Dear Ms. Manns:
The City has completed administrative review of the Java Store Espresso Stand, which the
applicant has proposed to locate at the Value Village site, 32945 Pacific Highway South. The
proposal is to construct a 96 square foot drive-thru espresso stand with two new parking stalls and
associated landscaping at the corner of Pacific Highway South and South 3301h Street. The
Process I application is hereby approved based on the enclosed Findings and Conclusions far
File No. 03-103971-00-UP.
Please note that due to Public Works street improvements along Pacific Highway South
scheduled for implementation in the summer of 2004, in place of installation of required
landscaping the applicant may submit a landscape bond or comparable financial guarantee prior
to certificate of occupancy being granted. Upon completion of the street improvements, the
applicant will install the required perimeter landscaping according to the approved landscape plan
and contact the City for a final landscape inspection. This landscape modification is issued
pursuant to FWCC Section 22-1570(d).
The effective date of the decision is October 30, 2003. Pursuant to Federal Way City Code
(FWCC) Section 22-355, this decision may be appealed in the form of a letter delivered to the
Department of Community Development Services (33530 First Way South, PO. Box 9718,
Federal Way, WA 98063-9718) by November 13, 2003, by any person who submitted
comments or receives a copy of this decision. An appeal letter must contain a clear reference to
the matter being appealed and a statement of the factual findings and conclusions of the Director
of Community Development Services disputed by the person filing the appeal, and must include
the appeal fee of $144.00. The Federal Way Hearing Examiner will hear any appeal of this
Process I decision.
Please be advised that since you are the only party of record for this application, you may waive
your right to appeal. The City must receive this waiver in writing. Waiver of the right to appeal
does not effect the issuance date. Therefore, if you choose to waive your right to appeal, you
could begin work on the proposal on October 30, 2003, provided you have obtained the necessary
building permit (03-103986-CO).

This decision does not constitute building permit approval and does not waive compliance with
future City of Federal Way codes, policies, and standards relating to this development. A building
permit, sign permit, and electrical permit are required for this project. Final site inspection is
required prior to occupancy. Upon completion of the Public Works street improvements along
Pacific Highway South, in approximately the summer of 2004, the applicant shall install the
required perimeter landscaping and contact City staff for a landscape inspection. Upon successful
completion of the required landscaping, the landscaping bond or comparable financial guarantee
will be refunded.

FINDINGS AND CONCLUSIONS

The Java Store Drive-Thru Espresso Stand
32945 Pacific Highway South, Federal Way
1. The applicant has proposed to construct a 96 square -foot drive-thru espresso stand at the
corner of Pacific Highway South and South 330"' Street.
2- Zoning for the subject site is Community Business (BC). Pursuant to Federal Way City
Code (FWCC) Section 22-753, fast food restaurants are permitted in this zone. The proposal
is subject to Process I, Director's Approval, as it does not meet the land use process
exemptions under FWCC Section 22-32, and it does not exceed the Process I thresholds
established in FWCC Section 22-32.2.
The proposed espresso stand is exempt from SEPA review pursuant to Washington
Administrative Code (WAC) 197-11-800, "Categorical Exemptions."
4. The proposal has been reviewed for consistency with all applicable zoning regulations
including FWCC Section 22-753, "Neighborhood Business, Fast Food Restaurant"; FWCC
Chapter 22, Article IV.B, "Director's Approval"; FWCC Chapter 22, Article IV,
"Nonconformance"; FWCC Chapter 22, Article XVII, "Landscaping"; and FWCC Chapter
22, Article XIX, "Community Design Guidelines."
5. Nonconformance: Pursuant to FWCC Section 22-334(3)(b), "Increase in Gross Floor Area,"
if a new and separate structure is constructed on an already developed site, the applicant
shall comply with all development regulations applicable to the geographic portion of the
site in which the new building is proposed. In the case of the espresso stand, the applicant
proposes installing a five-foot wide perimeter landscape strip comprised of Type III
landscaping along the corner of Pacific Highway South and South 330t' Street in the area of
the development, pursuant to FWCC Section 22-1566(fl(1).
6. Parking: Pursuant to the development regulations of FWCC Section 22-722, one parking
stall is required for each 300 square feet of gross floor area. The 96 square -foot espresso
stand requires a total of one parking stall, plus one accessible parking stall, as required by
the Uniform Building Code. The accessible stall in the proposed location to the west of the
espresso stand meets the minimum standards for accessibility.
7. Parking Reconfiguration: The applicant proposes to eliminate 11 existing parking stalls, in
order to create safe drive aisle widths to accommodate the espresso stand. The City -initiated
right-of-way improvements along Pacific Highway South will eliminate an additional eight
stalls. The parking requirement for Value Village is 63 stalls.' After the proposed
development and City -initiated right-of-way acquisition, the site will have a total parking
requirement of 65 stalls, with a total available parking count of 75 stalls.
1 Pursuant to FWCC Section 22-751, the parking requirement for a retail use in the BC zone is one parking stall per 300
square feet of gross floor area. According to King County Assessor's datum, the Value Village building is
approximately 18,870. Thus the parking requirement for the existing development is 63 stalls.
8. Garbage Enclosures and Restroom Facilities: The applicant has indicated that the espresso
stand will be utilizing the garbage facility for Value Village; restroom facilities are available
at Value Village and are less than 150 feet from the espresso stand.
9. Landscaping: The applicant has requested a modification from the landscape requirements
of FWCC Section 22-1569, in that the City of Federal Way Public Works requirement will
be constructing right-of-way improvements in the area of the required landscaping in the
summer of 2004. Installing the required perimeter landscaping prior to this construction
would result in destruction of the planting, in that the City has a construction easement to
use this portion of the Value Village property during right-of-way construction. The
applicant has submitted an October 2, 2003, landscape estimate for the required landscaping
from Olympic Landscape and Irrigation in the amount of $1,360.00. Pursuant to the
modification options identified in FWCC Section 22-1570(d), the applicant shall submit a
cash bond to the City, or comparable assignment of funds in lieu of completing the required
landscaping, prior to certificate of occupancy being granted. At such time as the Public
Works Department completes the proposed right-of-way improvements in the area of the
required landscaping, the applicant shall install said landscaping according to the approved
plans, and contact City staff for a final inspection of said landscaping. Upon successful
completion of the required landscaping, the landscaping bond or comparable financial
guarantee will be refunded.
10. Design Guidelines: Pursuant to FWCC Section 22-1634(g), the stacking lanes for drive -
through facilities shall be visually screened from right-of-ways by Type III landscaping. The
submitted landscape plan meets this requirement.
11. Pursuant to FWCC Section 22-352, and the forgoing findings, the proposal is found to be
consistent with the Federal Way Comprehensive Plan; all applicable provisions of the
FWCC; and with the public health, safety, and welfare.
Final construction drawings will be reviewed for compliance with specific regulations, conditions
of approval, and other applicable City requirements. These findings shall not waive compliance
with future City of Federal Way codes, policies, and standards relating to this development.

Sewer:
Any modification of the existing side sewer or new side sewer connection will require a side sewer permit. Owner/
Tenant will be required to complete a Sewer Use Survey (SUS); with pretreatment requirements, if any, to be
determined upon review of said SUS.
General:
The District's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units (ERU).
Residential equivalency will be estimated based on anticipated water use (255 gallons per day = 1 ERU). A
minimum of one (1) full ERU will be assessed. Owner will be required to provide water consumption information
from a similar facility. Actual water consumption will be monitored and additional charges may be assessed
within five years of original connection. The District's current Capital Facilities Charges are $3,205/ERU for water
and $2,721/ERU for sewer. These charges will be collected only if the structure is separately metered.
