The existing monument sign on the site meets the required setback. However, it must be relocated due to right-of-way acquisition along the east side of Pacific Highway South. The proposal is to move the sign so that the setback is 0.83 feet from the west property line. Federal Way City Code (FWCC) Section 22-335(1)(2) permits the City to allow a sign to be placed within the setback in the case of government acquisition of property for right-of- way, provided that the requirements of FWCC Section 22-335(i)(3) are met. The City has determined that those requirements have been met, as discussed below. Enforcement 14'the three-foot sign setback requirement would result in a substantial hardship for the business owners, as it would impact the available parking and the traffic circulation on the site. As the new road improvernents extend to the existing building, meeting the three-foot setback would also reduce the visibility of the sign. This hardship was created solely by City acquisition of property for the Pacific Highway South right-of-way. Zoning for the subject site is Community Business (BC). This site is considered medium profile for purposes of sign permit review, per FWCC Section 22-160 1 (a)(2). The existing sign that is to be relocated is a twelve -foot tall monument sign. The sign area is 128 square feet. As approved under sign permit 01- 103211-00-SG, it complies with all requirements of FWCC'Sections 22-1596 through 22-1629. It is not prohibited under FWCC Section 22-1600. Public Works staff has determined that, as proposed, the sign will not hinder the site distance for drivers or pedestrians utilizing or crossing the adjacent driveway. Locating the sign within the required setback is consistent with the public health, safety, and welfare. The Process I application is hereby approved. Please be advised that approval of a sign permit revision is also required from the City of Federal Way before undertaking any construction -related activities. This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this site. The effective date of this decision is July 26, 2004. Pursuant to FWCC Section 22- 356, any person who received notice of the administrative decision may appeal this decision to the Mr. Emter July 23, 2004 Page 2 Federal Way Hearing Examiner by August 9, 2004. Please be aware that no work on the proposal can commence until the end of the appeal period. However, in that you are the only party of record, you may waive your right to appeal this decision. The City must receive this waiver in writing. Waiver of the right to appeal does not affect the effective date of this decision. Therefore, if you choose to waive your right to appeal, you could begin work on the proposal on July 26, 2004, provided you have obtained the necessary sign permit.
