underground power,and necessary appurtenances consistent with good street construction
("Improvements"), so as to benefit the Property, through the formation of a Local
Improvement District.
NOW, THEREFORE, the Property Owner agrees as follows:
1. Permit. The Property Owner may obtain a building permit for 2220 S 284th Street
without the installation of the Improvements so long as all other conditions of the
permit, if any, are complied with to the City's satisfaction.
2. No Protest. Pursuant to RCW 35.43.182 and in consideration of the City
approving said permit,the Property Owner agrees to participate in and not protest
the formation of a Local Improvement District pursuant to RCW 35.43.180.
3. Term. This Covenant shall be for a term often(10)years commencing on the date
of execution hereof and terminating ten(10) years thereafter.
4. Improvements. Nothing in this Covenant shall in any way absolve the Property
Owner of any underlying obligation to make any public improvements as a
condition of permit approval under any application other than Permit No. 03-
101476-00-SF prior to the expiration date of this Covenant or upon eighty(80)
days written notice from the City if such public improvements are required
pursuant to the Federal Way City Code, any other permit application, or other
applicable laws, rules, or regulations, as now existing or hereafter adopted or
amended. The Improvements may be necessary to mitigate the effects of the
development of the Property. This Covenant shall be construed only as providing
an alternative means for payment for necessary public improvements through the
formation of a Local Improvement District.
5. Binding Effect. This Covenant shall be construed to touch and concern the land,
shall run with the land and bind the Property Owner, it's successors in interest,
heirs and assigns.
6. Filin . This Covenant shall be recorded by the Property Owner with the King
County Office of Records and the Property Owner shall pay all recording fees.

Dear Mr.Hancock:
The Public Works Department has received your request to waive the required Right-of-Way Improvements
along S 284th Street. Staff has evaluated the existing conditions along S 284th Street, Federal Way City Code
(FWCC) Sections 22-1496, 22-1477, and considered past direction provided by the City Council. The Public
Works Director is allowed to modify, defer, or waive required street improvements only after consideration of
four specific reasons under FWCC Section 22-1477 "Modification of Improvements Along Property Frontage".
The reason most applicable to your request is FWCC 22-1477(1) which states: "Improvements as required
would not be harmonious with existing street improvements, would not function properly or safely or would not
be advantageous to the neighborhood or city as a whole."
The development proposal is a single-family home with 39 feet of frontage on the bulb of the cul-de-sac on S
284th Street. Existing frontage improvements from the centerline consist of a cul-de-sac bulb approximately 80
feet in diameter all within a 100-foot diameter Right-of-Way. A planned roadway section for the S 284th Street
cul-de-sac is a Type Z street consisting of a 90-foot-diameter of pavement, with an optional center island of a
26-foot diameter, a 5-foot wide sidewalk, and a 3-foot utility strip all within a 106-foot in diameter
Right-of-Way. Curb and gutter, with no sidewalk abut this property. Streetlights are provided on overhead
power poles located along the Right-of-Way.
The required improvements would not be harmonious with existing street improvements and topographic or
physical conditions preclude construction of the required street improvements. Therefore the request for waiver
of frontage improvements is granted. The developer will be required to sign a Local Improvement District
Waiver of Protest Covenant. Please fill out the enclosed form and return to Kim Scattarella at the post office
box address listed above.

We are writing to you in regards to Permit#03-101476-000-00-SF. We are requesting a Right-of-Way
Code Variance to waive the requirements of FWCC Chapter 22,Article XVI for the following reasons:
1)The improvements as required would not be harmonious with the existing street improvements,would
not function properly or safely and would not be advantageous to the neighborhood as a whole.
2)Unusual topographic or physical conditions preclude the construction of improvements as required.
We are adding a second story addition to our home. We are not doing any excavating of land or making
any changes to the existing groundwork around our home. There are currently no sidewalks in our cul-de-
sac or our part of the neighborhood, nor would there be room for them in front of our home. We have
enclosed pictures of our existing property for your reference.
We have enclosed our check for$71.50 to apply for this waiver. We would appreciate your attention to
this matter. We could like to get our home remodel started soon in order to take advantage of the summer
months and would appreciate you expediting this waiver.

Dear Mr. & Mrs. Hancock:
The Public Works Department is unable to complete the plan review of the above-referenced
project until additional information regarding, but not limited to, the following items are
received:
1. S 284`h Street along the property frontage does not meet current City street standards. In
accordance with Federal Way City Code (FWCC) Article XVI Improvements, Section
22-1473 and 22-1474, street improvements must be installed as a condition of this
building permit, as the assessed valuation of your improvements exceeds 25 percent of
the existing property value. Required improvements for this lot would include curb and
gutter, a six-foot wide planter strip with street trees and eight-foot wide sidewalk.
FWCC Section 22-1477 allows the Public Works to modify, defer, or waive the
requirements of this article only after consideration of a written request from the owner
for the reasons stated in the enclosed handout Right of Way (ROi9 Improvement
Modification Request.
2. Per FWCC Section 16-48, Undergrounding of the service connection(s) shall be
required. These are facilities extending from a distribution system and terminating on
private property to serve a customer or subscriber. Service connections shall be
underground, unless the distribution system serving the customer or subscriber is aerial,
and the building, structure or facility to be served is new construction or an addition,
alteration, or repair thereto is under$20,000 in value.
3. Provide the following additional in formation on your plot plan:
• Indicate all on-site locations of roof drains from the downspout to the existing or
proposed on-site drainage system and other utility lines (water, sewer, gas, electric,
phone) on your property. See Appendix C, 1998 King County Surface Water
Design Manual for proposed on-site drainage system design guidelines.

finished(solid line) elevation contours. Also indicate the finished floor elevation.
• Delineate the clearing limits and show the location of silt fence on the plot plan.

• Show the location of the edge of pavement on S 284th Street.
• Indicate the construction entrance (driveway entrance). An alternative is a rocked
entrance with minimum dimensions of 10 feet wide by 25 feet long times one-foot
depth of quarry spalls onto the subject property.
