The Community Development Department has completed review of your Process I Master Land Use
application to replace the garbage enclosure at Evergreen Eye Center located at the above -referenced address.
The Process I application is hereby approved per the findings and conclusions noted below.
FINDINGS OF FACT
1. The zoning for the subject property is Office Park (OP). The existing medical office is an allowed use in
the OP zone per Federal Way Revised Code (FWRC) 19.235.010, "Office/Retail."
2. The existing enclosure walls are gray masonry and the gate consists of chain -link with gray slats. The
applicant is proposing to replace the garbage enclosure by removing the existing damaged walls and
replacing them with a six-foot tall solid screen chain link fence with a chain link gated enclosure on the
same footprint. The chain link fence will have "Viewguard Plus" slats, which have no gap between them,
and therefore no visibility through them. The slats will be gray in color to match the existing building.
3. Per FWRC 19.125.040(4), all trash enclosures shall be screened from abutting properties and/or public
rights -of -way by a 100 percent sight -obscuring fence or wall and appropriate landscape screen.
4. For commercial service yards, per FWRC 19.115.050(6)(a)(iv), chain -link fencing shall not be used where
visible from public streets, on -site major drive aisles, adjacent residential uses, or pedestrian areas.
5. Per FWRC 19.115.090(2)(f), chain -link fences visible from public rights -of -way or adjacent properties,
and not screened by Type I landscaping as defined in Chapter 19.125 FWRC, shall utilize vinyl -coated
mesh, powder -coated poles, dark color(s), and architectural element(s), such'as pole caps and/or a
decorative grid pattern.
6. The proposed upgrades will not create new impervious area; do not reduce the amount of required
landscaping, parking, buffering, open space, or public areas; and do not change pedestrian connections,
utilities, or easements.
7. A building permit is not required for the demolition or installation of the fence.

CONCLUSIONS OF LAW
1. The proposed improvements are not exempt from Use Process review as they do not meet criteria set
forth in FWRC 19.15.020, "Exceptions."
2. Process. I "D.irecvor's Decision" is the appropriate Master Land Use application as the improvements are
to a developed. site and do not exceed thresholds set forth in FWRC 19.15.030(1).
3. The proposed improvements are exempt from State Environmental Policy Act review as the scope of work
meets categorical exemption WAC 197-11-800(3), "Repair, Remodeling, and Maintenance Activity."
4. The Federal Wlay Comprehensive Plan and zoning designation for the subject property is Office Park (OP).
Pursuant to FWRC 19.235.010, the subject property's medical office use is permitted in OP zoning district.
5. The replacement trash enclosure will be comprised of a 100 percent sight -obscuring fence, which will
screen its contents from abutting properties and the public right-of-way. Existing landscaping will screen
the replacement enclosure in the same manner it did for the existing enclosure.
6. The existing enclosure has light gray masonry walls with a chain link fence gate with matching colored
slats, all of which match the color of the primary building on site. The replacement enclosure is proposed
to be a standard chain link fence with solid screen gray slats to match the color of the primary building.
The existing enclosure has landscaping that partially screens it from the right-of-way. Per FWRC
19.115,020, guidelines are intended to serve as performance objectives for developing the appropriate
siting and design solutions for each development on each unique site. Decisions may allow for departure
from any specific or numeric provisions contained in the guidelines, provided the end result is consistent
with the purpose statement of the chapter. Per FWRC 19.115.050(6)(a)(iii), service enclosures shall be
consistent with the primary building(s) relative to color. The use of additional silver colored chain link
fence (the existing gate is already chain link) for a replacement enclosure set against its gray colored solid
screen slats is inconsequential and will be allowed as proposed. The replacement enclosure gate's planned
use of solid screen slats will reduce the current visibility into the enclosure.
7. The proposed improvements meet Process I purpose criteria set forth in FWRC 19.55.020, including
compliance with applicable provisions of FWRC Title 19, "Zoning and Development Code," and health,
safety, and welfare standards.
APPEALS
The effective date of this decision per FWRC 19.05.360 is December 8, 2016. Pursuant to FWRC 19.55.050,
the applicant, any person who submitted written comments or information, any person who has specifically
requested a copy of the decision, or the city may appeal this decision to the Federal Way Hearing Examiner
by December 22, 2016. Any appeal must be in the form of a letter delivered to the Community Development
Department with the established fee. The notice of appeal must contain a statement identifying the decision
being appealed, along with a copy of the decision; a statement of the alleged errors in the director's decision,
including identification of specific factual findings and conclusions of the director disputed by the person
filing the appeal; and the appellant's name, address, telephone number, and fax number, and any other
information to facilitate communications with the appellant.
