Dear Mr. & Mrs. Batson:
Thank you for participating in the preapplication conference with the City of Federal Way's Development
Review Committee (DRC) held August 14, 2014. We hope that the information discussed at that meeting
was helpful in understanding the general requirements for your project as submitted.
This letter summarizes comments given to you at the meeting by the members of the DRC. The members
who reviewed your project and provided comments include staff from the city's Planning and Building
Divisions and Public Works Department, and representatives from Lakehaven Utility District and South
King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information
handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable
codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes
for all additional requirements that may apply to your project.

PROJECT DESCRIPTION
The applicant proposes development of a two -lot short subdivision on a 0.92-acre site. The property is
zoned Residential Single -Family (RS) 15.0.
MAJOR ISSUES
Outlined below is a summary of the major issues of your project based on the plans and information
submitted for preapplication review. These issues can change due to modifications and revisions in the
plans. These major issues only represent comments that the DRC consider most significant to your project
and do not include the majority of the comments provided. The major issues section is only provided as a
means to highlight critical requirements or issues. Please be sure to read the entire department comments
made in the next section of this letter.

• Planning Division
1. There is a Category 1 wetland located off site to the south. The wetland buffer is 200' and
impacts this property. The buffer area must be placed within a tract in the short plat and cannot
count towards the 15,000 square -foot minimum lot area for either lot.
2. All residential subdivisions are required to provide open space in the amount of 15 percent of the
gross land area of the subdivision site per FWRC 18.55.060(2). All or some of the open space
requirement may be satisfied by a fee -in -lieu payment. If open space is provided onsite, it shall be
provided in its own tract. As with other tracts, an open space tract cannot count towards the
minimum lot area of either lot.
s Public Works Development Services Division
The project shall meet the stormwater management requirements set forth in the city -adopted 2009
King County Surface Water Design Manual (KCSWDM) and city addendum to the manual.
■ Public Works Traffic Division
1. A Transportation Concurrency permit is required per FWRC Chapter 19.90.
2. Traffic Impact Fee (TIF) payment per FWRC 19.91.
3. Construct street frontage improvements and dedicate right-of-way (ROW) along the property
frontage on S 358th Street and 1 st Avenue S (FWRC 19.135.040).
4. Revise current proposal to meet access management standards (FWRC 19.135.280).
DEPARTMENT COMMENTS
Outlined below are the comments made by the representatives of each department present at the
preapplication conference. Each section should be read thoroughly. If you have questions, please contact
the representative listed for that section.
PLANNING DIVISION (Stacey Welsh, 253-835-2634, stace .welsh�]a ci offederalway.com
Short Plat Process — Pursuant to FWRC 18.30.010, short plat applications are administratively
processed through the Department of Community Development. The administrative review process
requires that the Director of Community Development issue a decision on the short subdivision
request and confirm conformance with FWRC 18.30.110(2). Public notice of the complete short plat
proposal is required per FWRC 18.30.080, and a 15-day public comment period is provided.
However, no public hearing will be required unless an appeal is filed. A master land use application
and short plat handout are enclosed; relevant code sections are available at the city's website at
www.cityoffederalway.com.
2. State Environmental Policy Act (SETA) —This short plat application is exempt from the requirements
of SEPA review.
3. Fees —As development fees change annually, please contact the Permit Center at 253-835-2607, or
permitcenter@cityoffederalway.com, for an updated fee list prior to submitting your application.
Additional utility fees, school impact fees, concurrency, and engineering plan review fees apply.

4. Lot Size — The zoning for the subject site is RS-15.0. Minimum lot size for each lot is 15,000 square
feet. As depicted, proposed lots 1 and 2 meet the minimum lot size requirement. Note that the off -site
wetland's on -site buffer will need to be placed within a tract in the short plat (also see note #12,
below). This tract area cannot count towards the lot area for the newly created lots. Additionally,
property dedicated to the City for right-of-way frontage improvements may not be counted in lot
areas either (see Traffic comments). Also, all residential subdivisions are required to provide open
space in the amount of 15 percent of the gross land area of the subdivision site per FWRC
18.55.060(2). If open space is provided onsite, it shall be provided in its own tract. As with other
tracts, an open space tract cannot count towards the minimum lot area of either lot (also see note #8,
below).
5. Design Criteria — Short plats are subject to the subdivision design criteria of FWRC 18.55.020.
6. Setbacks — Existing and future residences must conform to the following structural setback
requirements of FWRC 19.200.010, "Detached Dwelling Units": front yard —twenty feet; side yard —
five feet; and rear yard —five feet.
As information, for Lot 1 as it is shown on Sheet 2 of the submitted short plat site plan, the front lot
line is off of I` Ave S., as that is where the existing driveway is. As a result, S. 358 h Street requires a
side street setback of 10 feet for Lot 1.
7. Miscellaneous Single -Family Residential Regulations —
a. Maximum height of structures-30 feet above average building elevation.
b. Maximum lot coverage-50 percent.
c. Required parking spaces —two per dwelling unit.
8. Open Space — All residential subdivisions are required to provide open space in the amount of 15
percent of the gross land area of the subdivision site per FWRC 18.55.060(2). All or some of the open
space requirement may be satisfied by a fee -in -lieu payment at the discretion of the parks director
after consideration of the city's overall park plan, quality, location, and service area of the open space
that would otherwise be provided with the project. Open space fees shall be paid prior to recording
the short plat, unless the applicant chooses to defer the payment via a covenant recorded against each
newly created lot. If the applicant chooses to provide onsite open space, it shall be provided in its own
tract and include a combination of the following types:

Per FWRC 18.55.060.6, "Open space shall be owned in common undivided interest by all property

9. Clearing, Grading, and Tree and Vegetation Retention — The short plat is subject to the provisions of
FWRC 19.120, "Clearing, Grading, and Tree and Vegetation Retention." It is recommended that
FWRC 19.120 be reviewed carefully in reference to the proposed short plat. A clearing and grading
plan that meets FWRC 19.120.020 and FWRC 19.120.040 must be submitted with the formal short
plat application, if clearing and grading work is proposed.
10. Review FWRC 19.120.120 for minimum standards for rockeries and retaining walls.
11. The plat will be subject to tree density requirements of FWRC 19.120.130(1); note that 25 tree -units
per acre are required for single-family zoned sites. In the case of the 0.92-acre site, it appears that
approximately 23 tree units are required (25 x .92 = 23). Tree unit credits are in Table 2 of FWRC
19.120.130-2. The formal application must indicate if any trees are to be removed.
12. Critical Areas — A portion of the property is located within the buffer of the West Hylebos wetland.
According to city critical area maps it is a Category I wetland which requires a 200-foot buffer.
Pursuant to FWRC 19.175.040, land surface modification is not permitted and no structure or
improvement may be located within a regulated wetland buffer. A professionally prepared wetland
report that identifies the location of the wetland buffer on the project site is required as part of the short
plat submittal per FWRC Chapter 19.10.030 and 19.175.010.2. The applicant is responsible for
providing the report to the City and for covering the cost of the City's consultant who may review the
report. The City recently started a Critical Areas Review Optional Direct Services Program, which
provides you with another option for obtaining the services of a qualified consultant (see enclosed
handout). The short plat drawing must show the location of the buffer on the site and place it within a
tract per FWRC 19.150.070.
13. School Impact Fees — School impact fees (currently $4,687.00 per single-family home) are due at the
time of building permit application for new dwelling units. This fee amount is subject to change as
determined annually by the Federal Way School District.
14. Approval Duration — Short plat preliminary approval expires five years from the date of approval.
Engineering plans must be approved, improvements constructed, and the short plat must be recorded
within the five-year time period. No less than 60 days prior to the lapse of approval, the applicant
may request a two-year time extension for the short plat approval.
15. Recording — The city will record the short plat with the King County Division of Records and
Elections subsequent to Public Works Department approval of submitted as -built plans. Prior to
recording the short plat, all surveying and monumentation must be complete. In addition, all other
required improvements must be substantially completed as determined by the departments of
Community Development and Public Works.
PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Ann Dower, 253-835-2732,

Land Use Issues — Stormwater
1. Surface water runoff control and water quality treatment is regulated by the 2009 King County
Surface Water Design Manual (KCSWDM)'and the City of Federal Way Addendum to the 2009

KCSWDM. This project meets the requirements for Small Project Drainage Review as outlined in the
KCSWDM.
2. The project lies within a Conservation Flow Control Area; however, a flow control facility may not
be necessary for this project. The project also lies within an Enhanced Basic Water Quality Area.
However, since required street improvements are limited, water quality treatment may not be
necessary for this project.
3. At the time of preliminary short plat submittal, a small project drainage plan shall be submitted. Flow
Control Best Management Practices (BMP's) for the new single-family lot must be shown. If the lot
layout and footprint of the proposed house is known, then a design must be provided showing that the
new lot can accommodate the runoff from the new impervious surfaces. If the new home information
is not available, then a theoretical BMP design must be provided, assuming a minimum of 4,000
square feet of new impervious surface on the new lot. New impervious area created by required
frontage improvements must be calculated. If square footage thresholds for water quality or flow
control are exceeded, the developer will need to provide detention and/or water quality facilities
meeting the Conservation Flow Control and Enhanced Basic Water Quality standards.
4. Provide soil logs prepared by a licensed geotechnical engineer or septic designer to verify infiltration
suitability. Also show the location of existing and proposed septic systems.
Right -of -Way Improvements
1. See the Traffic Division comments from Senior Traffic Engineer Erik Preston for traffic related items.
2. Dedication of additional right-of-way will be required and shall be conveyed to the city through a
statutory warranty deed. The dedicated area must have clear title prior to recording.
3. FWRC 19.135.280 requires that driveways serving residential uses may not be located closer than 25
feet to any street intersection. Lots and intersections within new subdivisions or short plats must be
designed to meet this standard.
Engineering (EN) Permit Issues
1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be
reviewed and approved by the city. Engineering review fees are $549.50 for the first 8 hours of
review, and $68.50 per hour for additional review time. Engineering plans will require the
signature/seal of a professional engineer registered/licensed in the State of Washington.
2. The Federal Way Development Standards Manual (including standard detail drawings, standard
notes, and engineering checklists) is available on the city's website at www.ci offedera[wa .com, to
assist the applicant's engineer in preparing the plans and drainage narrative.
3. Bonding is required for all street improvements and temporary erosion and sediment control measures
associated with the project. The bond amount shall be 120 percent of the estimated costs of the
improvements. An administrative fee deposit will need to accompany the bond to cover any possible
legal fees in the event the bond must be called. Upon completion of the installation of the

improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30
percent of the original amount and held for a two-year maintenance period.
4. The developer will be responsible for the maintenance of the street improvements during the two-year
maintenance period. During that time, the Public Works Inspector will make periodic visits to the site
to ensure the developer's compliance with the maintenance requirements. Upon satisfactory
completion of the two-year maintenance period, the remainder of the bond will be released.
Maintenance for public roads then become the responsibility of the city. Maintenance for private
roads and drainage facilities, including short plats, remain the responsibility of the individual property
owners.
5. When topographic survey information is shown on the plans, the vertical datum block shall include the
phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are
noted.
6. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. All final approved
drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site
plans shall be drawn at a scale of 1" = 20', or larger. Architectural scales are not permitted on
engineering plans.
7. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix
D, 2009 KCSWDM, must be shown on the engineering plans.
8. The site plan shall show the location of any existing and proposed utilities in the areas affected by
construction.
PUBLIC WORKS TRAFFIC DIVISION (Erik Preston, PE, 253-835-2744,

Transportation Concurrency Analysis (FWRC 19.90)
1. Based on the submitted materials for 1 additional single-family home, the Institute of Transportation
Engineers (ITE) Trip Generation - 8th Edition, land use code 210 (Single -Family Detached Housing),
the proposed project is estimated to generate approximately 1 new weekday PM peak hour trip.
Alternatively, the applicant may submit a site specific trip generation study for the proposed
development.
2. A concurrency permit is required for this development project. The PW Traffic Division will perform
concurrency analysis to determine if adequate roadway capacity exists during the weekday PM peak
period to accommodate the proposed development. Please note that supplemental transportation
analysis and concurrency mitigation may be required if the proposed project creates an impact not
anticipated in the six -year Transportation Improvement Plan (TIP).
3. The estimated fee for the concurrency permit application is $344.50 (1 - 10 Trips). This fee is an
estimate and based on the materials submitted for the preapplication meeting. The concurrency
application fee must be paid in full at the time the concurrency permit application is submitted with
land use application. The fee may change based on the new weekday PM peak hour trips as identified

in the concurrency trip generation. The applicant has the option of having an independent traffic
engineer prepare the concurrency analysis consistent with City procedures; however, the fee remains
the same.
Transportation Impact Fees (TIF, FWRC 19.91)
Residential Land Divisions —Based on the submitted materials for 1 single family lot, the estimated traffic
impact fee is $3,205.30. The actual fee will be calculated and paid at the time of plat recording. The
applicant may defer part or all of the impact fee payment amount to either building permit issuance; or to
later than closing of the sale of the single family home. If this option is selected, a covenant prepared by
the city to enforce payment of the deferred fees will be recorded at the applicant's expense on each lot at
the time of plat recording for residential land divisions.
Street Frontage Improvements (FWRC 19.135)
1. The applicant/owner would be expected to construct street improvements consistent with the planned
roadway cross -sections as shown in Map III-6 of the FWCP and Capital Improvement Program (CIP)
shown as Table III-19 (FWRC 19.135.040). Based on the materials submitted, staff conducted a
limited analysis to determine the required street improvements. The applicant would be expected to
construct improvements on the following streets to the City's planned roadway cross -sections:
■ 1 st Avenue S is a Minor Arterial planned as a Type "O" street, consisting of a 34-foot
street with curb and gutter, 6-foot planter strips with street trees and streetlights, and 8-
foot sidewalks in a 68-foot right-of-way (ROW). Assuming a symmetrical cross section,
4-foot ROW dedication and half -street improvements are required as measured from the
street centerline.
S 358th Street is a Local Street planned as a Type "W" street, consisting of a 28-foot
street with curb and gutter, 4-foot planter with street trees, 5-foot sidewalks with
streetlights in a 52-foot ROW. Assuming a symmetrical cross section, 1-foot ROW
dedication and half -street improvements are required as measured from the street
centerline.
2. The applicant may make a written request to the Public Works Director to modify, defer, or waive the
required street improvements (FWRC 19.135.070). Information about a right-of-way modification
requests are available through the Public Works Development Services Division. These modification
requests have a nominal review fee currently at $105.50.
Staff may support a modification request to waive the street frontage improvements for S 358th
Street.
Access Management (FWRC 19.135)
1. Access management standards are based on roadway safety and capacity requirements. FWRC
19.135.280 provides access standards for streets based on planned roadway cross -sections. Please
note that access classifications are per Drawing 3-1A in the Public Works Development Standards.
2. Per FWRC 19.135.280, driveways that serve only residential use may not be located closer than 25
feet to any street intersection. The City may further limit or prohibit access to or from driveway on
arterial streets as deemed appropriate for safety.

3. 1st Avenue S is Access Class "4", which permits full access as close as 150 feet to any other street
intersection or driveway, whether on or off the subject property. The existing Lot 1 driveway does not
meet access management standards and should be modified to access S 358th Street.
4. Lot 2 shall be accessed from -S 358th Street.
Design Criteria (FWRC 18.55)
All lots shall be accessed by a public street right-of-way (FWRC 18.55.020). In certain cases, lots may be
accessed by an ingress/egress and utilities easement or alley subject to the requirements established in the
City of Federal Way public works development standards. Residential lots should not have access onto
arterial streets.

■ An updated Certificate of Water Availability (application form enclosed) issued separately by
Lakehaven may be required to be submitted with any land use and/or building permit applications (check
with land use agency for requirement). Certificate is valid for one (1) year from date of issuance. If
Certificate is needed, allow 10 work days to issue for typical, 3 work days for accelerated, processing.
■ The site has one (1) existing 5/8"x3/4" residential water meter (SN 3488).
• A water service connection application (form enclosed) submitted separately to Lakehaven is required
for each new service connection to the water distribution system, or any modification to an existing
water service connection (e.g., larger service, irrigation, abandonment of existing service(s), re-
activation, etc.), in accordance with standards defined in Lakehaven's current `Fees and Charges
Resolution'.
• Based on the proposal submitted, preliminary estimated Lakehaven water service connection

The City of Federal Way's Department of Community and Economic Development received
your request for a "Critical Area Designation Review" per King County Health Department
requirements for installation of a new septic system.
After a review of city critical areas maps within the City Of Federal Way I have found that the
subject property, parcel # 292104-9042, is potentially l��hln the buffer of the West
Hylebos Wetland. According to city critical area maps it is a Category I wetland which requires
a 200-foot buffer width. Pursuant to the Federal Way Revised Code (FWRC) 19.175.040 land
surface modification is not permitted and no structure or improvement may be located within a
regulated wetland buffer. The enclosed map shows the approximate location of the category I
wetland and associated buffer which affects this property. Critical areas maps produced by the
City designate the general location of critical areas, and do not provide exact demarcation of the
wetland and associated buffers. If more precise locational information is required it will be
necessary to hire a wetland biologist and prepare a wetland delineation.

13.44.010 Specifications —General. A. No inspection box or distribution box shall be
rnanufactuxed, sold or installed which is not constructed of durable, watertight materials
and which is not equipped with an adequate removable cover.
B. The inspection box or distribution box shall be set on a concrete pad or tamped
crushed rock to prevent misal pMCnt_
G The inspection box or distribution box shall be constructed and installed so the
inlet invert is not -less than four inches (4") above the level of the outlet invert(s), and the outlet
inverts shall be not less than two inches (2") above the floor of the box-
D. The inspection box or distribution box shall be installed with at least thirty-six
inches (36") of four -inch (4") tightline extending from each outlet There shall be no filter
material within thirty-six inches (36") of the inspection box-
E. There shall be no driving, parking, paving, or construction over the distribution
or inspection box.
F. The distribution or inspection box shall have an inspection access with a secured
lid at finished grade or be installed within twelve (12) inches of grade with a Permanent visible
marker at the finished grade.
