The Process I MLU application is hereby approved pursuant to conclusions based on findings made by the department's Planning Division. FINDINGS OF FACT 1. The applicant proposes to install a World Trade Center (WTC) 9/11 memorial, which includes a steel beam from the WTC towers that fell on September 11, 2001. The steel will be displayed at a 55 degree angle facing New York City (NYC) and will be placed in the center of a pentagon -shaped viewing area with the interior walls of the viewing area displaying the names of the victims of the tragedy. The structure will be a hands-on memorial. There will also be a water feature and 1,500 square feet of landscaping and plants significant to the NYC area. 2. Site plan depicts a three -foot -tall block wall and six -foot -tall wall, which retains less than four feet of soil located within the 25-foot front yard setback. There will also be benches for viewing the memorial. The improvements located in the required front yard meet the required yard exceptions pursuant to FWRC 19.125..160. (5) Fences and railings not over six feet in height may be located in required yards. • (6) Rockeries and retaining walls may be located in required yards if: a) The rockery or retaining wall is not being used as a direct structural support for a major improvement; b) The rockery or retaining wall is reasonably necessary to provide support to a cut, fill, or slope; and c) The rockery or retaining wall also meets the requirements of FWRC 19.120.120 et seq. 3. The installation is located in an existing grass area in front of the fire station building. No required parking or landscaping will be reduced with this project. Mai, Biirdyshaw October 31, 2013 Page 2 CONCLUSIONS OF LAW 1. The proposed improvements are not exempt from Use Process review as they do not meet criteria set forth in FWRC 19.15.020, Exceptions. 2. Process I "Director's Decision" is the appropriate Master Land Use application as the improvements are to a development site, and they do not exceed thresholds set forth in FWRC 19.15.030(1). 3. The proposed improvements are exempt from State Environmental Policy Act review as the scope of work meets categorical exemption WAC 197-11-800(3) repair, remodeling, and maintenance activity. 4. The Federal Way Comprehensive Plan and zoning designation for the subject property is Office Park (OP). Pursuant to FWRC 19.225.040, the subject property's Fire Station (government facility use) is permitted in OP zoning districts. 5. The proposed improvements meet Process I purpose criteria set forth in FWRC 19.55.020 including compliance with applicable provisions of FWRC Title 19 `Zoning and Development' and health, safety, and welfare standards. 6. An electrical permit would be required for any site lighting, but this would be an over-the-counter or on-line permit. Please contact the Permit Center at 253-835-2607 or permitcenter@cityoffederalway.com for more information. 7. It appears that the placement of the memorial would be on top and/or conflict with the existing underground fire protection service connection and drainage pipes for the site. Exact location cannot be determined. There is a potential that damage to existing pipes and fire protection service equipment (check valve assembly vault, lid, etc.) may occur. Please take precaution to avoid any underground utility pipes/service connections equipment when digging and installing the memorial. APPEALS The effective date of this decision is November 3, 2013, or three days from the date of this letter. Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by November 18, 2013. Any appeal must be in the form of a letter delivered to the Department of Community and Economic Development with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This Process I approval does not constitute approval of an electrical permit. Retaining Wall: The retaining wall is a 6 foot tall concrete wall retaining less than 4 feet of soil. The builder may use the attached retaining wall schedule for the retaining wall. See attached wall calculations. 2. Steel Section: The 11 foot section of steel from the World Trade Center is 16" tall by about 12" wide and 1600 pounds. This section is likely a W16x100. The section is to be attached to a concrete pedestal with rebar embeds similar to a concrete tilt -up building. A concrete tilt up embed is designed to withstand earthquake loading for a 7- 1/2" thick concrete panel on end up to 16 feet tall. Having (2) embeds (one each side) will provide adequate attachment to the concrete pedestal. The reinforced slab over the 2 foot wide footing of the pedestal will provide adequate restraint for overturning.
