The City of Federal Way's Community Development Department has completed an administrative review for
the proposed Town Square Park located at 31600 20th Avenue South. The Process II land use application
submitted on April 24, 2014, is conditionally approved as the proposal meets site plan and community
design guideline criteria set forth in Federal Way Revised Code (FWRC) 19.60.050 as found in the enclosed
ExhibitA — Findings for Process II Site Plan Approval. The remainder of this letter outlines the condition of
approval, land use review process required for this proposal, and a summary of appeal procedures.
REQUIRED REVIEW PROCESS
The proposed improvements to the existing developed site are subject to Process II Site Plan Review
pursuant to FWRC 19.15.030(4). The proposed addition is categorically exempt from an environmental
threshold determination pursuant to State Environmental Policy Act Rules 197-11-800(1)(b).
CONDITION OF APPROVAL
1. Add one additional accessible parking stall for a total of five.
APPROVAL DURATION
Unless modified or appealed, the Process II decision is valid for five years from the date of issuance of the
decision. Time extensions to the decision may be requested prior to the lapse of approval following the
provisions listed in FWRC 19.15.110. The improvements must be substantially completed within the five year
time period or the land use decision becomes void.
APPEALS
The effective date of this decision is May 10, 2014. Pursuant to F%IVRC 19.60.080, any person who received
notice of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by May
26, 2014. A written appeal must be delivered to the Community Development Department with the

established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement
of the alleged errors in the decision. No work on the proposal may begin until the end of the appeal period.
However, as you are the only party of record, the appeal period is hereby waived (this action allows the work
to begin iirunediately upon die effective date noted above).
CLOSING
This land use decision does not waive compliance with future City. of Federal Way codes, policies, and
standards relating to this development. This Process II approval does not constitute approval of a building or

Findings for Process II Site Plan Approval
Town Square Park

The Planning Division hereby presents the following analysis to the Director of Community Development
pursuant to content requirements of the Process II written decision as set forth in Faleral Way Reused Ca-k
(FWRQ 19.60.070.
1. Prr ,d — The project applicant proposes to construct an interim public park on the site of a former
movie theater. The site in its current condition is a paved parking lot —the theater building is
demolished. Park improvements include a sod play field, basketball courts, pea patch garden, staging
area for Federal Way Farmer's Market, grills, seating, parking, landscaping, port-a-pordes, and other
amenities. At some point in the future, the park is intended to be replaced with a combination of private
sector development and new permanent public park
2. RedewPnxess —The proposed improvements to the site are subject to Process II review pursuant to
FWRC 19.15.030(4) and 19225.100.
3. C,arpm�aciwPlan & ZonirglIsknraaaa— The subject property is located within the City Center -Core
(C(--C) comprehensive plan and zoning designation. The property's proposed use of public park is a
permitted use within the CGC zoning designation pursuant to FWRC 19225.100.
4. Enun mr trd Reuvw— The proposed improvements are exempt from environmental review as they do
not exceed the definition of "minor new construction" as set forth in WAC 197-11-800(1)(b).
5. Wr1A — A Killdeer bird was discovered to be nesting on the site. The city consulted with the
Washington State Department of Fish and Wildlife (WDFW). WDFW advised the city to cordon off the
area of the nest during anywork and that the hatchlings would leave the nest within 24-hours of
hatching. Accordingly, the city has cordoned off the nest during any preliminary patching and demo
work on the site and will continue to do so until the birds leave.
6. Hag% Sys, and Lot Cage— Setback requirements for public parks in the CGC none are
determined on a case-byrcase basis at the director's discretion. Given the urban setting, zero -setbacks
are appropriate and therefore, all improvements meet setback requirements. Allowed height limit is 75
feet. No maximum lot coverage applies.
7. Parking— Pursuant to FWRC 19.225.100, parking For parks is determined on a case-b),case basis at the
discretion of the director. The Parks Director has determined that the 130 proposed parking spaces are
more than adequate for this park facility.
8. Ligkirg— No lighting is proposed for the park Existing light poles exist on site and will be demolished
as there is currently no power to the site. Hours of park operation will be from dawn to dusk as is
typical of parks. Therefore, lighting is not required
9. LarAcaparg— Perimeter landscaping is not required along property lines adjacent to rights -of -way with
zero -setback requirements. As identified in # 6 above, the director has determined that this use has zero -
setbacks and therefore, perimeter landscaping is not required for an urban park use along any right -of -

way (20th Avenue South, 21- Avenue South, or South 316th Street). Perimeter landscaping would be
required along the south property line, which is nonconforming w0i regard to the type of plantings in
the existing perimeter planting area. The trigger for bringing this condition into conformance is that
when square footage is added to the site in the form of a new structure, the nonconformities in that
geographic part of the site must be brought into conformance. New square footage is not proposed.
The existing on -site parking stalls are nonconforming, to varying degree, with the code requirement to
provide 22 square feet of interior parking lot landscaping per parking stall. The trigger for bringing this
condition into conformance, as noted above, is that when square footage is added to the site in the form
of a new structure, the nonconformities in that geographic part of the site must be brought into
conformance. In that no new structures are proposed in the vicinity of the existing parking spaces to be
utilized, interior lot landscaping is not required to be brought into conformance. The applicant is,
however, proposing to install some additional landscaping planters in the area of the parking stalls to
improve the aesthetics of this area and, thus, is increasing the conformity of this part of the site.
10. QrmwatyDiesign Guidelines —The only relevant design guidelines are those addressing pedestrian
circulation and surface parking.
a) Pedestrian pathways and pedestrian areas are incorporated into the site design. Several new
pathways are depicted as painted lines. This thematic feature is typical of parks. Additionally, the
park is intended to be an interim improvement, which will eventually be replaced when the site is
redeveloped. Therefore, it does not make sense to install expensive paving on an interim basis. For
these reasons, and pursuant to FWRC 19.115.020 on -site pathways do not need to meet the
requirements of FWRC 19.115.050(4)(b) and 19.115.090(3)(d).
b) In the CGC zone, parking may not exceed more than 25% of the frontage along principal
pedestrian rights -of -way. The parking area fronts on much less than 25% of such rights -of -way.
11. Transportation— The Public Works Traffic Division has determined that the proposed improvements do
not trigger the requirement to submit a concurrency application, pay the traffic impact fee, or construct
frontage improvements. This is because the value of the improvements as related to the value of the
property does not trigger the requirement, and because of the credited vehicular trips associated with the
prior use of the property.
12. SwmuQuter— The Public Works Department has determined that the proposed improvements do not
trigger any surface water control or water quality requirements for reasons similar to those noted above
under # 11.
13. Derision Criteria — Staff finds the proposal is consistent with applicable site plan approval criteria required
for Process II as set forth in FWRC 19.60.050. The proposal is consistent with the city's comprehensive
plan, applicable provisions of FWRC Title 19, "Zoning and Development Code"; public health, safety,
and welfare; and streets and utilities in the area are adequate to serve the anticipated demand from the
proposal. The proposal is consistent with community design guideline decisional criteria set forth in
FWRC Chapter 19.115.
Final construction drawings will be reviewed for compliance with specific regulations, conditions of approval,
and other applicable city requirements. These findings shall not waive compliance with future City of Federal
Way codes, policies, and standards relating to this development.

The PW Traffic Division is supportive of allowing one crosswalk with proper signage at the south end of property on 21 t
Avenue South. This crosswalk would provide direct pedestrian path/access between the interim park and the FW Transit
Center. However, it appears that there is a small retaining wall along the west side of the street which should be graded
to meet ADA.
The proposed crosswalk to the north should be eliminated as it does not provide direct link between the interim park
and the FW Transit Center. In addition, pedestrian would need to cross longer distance and potentially block by vehicles
at the intersection. Also, the existing 30' driveway curb cut on the east side of the street would need to be improved to
meet ADA requirement.
