Dear Mr. McInnis:
This letter responds to your request dated December 7, 2004 to waive required street improvements along 61h Avenue S
associated with your proposed development. After evaluating the existing conditions along 6`k Avenue S, review of Federal
Way City Code (FWCC) provisions (Sections 22-1496, 22-477), and the direction provided by the City Council, the Public
Works Department hereby modifies the requirements for street improvements applicable to your permit application, as
discussed below.
FWCC Section 22-1477 Modification of Improvements Along Property Frontage: This code section allows the Public Works
Director to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific
reasons. The reason most applicable here is contained in FWCC 22-1477 (1) "Improvements as required would not be
harmonious with existing street improvements."
6`h Avenue S is classified as a collector street corresponding to Federal Way roadway section "R". This roadway section
requires a 40-foot wide paved street with vertical curbs, four -foot planter strip, six-foot sidewalk, three-foot utility strip, street
lighting, and street trees all within a 66-foot right of way.
Application of all the required street improvements would result in an improved roadway section that is not harmonious with
existing street improvements, which consist of'a 40-foot paved road, curb, gutter, five-foot sidewalk, and three-foot utility strip
within a 60-foot right of way.
As a result, the required street improvements will be modified to include only a streetlight and street trees to be placed behind
the sidewalk. The applicant must dedicate a three-foot wide strip along the property frontage for right-of-way and execute a
No Protest Local Improvement District (LID) Covenant in the event that a future lid is formed to make street improvements.
To aid staff in preparing these documents, please complete and return the enclosed worksheet.
The conditions of this right of way modification will be applicable for one year from the date of this letter. If a building permit
is not issued within the one-year time limit, the right of way modification will be void, and a new request for modification must
be submitted.

Request for Right -of -Way Modification
Dear Isaac;
We are writing to request a Right -of -Way Modification for the improvements required on
6th Avenue adjacent to the Dunham Medical Project in West Campus of Federal Way.
The modification is to 6th Avenue. We request that the frontage improvement
requirements placed on the Windermere building adjacent to our site also apply to our
site. As we understand, Windermere was not required to improve the frontage along 6th
Avenue, as the Right -of -Way there is built out. We would request the same consideration
for our 6th Avenue frontage.
We request consideration of thi modification request as soon as possible so that we can
plan for our site improvements and move ahead with our project. As requested, we have
attached the check for $72.50 for the review fee.
