Your request is to convert the existing Restoration Life Church into office space. in addition to interior renovations to the 8,880 sq. ft. building, the applicant proposes to demolish the existing concrete trash enclosure, a portion of the landscape area and one parking space. They wi II be replaced by a new trash enclosure. Also, a new curb accessible ramp will be installed. The City of Federal Way Building, Development Services, Planning and Traffic Divisions, and South King Fire & Rescue have reviewed this zoning change of use request. FWRC 19.15.025 addresses a change of use at a developed site as follows: "19.1 5. 025. Zoning and use review process for new tenants — Change of use at a developed s ite. The purpose of this section is to review and determine compliance with applicable zoning and development code requirements when a new use is proposed to occupy an existing building or site. YVhen a land use changes from one use category in the zoning charts to another use category, a zoning compliance review shall be performed as part of the use process review, when required, or in conjunction with the required business registration and/or building permit review. Each paragraph in a zoning chart is a use category. If the new use is in the same use category as any previous legal use of the site, no zoning compliance review is required. " The proposed office use is not located within the same zone chart or use category as a church use; therefore, a zoning compliance review is required as indicated above. Change of Use Analysis — Permitted Use The proposed office is located in the BC (Community Business) zoning district. Offices are a permitted use under the FWRC 19.220.010, `Office/retail — Manufacturing and production,' limited use zone chart. Parking Analysis For the fonner church use, FWRC 19.220.130 required 1 parking space for each 5 seats or 10 lineal feet of bench seating. Required parking under FWRC 19.220.010, `Office/retail — Manufacturing and production,' requires 1 parking space for each 300 square feet of floor area. Mr. Wong .lone 16, 2017 Paue 2 The subject property requires 30 spaces (8,880 sq. ft. /300 sq. ft. = 29.6 spaces). Planning staff have determined the subject property will contain 31 parking spaces after one is removed, thereby satisfying parking requirements for the proposed change of use. Dumpster Enclosure Analysis The city adopted new enclosure requirements, effective May 24"'. Because this change of use application was received on May 18"', the following (old) requirements shall apply. Per FWRC 19.125.150.7.b, space requirements are three square feet of storage space, with a maximum of 1,000 square feet, for every 1,000 square feet gross floor area, with a minimum of 65 square feet. The proposed 128 sq. ft. enclosure meets the size requirement (8,880 sq. ft. /1,000 sq. ft. = 8.8 sq. ft. x 3 = 26.6). Per FWRC 19.125.150.6.b, gate openings should be at least 12 feet wide if garbage and/or recycling drop boxes are used. In all other cases, gates shall be of sufficient width to allow access by recycling collectors and equipment. The proposed gate opening shall be a minimum 12 feet in width. Per FWRC 19.125.040.5, Type III landscaping shall be placed outside of sight -obscuring fences abutting public rights -of -way. The proposed enclosure shows such landscaping. OTHER DEPARTMENT REQUIREMENTS The following comments are provided as information in preparing subsequent permit application submittals to the city. BUILDING DIVISION —Peter Lawrence, Peter.Lawreneec�7c..eityoffecleralway.eom (253-835-2621) Based on the application materials received, the applicant proposes to alter the suite internally. This is a change of occupancy regarding the building department and relevant codes. Approval from the planning department does not constitute freedom to occupy or proceed with any interior or exterior modifications without the required plans and approvals from the applicable departments. The applicant must apply for a tenant improvement building permit approval by submitting the following: 1. (3) sets of architectural drawings. 2. Before and after floor plans. 3. Plumbing plans. 4. Mechanical plans for ventilation. 5. Egress plan. 6. Site plans. 7. Structural calculations and details if applicable. 8. A completed building permit application and commercial checklist. PUBLIC WORKS - TRAFFIC DIVISION — Sarady Long, Sarady.Lon a.citvofrederalwiiv.com (253-835- 2743) The proposed change of use from church to office is expected to generate an additional 8 weekday p.m. trips. The PW Traffic Division will perform concuTrency analysis to determine if adequate roadway capacity exists during the weekday PM peak period to accommodate the proposed change of use. Also, the applicant will be required to pay a traffic impact fee. Based on the proposed 8,880 square feet change of use fi•om a church to general office building, the estimated traffic impact fee is $33,370.72. Please note, the actual impact fee will be calculated based on the fee schedule in effect at the time a completed building permit application is filed and paid prior to pen -nit issuance (FWRC 19.100.070 3(a)). For a change in use for which no building permit is required, the fee shall be calculated and paid based on the impact fee schedule in effect on the date of an approved change of use. Prior to occupying the site the above -mentioned fees must be paid to the Pen -nit Center. Please contact Senior Transportation Planning Engineer Sarady Long if you have any questions. CLOSING Any new use shall comply with only those standards of the zoning and development regulations that are directly related to the new use. This includes parking, setbacks, use -specific notes/regulations, and other department review comments enclosed in this letter. Other nonconforming aspects of the site which are not made nonconforming as a result of the change of use are not required to be brought into conformance as a result of this subsection. The proposed office is allowed in the BC Zoning District. The change of use request is hereby approved. Please be aware you must obtain a Business License approval through the City of Federal Way Finance Department and building permits for site improvements as required by the building department prior to occupying the subject property and operating the new office business.
