South 3161h Place from 150 feet to approximately 89
feet (FWRC 19.135.280(2)).
The applicant believes that requiring a 150-foot separation of the proposed underground parking
from the intersection of Pete Von Reichbauer (PVR) Way S and S. 316th Place would limit them
to only two driveways. Currently the proposal shows four driveways along S. 316`h Place.
The reduction of the 150-foot minimum separation would reduce the available que for traffic
from S. 316`h Place onto PVR which will become critical for the proposed 179 residential units
for this project. Additionally S. 316th Place accommodates traffic flow from the Comfort Inn and
La Quinta Inn which adds to the queuing requirements.

The Public Works Department hereby denies your request to reduce the separation distance
between the intersection of PVR Way S and S. 316`h Place. Public Works preference would be to
relocate the underground garage entrance to the proposed circular drive which would then reduce
the number of driveways needed to three. At a minimum the underground garage entrance will
be aligned with the existing LaQuinta (Clarion) Inn driveway located along the north side of S.
316t' Place.
3. Reduction of driveway spacing along a property (FWRC 19.135.280(3)). The applicant has
requested waiving the standard to allow up to four driveways along South 316 Place.
FWRC 19.135-280(3) limits access to one driveway every 330 feet of lot frontage. This project
has approximately 475 feet of frontage along South 316t' Place. As stated above the current
proposal indicates four driveways. A precedent exists due to the Comfort Inn (also on S. 316t'
Place) which has a circular entrance drive similar to the one proposed.
The Public Works Department hereby approves the reduction of driveway separation for the
circular drive, the proposed delivery drive and if unavoidable the parking garage entrance.
The applicant shall either record the roadway as a Tract "X" (future right-of-way) or dedicate this portion
of the roadway to the City upon completion of the right-of-way improvements.
The conditions of this right-of-way modification will be applicable for a period of one year. If the
commercial permit is not issued within the one-year period, this modification will be void, and a new
request for modification must be submitted.

STREET MODIFICATION REQUEST / ACTION

Request The applicant proposes to construct a 179 unit age restricted, senior housing
"community". The property is located at the corner of S 316th Place (private road) and Pete Von
Reichbauer (PVR) Way South.
The applicant is requesting the following modifications of street frontage improvements along S
316t" Place:
1. Reduction of the required driveway to intersection separation (FWRC 19.135.280(2))
2. ,Modification of the driveway spacing (FWRC 19.135.280(3))
3. Reduction of the sidewalk width along S 3161h Place from 12-feet to 8-feet wide (FWRC
19.135.250).
Staff Analysis S 316th Place is a private roadway and does not have a classification under
Map III — 4 Cross Section Application by Street. Currently a credit union, a strip mall and two
hotels use this as a secondary access roadway.
The Pre -Application Summary letter (Sarady Long) called for minimum 20-foot paved road
section with 12-foot sidewalk along the Affinity frontage of S 316th Place. South King Fire &
Rescue (Chris Cahan) required an increase to 28-foot road section to assure emergency vehicle
access.
l . The underground parking garage access measures 89 feet from the centerline of PVR
Way to the centerline of the driveway. If allowed, this would extremely limit vehicle que
on S 31614 Place. In addition this does not meet 19.135.280(2) which requires a minimum
of 150 feet for any use other than detached dwelling units.
2. The circular pick-up and drop-off driveway does not meet the requirements of FWRC
19.135.280 (3). Typically this section is applied only to City right-of-way. Currently, the
Comfort Inn, which also uses S 316`h Place, has a circular pick-up and drop-off that is
very similar to the proposal.
3. FWRC 19.135.090 requires private streets to be improved to be consistent with the
requirements of right-of-way. The City's Comprehensive Plan Map III — 3 Functional
Classification of Existing and Planned Streets and Highways indicates a Type "Q"
roadway is to be located within the vicinity of this project. Any sidewalk and the
associated transition ramps will need to meet the current ADA standards.
Requirements / Conditions of Approval Development Services staff make the following
recommendations for this request on street improvements:
1. Deny reduction of parking garage entrance to 89 feet. Modify to either align with La
Quinta (Clarion) Hotel driveway located along the north side of S 316"' Place
Scan completed form into Amanda folder
(approximately 170 feet) or provide access to parking garage from the proposed pick-up
and drop-off circular drive. The latter modification will reduce the number of driveways
to three.
2. Approve the reduction of the driveway separation along S 316th Place for the circular
driveway and the proposed delivery driveway (west edge of property).
3. Deny reduction of the sidewalk along S 3161h Place from 12-feet to 8-feet wide. Half -
street improvements shall match Type "Q" roadway section with the paved roadway no
less than 28-feet wide (SKF&R). The applicant shall either record the roadway as a Tract
"X" or the City is willing to accept a dedication of this portion of the roadway as right-of-
way once the improvements are complete.

On behalf of Affinity at Federal Way, LLC and the Inland Group, ESM Consulting Engineers,
LLC is requesting modifications to the Federal Way Revised Code (FWRC), Chapter 19.135,
Development Standards. Pursuant to FWRC 19.135.070 the following modifications are
being requested as part of this letter:
1. Modification of intersections spacing (FWRC 19.135.2800);
2. Modification of driveway spacing (FWRC 19.135.280(3)); and
3. Modification of sidewalk width along South 316th Place (FWRC 19.135.250).
The proposed Affinity at Federal Way project is located at 31701 Pete Von Reichbauer
Way South (also known as 20th Avenue South in the City's Comprehensive Plan). This
age -restricted, market -rate, senior housing community will offer 179 residential units in a 6
story building with structured parking. Along the north property frontage is South 316`h
Place (private road), to the west is a Comfort Inn, to the south is the Seatac Village
Shopping Center, and along the east property frontage is Pete Von Reichbauer Way South
(public road).
FWRC 19.135.280Intersection S acin
FWRC Chapter 19.135.280(2) requires 150 feet of separation between driveways or
intersections, as measured from centerline to centerline. There are three existing
driveways along the projects frontage along S 316th PL, two of which don't meet this
standard.
In order to meet this separation standard of 150', the project would only be allowed two
access points along its frontage of 472', and the project requires four access points.

We recognize that the existing driveways do not align with the proposed access points;
however, as an age -restricted community, we do not anticipate a large volume of traffic on
this dead-end, private street.
This standard is not achievable for the following reasons:
The proposed type of development requires three vehicular access points and one
additional delivery truck lane for the operation of the senior housing community.
The property is not deep enOLIgh to allow an access point from Pete Von
Reichbauer Way South, therefore, all access points need to derive from S 316th
Place. With this configuration, the City Center is benefitting from less traffic
queuing on Pete Von Reichbauer Way South, which is a Principal Collector
roadway.
2. The first two of the three vehicular access points allow for through -travel
underneath a Porte Cochere at the main entrance to the building. This allows for
quick pick-up and drop-off of residents either by private vehicle, taxi service, or
shuttle service and it provides an emergency vehicle turn -around which is needed
for this dead-end private roadway. These proposed driveways provide ±84 feet of
spacing between centerlines and they are offset from the driveway to the north by
±35' and ±55'.
3. The third egress/ingress point is closer to the northeast corner of the building
where a monitored access to the parking garage is proposed. The spacing
between the centerline of this garage access point and the centerline of Pete Von
Reichbauer Way South is ±90 feet. The parking garage access has been located
at this location because the existing topography prohibits safe access directly from
Pete Von Reichbauer Way South.
4. The spacing between the centerline of the truck delivery lane access and the
centerline of the westernmost access to the Porte Cochere is approximately ±89
feet. It is also slightly off -set from the existing driveway to the north. The location of
this delivery truck access should not be an issue since it will provide access only
during times of emergency or when a delivery is required.
5. The existing topography along the eastern boundary of the proposed development
precludes access onto Pete Von Reichbauer Way South. The 20 feet of elevation
change in this location, along with the required grading activities to support the
structured parking prohibits access directly onto Pete Von Reichbauer Way South.
6. Proper vertical alignments on the South 316th Place (private road) cannot be
determined because the existing street was constructed prior to incorporation into
the City of Federal Way.
7. Furthermore, since the access is consolidated to South 316th Place (private road),
no impacts to the six -year transportation improvement program are anticipated.

FWRC 19.135.280(3) limits access to one driveway every 330 feet of lot frontage. Affinity at
Federal Way has approximately ±475 feet of lot frontage on South 316th Place and only
162 feet of frontage along Pete Von Reichbauer Way South. We are requesting that this
standard be waived to allow a total of four driveways on South 316th Place for the following
reasons:
1. There are several advantages to consolidating driveways to a private road such as
South 316th Place. These include: potential traffic queuing is removed from Pete
Von Reichbauer Way South; City maintenance of public right-of-way is not
encumbered by private driveways; and, it allows greater spacing between
intersections and driveways on Pete Von Reichbauer Way South.
2. During a pre -application conference with the City it was anticipated that garage
access would be from Pete Von Reichbauer Way South. Further analysis of the
existing topography and the amount of grading required to achieve that access, it
has been determined that this access point is not feasible. The existing
topography at the eastern portion of the proposed development involves 20 feet of
elevation change which precludes direct access onto Pete Von Reichbauer Way
South.
3. Existing topography of the site matched with the existing grade of Pete Von
Reichbauer Way South precludes the development from providing a safe access in
a short amount of distance. Since South 3161h Place is private, access to each vital
section of the proposed development is easier to achieve.
4. Since all site access is limited to South 316th Place (private road), no impacts to the
six -year transportation improvement program are anticipated. Existing conditions
currently show 3 access points onto South 316th Place from previous development.
FWRC 19.135.250 Modification sidewalk width along South 316th Place
FWRC 19.135.250 requires that a 70-foot right-of-way in the City Center contain a 12-foot
wide sidewalk Although South 31 dh Place is a private street, the City has requested that
Affinity at Federal Way provide a 12-foot wide sidewalk along this street frontage.
The required standard is not achievable for the following reasons:
1. The fire department requires Affinity at Federal Way provide an additional 8 feet of
pavement width to the existing 20 feet of travel lane. The addition of this 8 feet of
pavement is provided solely from the proposed building site which further reduces
the buildable area.
2. The requirement of a 12-foot sidewalk in this location would reduce the amount of
landscaping between the building and the sidewalk, making the majority of the
frontage along South 316th Place a hardscape, devoid of any plant materials. In
order to provide a small amount of Type -III landscaping along the project's
northern boundary, we are proposing to reduce the sidewalk width slightly.

3. The small separation between the 8-foot sidewalk and the building proposed,
make the grade transition in these areas easier to accommodate and help reduce
the impervious surface coverage for the site.
4. The proposed 8-foot wide sidewalk is better suited to a private street as it is less
wide then the public sidewalk proposed along Pete Von Reichbauer Way South.
In conclusion, we believe the requested modifications should be granted because none of
the proposed modifications pose a threat to fire, life and safety, and are merely proposed
to make the project work on such a small site. The proposed improvements are sufficient
to meet the intent of the City standards, while providing accommodations that allow for the
safe operation of the proposed senior housing development
