The additional two trees are both dead (or dying) and represent a threat to property stored in the area. The felled trees may be left in the buffer area, but take care to avoid damaging other healthy trees and plants in the area. Stumps in the range of 6 -10 feet should be left in place. One of the trees appears to be located within a wetland buffer (the other is just outside the buffer). Code interpretation 1,410-01 authorizes removal of hazardous trees from critical areas such as wetland buffers under certain circumstances as addressed below. 1. The proposed activity will not adversely affect water quality. 2. The proposed activity will not destroy nor damage a significant habitat area. 3. The proposed activity will not adversely affect drainage or stormwater retention capabilities. 4. The proposed activity will not lead to unstable earth conditions nor create erosion hazards. 5. The proposed activity will not be materially detrimental to any other property nor to the city as a whole, including the loss of significant open space. 6. The proposed activity is necessary to: a. Maintain existing pathways and landscaping, ensure the health of existing vegetation, achieve limited pruning to allow for view maintenance, reduce tree mass or redirect tree growth, or similar purposes; and/or b. The proposed activity is necessary to minimize potential impacts from dead, dying, diseased, or otherwise dangerous or nuisance vegetation. 7. The proposed activity does not require review under the State Environmental Police Act (SEPA). 8. The proposed activity is consistent with the requirements of Chapter 19.120, ('louring, Grading, and Tree anti 11c,clalion Relenlion. The proposal satissfies each of the above triter =. We have had a tree break in half in the last year and it fell on the fence line. Now it looks like the second tree is about to fall and it looks like once it falls, it may damage not only the fence line but also customer's vehicles. We first contacted the city of Federal Way parks maintenance and they sent over Jim Barber. Jim from the city of Federal Way confirmed with me that the tree is on our property and that the property line goes much deeper than what the fence shows. The law is that no one can fence in the wetland therefore they had to fence just outside the wetland on our property. He also said that if we want to remove any tree that is larger than 6 inches, we need to send a request to the community development department. Today as we were doing a lock check, we realized that the tree seems to be getting weaker and combined with the gusty winds, it seems like just a matter of time before it falls. We are writing to you so that you can direct us to a direction where the tree is taken down with accordance to the city of Federal Way ordinance and at the same time minimize the risk it may bring if it were to fall. Please get back to us at your earliest convenience. We have also attached pictures of the tree and the one that has already fallen and is broken in half.
