I have completed a preliminary site plan review of your application. There is an issue that needs to be resolved before my review can continue. Per Federal Way City Code(FWCC) Section 22-334(3) (enclosed), if an applicant proposes to increase the gross floor area of any use on the subject property, then the applicant shall comply with all development regulations currently in effect. Any existing improvements on the property that are nonconforming must be brought into compliance. The only improvement on your property that seems to be nonconforming is the driveway; it is nonconforming for two reasons. 1. According to FWCC Section 22-1453(a) and(b), all parking areas and the first forty feet of residential driveways must be surfaced with a material comparable or superior to the surface material of the adjacent street. As SW 368th Street is paved, you must at a minimum pave the first forty feet of your driveway and any areas that you intend to use for parking. 2. The existing driveway also exceeds the maximum width allowed in the required front yard (in your case, the front twenty feet of the property). A driveway serving a two-car garage may not exceed twenty feet in width within the required front yard, although it may flare to a maximum of thirty feet at the street. Additionally, the driveway must be set back a minimum of five feet from the side property line(FWCC Section 22-1135(1)(a)). Please revise your site plan to reflect the above requirements and resubmit two copies of your revisions. Please note that the City of Federal Way will not require you to remove any gravel that is already existing in the side yard, however, you may not drive or park vehicles within five feet of the property line. Similarly, in the front yard, although the newly paved part of the Doc.I.D. Pzi driveway may not exceed twenty feet in width, the City will not require you to remove existing gravel beside the paved driveway. However, the gravel in the front yard may not be used for driving or parking of vehicles.
