Thank you for participating in the preapplication conference with the City of Federal Way's Development
Review Committee (DRC) held March 9, 2017. We hope that the information discussed at that meeting
was helpful in understanding the general requirements for your project as submitted.
This letter summarizes comments given to you at the meeting by the members of the DRC. The members
who reviewed your project and provided comments include staff from the city's Planning and Building
Divisions and Public Works Department, and representatives from Lakehaven Utility District and South
King Fire & Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information
handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable
codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes
for all additional requirements that may apply to your project.

PROJECT DESCRIPTION
The proposal is to subdivide three lots into 10 single family lots through a testamentary subdivision. The
applicant requested to know whether the lots would be buildable.
MAJOR ISSUES
Outlined below is a summary of the major issues of your project based on the plans and information
submitted for preapplication review. These issues can change due to modifications and revisions in the
plans. These major issues only represent comments that the DRC consider most significant to your project
and do not include the majority of the comments provided. The major issues section is only provided as a
means to highlight critical requirements or issues. Please be sure to read the entire department comments
made in the neat section of this letter.

■ Planning Division
1. A Subdivision Application to the city is not required for divisions made by testarnentary
provisions.
2. An applicant may build one detached dwelling unit on a nonconforming lot if the owner does not
own contiguous lots.
• Public Works Development Services Division
1. This project meets the requirements for a Full Drainage Review.
2. The project lies within a Flood Problem flow control area; thus, the applicant must design the
flow control facility to meet this performance criteria.
• Public Works Traffic Division
1. Traffic Impact Fees (FWRC 19.91) —Traffic impact fees are required for single-family
residential dwelling units.
2. Frontage Improvements (FWRC 19.135.040) — Construct street frontage improvements along
the property frontage on 8"' Avenue S.
• Lakehaven Water & Sewer District
A Certificate of Water Availability and a Certificate of Sewer Availability issued separately by
Lakehaven may be required to be submitted with any land use and/or building permit applications.

1. Per FWRC 18.05.030, subdivision review is not required for divisions made by testamentary
provisions.
2. State EnViro77117ental Policy Act (SEPA) — Applications for residential structures up to 20 dwelling
units are exempt from the requirements of SEPA review, per FWRC 14.15.030(a).
3. Fees —As development fees change annually, please contact the Permit Center at 253-835-2607, or
penniteenteraeityoffederalway.Cotn, for an updated fee list prior to submitting your application.
Additional utility fees, school impact fees, concurrency, and engineering plan review fees may apply.
4. Lot Sipe — The zoning for the subject site is Single -Family Residential (RS) 7.2. The minimum lot
size for each lot is 7,200 square feet. Property set aside in tracts (access and/or stormwater) cannot
count towards the minimum lot area per FWRC 19.05.120 "lot area." An applicant may build one
detached dwelling unit on an undersized lot if the owner does not own contiguous lots; otherwise,
contiguous lots must be combined per FWRC 19.105.010(2)(b).
5. Setbacks — Any existing structures and future structures must conform to the following structural
setback requirements of FWRC 19.200.010, "Detached Dwelling Units": front yard — 20 feet; side

yard — 5 feet; and rear yard — 5 feet. Side yard setback for a corner lot for that portion of the lot not
adjacent to the primary vehicular access is 10 feet, otherwise 5 feet.
6. Miscellaneo its Single -Family Residential Regulations —
a. Maximum height of structures — 30 feet above average building elevation.
b. Maximum lot coverage— 60 percent.
c. Required parking spaces — two per dwelling unit.
7. Driveways — Per FWRC 19.130.240, "Driveways and parking areas":
"Vehicles may not be parked in required yards except as follows:
"(1) Detached dwelling units. The regulations of this section apply to driveways and parking
areas for detached dwellin, units.
"(a) Generally. Vehicles may not be parked in a required side yard, but may be parked in the
required front and rear yards only if parked on a driveway and/or parkin, pad. A driveway
and/or parking pad, in a required front yard, may not exceed 20 feet in width except as
specified in subsection (1)(b) of this section and may not be closer than five feet to any side
property line.
"(b) Exception. A driveway and/or parking pad in a required fi-ont yard may exceed 20 feet in
width if:
"(1) It serves a three -car garage;
"(ii) The subject property is at least 60 feet in width; and
"(ill) The garage is located no more than 40 feet from the front property line.
"In addition, a driveway may flare at the front property line to a maximum width of 30 feet."
8. Clearing, Grading, and Tree and Vegetation Retention — Building permit applications are subject to
the provisions of FWRC 19.120, "Clearing, Grading, and Tree and Vegetation Retention." A clearing
and grading plan that meets FWRC 19.120.020 and FWRC 19.120.040 must be submitted prior to
Building permit issuance.
9. Tree Density Requirements — The new lots will be subject to tree density requirements of FWRC
19.120.130(1); note that 25 tree -units per acre are required for single-family zoned sites. A tree unit is
a value assigned to existing trees retained on the property or replacement trees. The larger the tree, the
greater value it is assigned. Required tree density can be composed of retained trees and replacement
plantings per FWRC 19.120.130. The tree and vegetation plan must clearly show where the tree units
are to be located. The building permit application must indicate what trees are to be removed.
Tree unit credits are in Table 2 of FWRC 19.120.130(2). Per FWRC 19.120.130(3), the total number
of tree units required to be provided is calculated by multiplying gross lot acreage, minus any streets or
easements.
If an applicant cannot provide for the minimum tree units per acre on site, off -site mitigation or a fee -
in -lieu payment to the city's urban forestry account, may be approved by the director. See FWRC
19.120.140 for off -site mitigation and fee -in -lieu payment requirements.
10. School Impact Fees — School impact fees (currently S3,35 % per single-family home) are due at the
time of the building permit application for new dwelling units and are subject to the fee schedule in

effect at that tune. This fee amount is subject to change as determined annually by the Federal Way
School District.
PW DEVELOPMENT SERVICES DIVISION (Ann Dower, 253-835-2732, nnn.dower(e citvofFederalwav_com)
Please note: Since this is a testamentary subdivision, the following comments will apply when a
building permit or engineering permit application is submitted.
Land Use Issues — Stormwater
1. Surface water runoff control and water quality treatment will be required per regulations in place at
the time a complete application is submitted or as determined by state law at that time. Currently, the
2016 King CountySinface Water Design Manual (KCSWDM) and Federal Way Revised Code
(FWRC) are regulating documents.
This project meets the requirements for a Full Drainage Review. At the time of land use site plan
submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project
to the nine core and five special requirements of the KCSWDM will be required. A Level i
downstream analysis shall also be provided in the preliminary TiR. The City has 1"= 100', five-foot
contour planimetric maps that may be used for basin analysis.
2. The project lies within a Flood Problem flow control area, thus the applicant must design the flow
control facility to meet this performance criteria. In addition to flow control facilities, Best
Management Practices (BMP's) are required as outlined in the KCSWDM. The project also lies
within Enhanced Basic Water Quality Area. Water Quality Treatment shall be designed to meet the
treatment criteria of the Enhanced Basic Water Quality Menu.
3. if infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer
must be provided to verify infiltration suitability.
Detention and water quality treatment facilities for subdivisions are required to be above ground
(i.e.an open pond), within a separate storm drainage tract, and dedicated to the City for future
maintenance. Detention and water quality facilities may be within the same tract. Underground
facilities are allowed only with approval from the City of Federal Way Stormwater Management
Division.
5. Detention and water quality facilities must be above ground (i.e. open pond). Underground facilities
are allowed only with approval from the City of Federal Way Public Works Department.
6. Show the proposed location and dimensions of the detention and water quality facilities on the
preliminary plans.
7. If more than one acre will be disturbed during construction, a National Pollutant Discharge
Elimination System (NPDES) construction storm water permit may be required. Information
rec,arding this permit can be obtained from the Washington State Department of Ecology at

Right -of -Way Improvements
1. See the Traffic Division comments from Erik Preston, Senior Traffic Engineer, for traffic related
items.
2. If dedication of additional right-of-way is required to install street frontage improvements, the
dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must
have clear title prior to recording.
3. All stormwater treatment and detention requirements outlined above may apply to any improvements
within the public right-of-way.
4. FWRC 19.135.280 requires that driveways serving residential uses may not be located closer than 25
feet to any street intersection. Lots and intersections within new subdivisions or short plats must be
designed to meet this standard.
Building (or EN) Permit Issues
1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be
reviewed and approved by the City. Engineering review fees are currently $2,430.00 for the first 12
hours of review, and $135.00 per hour for additional review time. A final TIR shall be prepared for
the project and submitted with the engineering plans. Both the TIR and the plans will require the
signature/seal of a professional engineer registered/licensed in the state of Washington.
2_ In addition to engineering approval, short plats and subdivisions are required to obtain a separate
permit for grading. Details and fees may be obtained from the Building Department.
The Federal Way Public Works Development Standards Manual (including standard detail drawings,
standard notes, and engineering checklists) is available on the City's website at:
www.cityoffederalway.com/node/1467 to assist the applicant's engineer in preparing the plans and
TI R.
4. Bonding is required for all street improvements and temporary erosion and sediment control measures
associated with the project. The bond amount shall be 120 percent of the estimated costs of the
improvements. An administrative fee deposit will need to accompany the bond to cover any possible
legal fees in the event the bond must be called. Upon completion of the installation of the
improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30
percent of the original amount and held for a two-year maintenance period.
The developer will be responsible for the maintenance of all storm drainage facilities (including the
detention and water quality facilities) and street systems during the two-year maintenance period.
During that time, the Public Works Inspector will make periodic visits to the site to ensure the
developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-
year maintenance period, the remainder of the bond will be released. Maintenance for public roads
and subdivision drainage facilities then become the responsibility of the City. Maintenance for private
roads and drainage facilities, including short plats, remain the responsibility of the individual property
owners.

6. When topographic survey information is shown on the plans, the vertical datum block shall include
the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations
are called out.
Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. Site plans shall
be drawn at a scale of 1" = 20', or larger. Architectural scales are not pennitted on engineering plans.
8. Provide cut and fill quantities on the clearing and grading plan.
9. Temporary Erosion and Sediment -control (TESC) measures, per Appendix D of the 2016 KCSWDM,
must be shown on the engineering plans.
10. The site plan shall show the location of any existing and proposed utilities in the areas affected by
construction.
PUBLIC WORKS TRAFFIC DIVISION

Transportation Impact Fees (TIF) (FWRC 19.91)
Based on the submitted materials for 10 new single-family homes, less one existing single-family home,
the estimate total traffic impact fee is $35,922.55. The actual fee will be assessed and collected from the
applicant when the building permit is issued, using the fee schedule then in effect (FWRC 19.100.070
3(c)). At any time prior to building permit issuance, the applicant may request to defer to final building
inspection the payment of a transportation impact fee for a single-family residential dwelling unit (FWRC
19.100.075). If this option is selected, a covenants prepared by the city to enforce payment of the deferred
fees will be recorded at the applicant's expense. Refer to defer payment of impact fee code for process.
Street Frontage Improvements (FWRC 19.135)
The applicant/owner would be expected to construct street improvements consistent with the planned
roadway cross -sections as shown in Map 111-4 in Chapter III of the Federal Way Comprehensive Plan
(FWCP) and Capital Improvement Program (CIP) shown as Table III-10 (FWRC 19.135.040). Based
on the materials submitted, staff conducted a limited analysis to determine the required street
improvements. The applicant would be expected to construct improvements on the following streets
to the City's planned roadway cross -sections:
8"' Avenue S is a Minor Collector planned as a Type "S" street, consisting of a 36-foot
street with curb and gutter, 4-foot planter strips with street trees, 5-foot sidewalks and
streetlights in a 60-foot right-of-way (ROW). Assuming a symmetrical cross section, no
ROW dedication is required, but half -street improvements are required as measured from
the street centerline OR far side edge of travel way.
2. The applicant may make a written request to the Public Works Director to modify, defer, or waive the
required street improvements (FWRC 19.135.070). Information about right-of-way modification
requests is available through the Public Works Development Services Division. These modification
requests have a nominal review fee currently at $290 ($270.00 plus $20 recording fee).

3. Tapers and transitions beyond the project frontage may be required as deemed necessary for safety
purposes, taper rate shall be WS^2/60 or as directed by the Public Works Director.
Access Management (FWRC 19.135)
The proposed access driveway onto 8`' Avenue S may be restricted if such access would interfere with the
95`h percentile queue lengths frorn any existing traffic control device. Of particular concern are the queue
lengths from the traffic signal on the southbound approach of 8`' Avenue S to S 312`h Street. Currently,
the 95°i percentile queue length is approximately 78 feet in the PM peak hour, which leaves approximately
40 feet of storage remaining to the centerline of the proposed driveway.
Misc. Safety related Comments
The City will monitor traffic conditions (queuing, collisions, etc.) on 8°i Avenue S and shall reserve the
right to limit access to right -in and right -out at such time deemed necessary.
BUILDING DIVISION (Peter Lawrence, 253-835-2621, peter. lawrencertD.citvoffederaIw•ay.com)
1. Land use shall be completed and approved prior to the submittal of building plans. Land use
applications and building permit applications are not tied together as far as time limitations for
expiration of an application.
2. Geotechnical reports for soil conditions are required.
3. All building setbacks shall be required.

General
• Lakehaven has no specific comments on the proposed testamentary subdivision, as based on the
submittal it appears no existing and Lakehaven water/sewer facilities will be affected by the proposed
land use action.
• All other comments herein are valid for one (1) year and are based on the proposal(s) submitted and
Lakehaven's current regulations and policies. Any change to either the development proposal(s) or
Lakehaven's regulations and policies may affect the above comments accordingly.
• All Lakehaven Development Engineering related application forms, and associated standards
information, can be accessed at Lakehaven's Development Engineering web pages

Water
• A Certificate of Water Availability issued separately by Lakehaven may be required to be submitted

Pre -Design Meeting or a DE Agreement. Lakehaven encourages owners/developers/applicants to
apply for Lakehaven processes separately to Lakehaven, and sufficiently early in the pre-
design/planning phase to avoid delays in overall project development.
• The site currently has one (1) existing residential water service connection (SvcNo 3866, 5/8"x3/4"
meter).
• A water service connection application submitted separately to Lakehaven is required for each new
service connection to the water distribution system, or any modification to an existing water service

On August 17, 2016, Robert Verzani passed away, and in his Codicil he provided under RCW
58.17.040(3) that his three lots be divided under a testamentary division into 10 lots, provide a roadway
and other improvements for 10 homes to be created, with reservation for water retention and side walks
as required by local zoning.
The attached Initial and Alternative Plans, both provide for the Testator's last wishes, each having an
alternative means to accomplish his wishes.
The Initial Plans propose a series of 10 lots with an easement over all 10 for the roadway to enter from
8tn Avenue. The purpose of this set of plans is to provide for all 10 lot owners to maintain the street and
utilities to access their homes. Each lot, after the common easement is removed provides lots more than
7,200 square feet.
The Alternative Plans propose a series of 10 lots with a roadway and each lot being more than 7,200
square feet.
At this time the Estate of Robert J. Verzani, through this Application seeks confirmation as to the
ability to build homes on the above lots.

The Last Will and Testament filed herein was duly executed by ROBERT J.
VERZANI on January 26, 2015, in the presence of two competent subscribing witnesses

time of executing the document, above the age of majority and of sound mind and not

I, ROBERT J. VERZANI, of 31095 8th Avenue South, Federal Way, King
County, Washington, being of -sound and disposing mind and memory and not acting
under duress, menace, fraud or the undue influence of any person whomsoever, do make,
declare and publish this my Codicil to My Last Will and Testament bearing the date of
January 26, 2015, amending my Will and any codicils heretofore made by me.
ARTICLE 1
Subdivision of Parcels
I, being the owner of three parcels of land located at 31095 81h Avenue South in Federal
Way, King County, Washington, being tax lot numbers 0821049179, 0821049030, and
0821049199, hereby divide said lots pursuant to RCW 58.17.040(3) into a cul-de-sac
exiting onto 8th Avenue South, with ten (10) lots of 7,200 square feet each, with an area
reserved for appropriate water retention and side walks as required by local zoning code.

KNOW ALL MEN BY THESE PRESENTS, That I, ROBERT J. VERZANI, of
31095 8TH Avenue South, King County, Washington 98003, being of sound and disposing
mind and memory, and not acting under duress, menace, fraud, or the undue influence of
any person whosoever, do make, publish and declare this my Last Will and Testament,
hereby revoking any and all former wills and codicils heretofore made by me.
ARTICLE I.
IDENTIFICATION OF FAMILY
I hereby declare that I am a single man. I have five (5) children, namely.Karl, Gail,
John, Philip and Marc, I have no deceased children or children of deceased children.
Except as provided below, I make no provision in this Will for any person who claims an
interest in my estate as a child of mine or the descendant of a deceased child of mine.
ARTICLE II.
BE VESTS
2.1 At my death, I may have prepared a hand written and/or signed list defining
the persons to'whom I wish certain items of tangible personal property to pass. I intend that
list to conform to RCW 11.12.260 as a consequence of which the property listed thereon
shall pass in accordance with such list.
2.2 I hereby give, devise and bequeath all of the rest, residue and remainder of
my estate as follows:
a, The sum of one.dollar ($.1,00) to daughter'Gail. -
' b. The rest, residue and remainder of my estate, I give, devise and bequeath
as follows:
c. Twenty Five (25) percent to son, Philip; Twenty Five (25) percent to
Karl; Twenty;Five (25) percent to John and Twenty Five (25) percent to Marc; provided
however, if any son shall receive funds from a Joint Tenancy With Right of Survivorship
(TWROS) and/or a life insurance policy or from any other single source, the amount so
received shall- be debited from the twenty five (25) percent. It being the my intent that each
son receive equal amounts regardless of the source of funds.
d. If any of my beneficiaries predecease me leaving surviving descendants,
then the share that would otherwise be received by that deceased beneficiary shall pass to

his or her then living descendants by right of representation; and in the absence of
descendants, the gift shall lapse.
ARTICLE III.
PAYMENT OF DEBTS
I hereby direct and order that all just debts for which proper claims are flied against
my estate, and the expenses of my Iast illness and funeral, be paid by my personal
representative as soon after my death as is practicable; provided, however, that this
direction shall not authorize any creditor to require payment of any debt or obligation prior
to its normal maturity in due course.
ARTICLE IV.
APPOINTMENT OF PERSONAL REPRESENTATIVE
WITHOUT BOND AND WITH NONINTERVENTION POWERS
4.1 I nominate and appoint John and Marc, Personal Representatives of my
estate. In the event one is unable or unwilling to so act, then I appoint the other, as
Personal Representative.
4.2 Said Personal Representative(s) is to act as such without bond and without
the intervention of any court, except as may be required under the laws of the State of
Washington in the case of a nonintervention Will. My Personal Representative shall have
the full power to sell, convey and encumber without notice or confirmation, any assets of
my estate, real or personal, at such prices and terms as to my Personal Representative may
seem just; to advance funds and borrow money, secured or unsecured, from any source, to
mortgage or pledge estate properties; to select any part of the estate in satisfaction of any
partition or distribution hereunder, in kind, in money, or both. Such powers may be
exercised whether or not necessary for the administration of my estate.
ARTICLE V.
TAXES
My Personal Representative shall pay all estate inheritance and succession taxes
assessed by reason of my death whether attributable to property passing under this Will or
outside of it from the residue of my estate disposed of by this Will.
ARTICLE VI.
MISCELLANEOUS
6.1 I revoke entirely all prior Wills.
6.2 Unless some other meaning and intent is apparent from the context, the plural
shall include the singular and vice versa, and masculine, feminine and neuter words shall be
used interch-pgeably.

6.3 Burial: It is my desire that I be interred in the Catholic South Creek Cemetery
at Ponca, Nebraska adjacent to my father, Philip F. Verzani. No cremation.
ARTICLE VII.
PROOF OF WILL
It is my desire that this Will be proved and admitted to probate in accordance with
the provisions of RCW 11.20.020(2), and I hereby declare that at the time of execution of
this Will, I have requested the subscribing witnesses to execute a declaration as provided
for in Washington Law.
