Dear Mr. Fadden:
This letter is in response to your request for a two-year extension of the Land Use Process III approval
(File #07-105925-00-UP). Per Federal Way Revised Code (FWRC) 19.15.110, the request must
demonstrate that the applicant is making substantial progress on the development activity, use of land, or
other actions approved under this chapter and that circumstances beyond the applicant's control prevent
compliance with the time limits of FWRC 19.15.100. In reviewing your project's history, it has been
deemed that there has been substantial progress on development activity in regards to the project as
evidenced by the issuance of a commercial grade and fill permit (#09-100855-00-CO) issued on May 8,
2009, and a nationwide economic downturn that is beyond the applicant's control has prevented
compliance with the time limits of FWRC 19.15.100.
However, per FWRC 19.15.110(1), the Director of Community Development may only grant a one-time
one-year extension of time. Therefore, the extension of Land Use Process III #07-105925-00-UP has been
approved through July 12, 2010. City staff is currently undergoing research to prolong the extension of
time allowed granted under FWRC 19.15.110. If you have any questions regarding this letter, please
