Dear Ms. Smith:
The Department of Community Development Services is in receipt of your Process I Master Land Use
application submitted to the city on August 6, 2010. The Process I application is hereby approved pursuant to
the findings presented by the department's Planning staff and the conclusions based on those findings.
FINDINGS OF FACT
1. Proposal — The applicant is requesting Process I `Director's Approval' for a mobile espresso cart located
at an existing retail automotive repair business. The mobile cart will be located outdoors under a covered
patio near the front entrance of the existing storefront. Electricity will be provided via an existing exterior
outlet located within three feet of the cart's proposed location. The proposed cart is intended to offer
beverages and pre -packaged food to customers of the retail facility waiting for automotive repairs.
2. Outdoor uses — Pursuant to Federal Way Revised Code (FWRC) 19.125.170, commercial uses conducted
outdoors are subject to Process I approval. Espresso carts are exempt from specific site plan, use and
development requirements of the "Outdoor Activities and Storage" title section. The espresso cart will be
located under the existing covered patio and footprint; therefore, no gross floor area expansion is
proposed.
3. Applicant submittal —The following items were included with the Process I Master Land Use application:
(1) general site plan; (2) photos of the espresso stand; and (3) written narrative of the proposal. The
application was determined complete at intake.
Comprehensive plan & zoning designation — The subject property is located within a Commercial
Enterprise (CE) comprehensive plan and zoning designation. The existing automotive repair business and
proposed mobile espresso cart are permitted uses in CE zoning districts pursuant to FWRC 19.240.050
and 19.240.070, respectively.
5. Accessory use — The proposed espresso cart is an accessory use to the existing retail automotive repair
business. The footprint of the espresso cart is less than the principal structure building footprint.
6. Circulation — The proposed location of the espresso cart provides adequate space for pedestrian
circulation. The front entrance is unobstructed from the cart's customer queue. Outdoor seating will be
provided east of the front entrance for espresso/automotive repair customers. The espresso cart serves
walk-up patrons only and does not have a vehicle queuing lane. The cart does not inhibit safe vehicular
and pedestrian movement to, from, and on the subject property.

7. Environmental review — The proposed espresso cart does not exceed categorical exemption thresholds;
therefore, an environmental checklist and threshold determination are not required pursuant to State
Environmental Policy Act Rules 197-11-800(2)(d).
CONCLUSIONS
Various sections of the Zoning and Development Code indicate that certain developments, activities, or uses
are permitted only if approved using Process I — Director's Approval. Based on the findings above, the
proposed improvements to the developed site meet the following Process I approval criteria, land use review
thresholds, and accessory use authority of FWRC 19.15.030, 19.55.020, and 19.125.170, respectively:
1. There is no change of use;
2. There is no reduction in the amount of required landscaping, buffering, open space, or public areas;
3. There is no material change or reduction in the amount of required parking;
4. There is no material change in the location of utilities, easements, or pedestrian connections;
5. There is no material change to the approved architectural design; and
6. There are no additional adverse impacts to sensitive areas or significant trees.
7. The proposed improvements are consistent with applicable chapters of FWRC Title 19 `Zoning &
Development Code' including, but not limited to: Community Design Guidelines; Outdoors, Yards &
Landscaping; Commercial Enterprise (CE); and Accessory Uses & Facilities;
8. The health, safety and welfare of the citizens of the city are preserved;
9. The proposed espresso cart is an accessory use and clearly secondary to the existing automotive repair
business.
APPEALS
The effective date of this decision is August 15, 2010, or three days from the date of this letter. Pursuant to
FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative
decision may appeal the decision to the Federal Way Hearing Examiner by August 30, 2010. Any appeal must
be in the form of a letter delivered to the Department of Community Development Services with the
established fee.
However, as you are the only party of record, you may waive your right to appeal this decision. If you wish to
waive your right to appeal, you must do so in writing to the Department of Community Development Services.
No work on the proposal may begin until the end of the appeal period or receipt of your waiver and building
permit issuance.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
