BACKGROUND Pursuant to Federal Way City Code Section 22-394, the Director of Community Development Services shall use the decisional criteria contained in Section 22-394 in deciding upon a Process I application. The Director may approve the application only if; 1. It is consistent with the comprehensive plan; 2. It is consistent with all applicable policies of the zoning code; and 3. It is consistent with the public health, safety, and welfare. FTMnTMaq 1. The site is located at 37515 8th Avenue South, within the RS-35.0 (Residential Single Family minimum lot size 35,000 square feet) zoning district. The vicinity of the site is rural in nature. 2. The proposal is to construct a 4,040 square foot gymnasium/multi-purpose building, 18 parking stalls, landscaping, street improvements and stormwater drainage facilities. 3. The site is designated Low Density Single Family Residential in the City's Adopted 1995 Comprehensive Plan "CityShape". Findings and Conclusions for Process I Review UPR96-0009 June 5, 1997 Page 2 4. The site is presently developed with an approximately 4,800 square foot building which is used for a private school. Two small accessory buildings and fenced play area exist on the site. 5. Pursuant to Federal Way City Code (FWCC) Section 22-639, a school use is permitted in the RS zoning district subject to Process I review. 6. Pursuant to FWCC Section 22-366, if a project is subject to Process I review, the site plan review will be put in writing and form the basis of or be an exhibit to the staff report to the Director of Community Development under Process I review. This document comprises the findings for the site plan and findings for Process I approval. 7. The site was posted with a Notice of Process I and SEPA application on April 5, 1996. A copy of the notice of application was also posted on the City's official notice boards and in the Federal Way News on April 4, 1996. No comments were received on the notice of application. 8. Following review of an environmental checklist and other pertinent information, the City of Federal Way issued State Environmental Policy Act (SEPA) Determination of Non - significance (DNS) for the project on May 4, 1997. No comments or appeals were received on the SEPA decision. 9. The City Traffic Division did not require a Traffic Impact Analysis because the project does not generate an additional 10 peak hour trips. The applicant developed a parking analysis dated October 4, 1994 that verified the adequacy of the 25 on -site parking stalls plus occasional use of available on -street parking. 10. The project meets the applicable height, bulk and dimensional standards of the FWCC. 11. Pursuant to FWCC section 22-335, signage on the site must comply with current standards. Two freestanding signs on site must be removed and/or modified to comply with applicable standards. Any non -conforming signage must be brought into compliance with current standards prior to final occupancy of the proposed building. A sign permit is required for modification of signage on the site. 12. The proposed improvements are valued at $220,000 while the Findings and Conclusions for Process I Review UPR96-0009 June 5, 1997 Page 3 existing improvement value is assessed at $105,000. Pursuant to FWCC section 22-337, in addition to parking, signage and buffering, all site elements must be brought into conformance with applicable code standards because the proposed improvement value exceeds 50 percent of the existing improvement assessment. 13. No other site elements are non -conforming other than the street improvement discussed in item 17 below. 14. Pursuant to Note 5 of FWCC section 22-639, the school serves the area in which it is located. The existing school use and the proposed site expansion will not be detrimental to the vicinity in which it is located. 15. The addition of the proposed gymnasium/multi-purpose building will not result in increased student population. Therefore the normal hours of operation of the school will not be modified by this proposal. Occasional use of the proposed building for school related performances does not warrant a limitation of hours of use for the site as allowed by FWCC section 22-639 Note 4. 16. Per note 6 of FWCC section 22-639, the parking and loading area is located in the center of the 6.5 acre site and thus minimizes impacts on the surrounding areas. 17. The applicant will be installing street frontage improvements per Public Works Department standards pursuant to FWCC section 22-1473. 18. The applicant will be installing a stormwater infiltration system and bio-swale for the runoff generated from the parking area. An engineered design must be approved by the Public Works Department in.conjunction with the building permit. 19. This land use application is_being review under the Federal Way zoning code in place on April 4, 1996. 20. The proposal embodies design principles that will be consistent with the surrounding residential area, as the building is a natural finish cedar timbers, with earthtone brown roofing. Conclusions: The proposed site plan and application have been reviewed for compliance with the Federal Way Comprehensive Plan, Findings and Conclusions for Process I Review UPR96-0009 June 5, 1997 Page 4 pertinent zoning regulations and other applicable City regulations. The site plan meets the intent of the comprehensive plan and zoning code. Additionally, the proposal will not be injurious to the public health, safety or welfare, as the building does not conflict with the semi -rural character of the area, and the public has been notified twice of the pending application and no written comments were received. Based on the findings and conclusions of this review, approval of the Process I review is recommended. This decision shall not waive compliance with future City of Federal Way codes, policies and standards relating to this decision. The existing school has an enrollment of approximately 60 students. Pursuant to FWCC section 22-639 a minimum setback of 50 feet from all property lines is required for schools with more than 50 students. The building as proposed meets the minimum setbacks of FWCC section 22-639. The existing buildings also meet the 50 foot setbacks. The new building is proposed with a fifty foot setback from the north and east property lines. The proposed building will be approximately 350 feet from the west property line and 500 feet from the south property line. 2. The site is within and adjacent to a low density zone, therefore, note 8 of FWCC section 22-639 relating to building height applies to this application. The proposed building meets the maximum building height of 15 foot above average building elevation as shown on elevation drawings sheets 3 and 4 by Lindal Cedar Homes. The height complies as follows: the lowest existing grade at the building is 133.24 feet and the highest existing grade is 136.23 at the southeast corner. To determine the height, the reference point is 2.99 feet above the lowest point, or 136.23 feet. Measuring up to the average height of the highest gable from the reference point of 136.23, the average building elevation is just under 15 feet. Approximately 5.5 feet of the peaked roof exceeds the 15 foot average building elevation as allowed by FWCC height definition. 3. A maximum of 75 percent lot coverage is allowed by FWCC section 22-639. Approximately 9 percent or 26,000 square feet of the 283,140 square foot (6.5 acre) lot will be covered with impervious areas, per figures derived from the John Oye P.E. drainage report page 5. The lot coverage does not exceed the FWCC maximum of 75 percent. 4. FWCC section 22-639 requires parking stall count to be determined on a case by case basis for a school use. Pursuant to FWCC section 22-334, the floor area is increasing on the site so parking must comply with applicable standards. Eight paved parking stalls are currently located on the site. An additional 17 new parking spaces are proposed for a total of 25 on -site parking stalls. The applicant provided a parking analysis dated October 4, 1994 that summarizes the daily school activity generates the demand for seven parking stalls. Five full time faculty members are employed at the site. The applicant indicates the proposed multi -purpose building will be used by the current school and the addition of the multi -purpose building will not generate additional students. The applicant states the multi -purpose building will be used primarily for existing school functions. However, the building will be used up to five times a year for school related performances, which will create additional parking demand. The site is in a semi -rural setting, and street parking is available for infrequent school functions. The site frontage of approximately 625 feet can accommodate parking for approximately 30 vehicles. The applicant is widening the road section adjacent to the site. The combined 25 on -site stalls and available street parking should be adequate for accommodating the school related activities. The on site parking area has a loading/unloading zone for student pick-up/drop-off. Busses are not used to transport students. The parking stalls and drive aisles meet the dimensional requirements of the FWCC. Both access points onto 8th Avenue must be marked with appropriate signage denoting one way access. 6. Pursuant to FWCC section 22-1566(b) and FWCC section 22-336, ten feet of type III landscaping is required around the site perimeter, as the site is a non-residential use in a residential zone. A landscape plan developed by Lynn Horn, Landscape Architect has been developed and meets the ten foot of Type III landscaping along the east and north property lines adjacent to the proposed multi -purpose building. The remainder of the 6.5 acre site will not be impacted by this development. The proposed internal parking lot landscaping meets the required 20 square feet of landscaping for each parking space. All landscaping must be installed prior to final building inspection. 7. An existing, fenced play area of approximately 16,000 square feet exists on the site, and will not be modified with this proposal. This modification requests to replace the required ten -foot wide Type III landscape strip along the north property line with two separate 25 by 35 foot landscape clusters. Your landscape modification request also includes a June 21, 2000, signed statement from the abutting property owner to the north, generally not objecting to the requested landscape modification. As permitted in Federal Way City Code (FWCC) Section 22-1570, the requested modification is granted conditional approval based on FWCC Sections 22-1570 (b)(1) and (2) and 22-1570(d). Specifically, the unforeseen property line encroachment along the northerly property line represents a unique feature on the property. Two landscape areas of 25 feet wide by 35 feet long are proposed centrally between the building and property line, in lieu of a 140 foot long by ten -foot wide perimeter buffer. In order to comply with the landscape modification intent of providing a superior landscape result, the following condition applies to this approval: 1. In order to comply with the intent of FWCC Section 22-1566(b), the shrub and groundcover layers as proposed must be modified to closer resemble the required ten foot wide perimeter buffer standard. Specifically, the shrub and groundcover layer must be planted in a continuous ten foot wide strip for a length of at least 140 feet, and be located between the building and bio-swale. In accordance with the DRC Administrative Guidelines the following are responses to Section 8: Modification Requests. 1. Any change in land use. No. 2. Increase in density, square footage, number of units, or lots. No. 3. Changes in the location or number of access points (outside of driveways for residential purposes). No. 4. Reduction in the amount of landscaping, or buffering, open space, or public areas. Yes, we are proposing to reduce the landscaping area to install (5) additional parking stalls. The proposed landscaping is still adequately sized to meet the City's parking lot and perimeter landscaping requirements and we are proposing to plant more shrubs than were originally included in the approved project. 5. Change in the amount of parking. Yes. We are proposing to add (5) additional parking stalls to the facility. 6. Increase in the total square footage of structures to be constructed. Yes, we are proposing to add a sprinkler riser room to the building. This is a requirement from the fire marshall's office. The additional building area is only 24 s.f. and does not encroach on the setbacks. 7. Increase in the height of structures. No. 8. Change to the size or location of utilities, easements, or pedestrian connections. No. 9. Substantial changes to the approved architectural design. No. 10. Additional impacts to sensitive areas, significant trees, or the environment. No. Attached is a site plan identifying the interior parking lot landscaping areas illustrating how we meet the 20 s.f. of landscaping required per parking stall. The facility has 31 parking stalls @ 20 s.£ each requires 620 s.E of internal landscaping. Based on the attached site plan we are proposing to install 702 s.f. of interior landscaping without counting the large seeded area in the middle of the parking area. The original approval was granted on June 5, 1997. A copy of the approval letter is attached. At the time of approval, we proceeded to complete the construction drawings and submitted the drawings for permit. As a part of the review the water purveyor, Lakehaven Utility District, reviewed the water requirements for the building and claimed that the letter of water availability provided by them for the Process One submittal had expired and that the available water to the site never had the kind of pressure shown in their original letter. At that point Lakehaven required the owner to improve the mainline around the entire site. Through a series of negotiations with Lakehaven and the Fire Marshall it was determined that a fire sprinkler system would suffice. A sprinkler design company was brought in and though another series of negotiations the sprinkler design has been approved by 'loth the water purveyor and the Fire Marshall. Unfortunately, our building permit application and Process One application have now expired. We recognize that we will need to resubmit the building permit application as this`review was never completed, but we are asking for an extention to the previously approved Process One application. The building floor plans, elevations and site plan will be identical to those submitted for the building permit. The fire flow test that was used for the availability certificate, issued in March, 1996 (and now expired), was old ( 02/16/84 ) and it seemed reasonable to verify that flow was still available at that level (2,787 gallons per minute at 20 pounds per square inch). The hydraulic model disclosed that such a high flow would cause serious water system problems, creating flow velocity more than double our current design criteria. The increased flow velocity and high pressure in the upstream piping could create significant "water hammer" (where the system is shut down too quickly) within the system and potentially damage the distribution system. This poses a serious safety concern, especially with children involved, that water mains could break under such a demand and flow would not then be available to fight a fire in the structure. The model indicated that no more than 700 gallons per minute should be allowed to flow through this hydrant. It is our recommendation that the water main serving this hydrant be replaced with ductile iron pipe of appropriate size from South 373rd Street to the most southerly property boundary. Given the location of this property, near the edge of the District's water service area, it may be appropriate to install twelve -inch diameter pipe to allow placement of more than one hydrant on this length of unsupported water main (no additional feeds/loopinybMO Ii�Y�E RECEIVED BY AEPARTA Dale A. BACKGROUND: The proposed action is to construct a 4,040 sf. gym/multi-purpose building, 18 parking stalls and related drainage and landscaping to augment existing private school. SEPA review is required because the proposal includes more than 20 cumulative parking stalls, and the construction of a 4,040 square foot building. Analysis of the proposal is based on the submitted checklist dated June 13, 1996, Level One Surface Water Technical Information Report dated March 29, 1996 (revised on January 22, 1997) and site plan drawings by James Guerrero Architects dated revised April 3, 1997. 1 B. ENVIRONMENTAL ELEMENTS: Earth: The lot is presently developed with an approximately 4,050 sf. building, seven parking stalls and landscaping. The 1973 USDA Soil Conservation Service's (SCS) Soil Surve for the King Counly Area classifies the soils as Everett gravelly, sandy. Runoff potential is slow to moderate. Erosion hazard is slight to moderate. The lot is not in a problem area relative to erosion and steep slope hazard areas as identified by the King County and City of Federal Way Sensitive Areas maps. the steepest slope on the lot is approximately eight percent grade. No soil is proposed to be imported or exported for construction. A temporary erosion/sedimentation control plan shall be provided with the building permit application related to this proposal. Maximum lot coverage (impervious surface ratio) is limited to 75 percent for the lot. Less than this amount is proposed. No further mitigation is necessary. 2. Air: Short term impacts to air quality will occur during construction and paving operations. Longer term impacts due to vehicle emissions will vary in level according to the amount of traffic generated in the future by the proposal. Construction activity, especially site preparation work, will contribute to a short term increase in local suspended particulate levels. Construction activity also contributes to carbon monoxide levels through the operation of construction machinery, the use of trucks to deliver equipment and materials, and worker access to the lot by automobile. These activities also involve emissions of hydrocarbons and oxides of nitrogen, potentially elevating the level of photochemical oxidants, such as ozone, in the ambient air. Longer term air quality impacts due to vehicle emissions will vary in level according to the amount of traffic generated by use of the lot. Compliance with local, state and federal air quality standards will provide sufficient mitigation of the potential onsite impacts of construction activities. In addition, required landscape buffers will provide filtering of suspended particulates. Additionally, the continued application of effective maintenance and operation procedures, and periodic watering of the lot may be employed to keep the generation of dust within acceptable limits during excavation and construction phases, as required by the city. No further mitigation is necessary. 3. Water: Surface Water: As with all paved areas, the parking lot will contribute some pollutants to ground and surface waters as these will be washed off by storm drainage 2 across the lot. Pollutants which accumulate on paved surfaces may include heavy metals, petrochemicals and other substances. The existing drainage system will be enhanced to include water quality treatment (biofiltration swale) as required by Federal Way City Code (FWCC) 22-330. Johan Oye P.E. prepared a Level One Surface Water Technical Information Report dated March 29, 1996 (and revised on January 22, 1997) for the proposal. This analysis was examined to determine if drainage improvements are necessary with the related Process I application. Storm drainage facilities will be enhanced in accordance with all applicable Core and Special Requirements outlined in the King County Surface Water Design Manual. The project proposes to treat the stormwater from the parking lot through biofiltration and infiltration. Infiltration is the recommended method for handling stormwater as stated in the Executive Proposed Basin Plan - Hylebos Creek and Lower Puget Sound document. The proposal is not in a 100 year floodplain, as identified by Federal Emergency Management Administration map data. No further mitigation is necessary. 4. Plants: No significant trees, as defined by FWCC, are within the proposed construction area. Proposed lot landscaping will comply with requirements of FWCC Article XVII Landscaping. No further mitigation is necessary. 5. Animals: Concur with checklist. 6. Energy and Natural Resources: Energy provisions for the proposal will conform to applicable local, state and federal regulations as part of the site plan review application. No further mitigation is necessary. 7. Environmental Health: Noise levels will increase on a short term basis during construction activity. These will be controlled by conformance with local noise ordinances that regulate hours of construction. An increase in noise levels due to traffic generated by the proposal is expected on a long term basis. Required landscaping along north and east lot perimeters will also buffer these noise levels. No further mitigation is necessary. 8. Land and Shoreline Use: The site is zoned RS 35.0. The Comprehensive Plan designation is Low Density Single Family. The proposal will be compatible with adopted city regulations through review of the Process I application. No shorelines abut the proposal. No further mitigation is necessary. 9. Housing: Concur with checklist. 3 10. Aesthetics: The setbacks and height of the building comply with FWCC section 22- 639. No aesthetic impacts are created by the proposal. Landscaping will conform with the standards in Article XVII of the FWCC. No further mitigation is necessary. 11. Light and Glare: All exterior illumination shall be designed or shielded to eliminate offsite glare as required by FWCC Section 22-954. This requirement will be verified with the building permit application. 12. Recreation: Concur with checklist. 13. Historic and Cultural Presentation: Concur with checklist. 14. Transportation: The lot fronts on 8th Avenue South. Two paved driveways currently provide access to the subject lot. Both driveways will have minor reconfigurations with the related building permit to match applicable design requirements. Right-of-way improvements are required with this proposal because value of the proposed structural improvements exceed 25 percent value of existing structural improvements, pursuant to FWCC section 22-1473. For reference, existing 1996 King County assessed value of all structural improvements is $105,300. Proposed structural value as determined by the city is $202,000 (which calculates to a new improvement value of 191 percent over the existing building valuation). Right-of-way improvements will be designed by the applicant's engineer and be required in conjunction with Process I approval and the building permit by the Federal Way Public Works Department. No additional mitigation is necessary. 15. Public Services: No increase in public services is necessary for the proposal provided all applicable City and affected agency design requirements, including King County Fire District #39, are met. The proposal will comply with relevant fire protection and emergency vehicle access requirements if constructed as conditioned by the site plan approval. No further mitigation is necessary. 16. Utilities: Domestic water is provided to the existing building. Domestic water connection to the proposed building must comply with Lakehaven Utility District requirements. Sanitary sewer service is not provided to the site. Septic system design must be submitted to and approved by the King County Health Department. C. CONCLUSION: The proposal can be found to not have a probable significant adverse impact on the 4 environment pursuant to a Determination of Nonsignificance (DNS). This DNS is based upon the environmental checklist, attachments, and the above "Final Staff Evaluation for Environmental Checklist Application #SEP96-0016", and is supported by plans, policies and regulations formally adopted by Federal Way for exercise of substantive authority under SEPA to approve, condition, or deny proposed actions. As you are aware, prior to issuance of a building permit the State Environmental Policy Act (SEPA) review and Process I decision and appeal periods must be completed. The SEPA decision includes a 15 day comment and 14 day appeal period. The Process I decision requires a seven day reconsideration and 14 day appeal period. This letter is a follow up to our February 12, 1997, discussion regarding the project status. As I informed you on the phone, the building as proposed exceeds the height limit by one foot. The maximum structure height for the school use is identified in Federal Way City Code (FWCC) section 22-639 (note 8) as follows: If any portion of a structure on the subject property is within 100 feet of a low density use, then either: a. The height of that structure shall not exceed 15 feet above average building elevation; or b. The facade of that portion of the structure parallel to the low density use shall not exceed 50 feet in length. As proposed, the average building elevation is 16 feet as measured on the enclosed elevation drawing. The north facade of the building is 90 feet in length and the proposed building setback from the north property line is 50 feet. The building height must be reduced by one foot, or the building must be relocated so that any portion of the building located within 100 feet from a low density zone is less than 15 feet in height. We will move forward with the SEPA decision when you inform us of how the height standard will be met. Please provide information on how you propose to meet the height standard. FIRE APPARATUS ACCESS ROAD Fire apparatus access roads shall be provided when any portion of the facility or any portion of an exterior wall of the first story of the building is located more than 150 feet from fire apparatus access as measured by an approved route around the exterior of the building or facility. EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. Plans for fire apparatus access roads shall be submitted to the fire department for review and approval prior to construction. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 25 ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 32 foot inside turning radius and not less than a 40 foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 12 percent. [K.C.F.D. #39 Administrative Policy Guideline No. 10061 Designated fire lanes may be required for emergency access. This may be done during the plans check or after the facility is in operation. When required, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction by parking and other obstructions. Fire apparatus access road gates shall comply with K.C.F.D. #39 Administrative Policy Guideline No. 1003 (copy attached). Fire apparatus access roads shall be installed and made serviceable PRIOR to and during the time of construction. FIRE -EXTINGUISHING SYSTEMS Four (4) sets of plans and specifications for automatic fire -extinguishing systems, standpipes and their appurtenances shall be submitted to the fire department for review and approval prior to installation. Plans shall be drawn to an indicated scale, on sheets of uniform size, with a plan of each floor, and shall show those items listed in Chapter 6 of 1994 Uniform Building Code Volume 3 (UBC Standard 9-1) that pertain to the design of the system. Sprinkler plans shall bear a Washington State Certificate of Competency stamp. An automatic fire sprinkler system shall be installed in all occupancies requiring 2,000 gpm or more fire flow or where the total floor area included within the surrounding exterior walls on all floor levels, including basements, exceeds 10,000 square feet. Area separation walls shall not be considered to separate a building to enable deletion of the required automatic fire -extinguishing system. [Federal Way City Code Chapter 8, Article II, Division 41 The automatic fire -suppression system shall be connected to the fire alarm system (last zone) in all buildings having an automatic fire detection system. The total pressure (to the source) required in a hydraulically designed automatic fire sprinkler system shall be at least 10 per cent less than the stated static P.S.I. from the appropriate water flow test. Fire department connections shall comply with K.C.F.D. 39 Administrative Policy Guideline No. 1002 (copy attached). Plans and specifications for fire alarm systems shall be submitted to the fire department for review and approval prior to system installation. Plans and specifications shall include, but not be limited to, a floor plan; location of all alarm - initiating and alarm -signaling devices; alarm control and trouble -signaling equipment; annunciation; power connection; battery calculations; conductor type and sizes; voltage drop calculations; and manufacturer, model numbers and listing information for all equipment, devices and materials. Fire alarm systems, automatic fire detectors, emergency voice alarm communication systems and notification devices shall be designed, installed and maintained in accordance with U.F.C. Standards 10-2 and 10-3 and other nationally recognized standards. Systems and components shall be listed and approved for the purpose for which they are installed. An automatic fire detection system shall be installed in all buildings exceeding 3,000 square feet gross floor area. This fire detection system shall be monitored by a central and/or remote station conforming to the current requirements of the National Fire Protection Association standards and/or the fire chief or designee. [Federal Way City Code Chapter 8, Article II, Division 41 Group E, Division 1 Occupancies and Group E, Division 3 Occupancies having an occupant load of 50 or more shall be provided with an approved manual fire alarm system. An added benefit to this building will be to provide a large open room on this campus which can serve as both a large gathering room and performance area. The existing site is approximately 6.5 acres. The existing school has approximately 4,050 square feet and was remodeled in 1984. The proposal is designed for a new detached building of 3,990 square feet. Off -site improvements to 8th Ave. are included. An additional 18 parking stalls are being added to the site along with the 7 existing stalls for a total of 25. The building is proposed as a Justus Cedar Home Construction.
