Dear Mr. Boe:
This letter responds to your December 27, 2017, request to clear underbrush at the above -referenced
property. Community Development Department staff met with you to discuss the process to receive
authorization to clear the underbrush of the above -referenced properties in order to deter criminal activity.
This letter, Administrative Decision No. 17-106099-AD, constitutes that authorization based on the
following:
Federal Way Revised Code (FWRC) 19.120.030(7) exempts clearing of underbrush from
permit and code requirements contained in FWRC 19.120.020 for, "Actions which must
be undertaken immediately, or within a time too short to allow for compliance with the
requirements of this article, to avoid an imminent threat to public health or safety; to
prevent an imminent danger to public or private property; or to prevent an imminent
threat of serious environmental degradation." Based on information known to City staff
and SKF&R staff, confirming incidents of public threats and misdemeanor activity by
trespassers encamped or hiding on the property, this criterion is met.
The department hereby conditionally approves limited clearing on the subject properties and exempts the
clearing and grading plan approval requirements of FWRC 19.120.020 for vegetation maintenance and
underbrush clearing on the subject properties.
Conditions of Approval
• This approval allows clearing brush and tree branches from approximately six inches above
ground to a height of approximately seven feet above ground. No coniferous trees more than
12 feet tall or 3-inch caliper deciduous trees (measured at 4.5 feet above ground level) may be
removed without an approved clearing and grading permit. This work may be conducted
with: hand tools and hand equipment; mini excavator or similar; and brush hog or similar.
• Ground disturbance, grading or land filling, access road construction, on -site vegetation
piling, and on -site burning are not allowed unless authorized through a separate development
permit.

The subject property has several wetlands and wetland buffers. No vegetation removal and no
mechanized equipment are allowed in wetlands and wetland buffers. If additional work or
vegetation removal is desired or necessary within the wetland or wetland buffer, you will need to
submit to the City a plan from your consulting wetland biologist identifying how to best address
these concerns, and this would be reviewed through a separate application.
This approval is revocable by the City at any time, and is valid for 120 days from the date of this letter. If
requested in writing by the property owners, the City may extend the duration of this approval.
This administrative decision shall not waive compliance with future City of Federal Way codes, policies,
and standards relating to this site. If you have any further questions or need additional information, please

Dear Mr. Davis,
South King Fire and Rescue would like authorization to clear underbrush on our property adjacent to Station 64 at 3700 S 320`h St. Parcel
numbers 551560005, 5515600010, 5515600015, 5515600020, 5515600025, 5515600026, 5515600030, 5515600035, 5515600037, 5515600090
and 5515600091. -
I spoke with Jim Harris at the permitting front counter on December 27`h about our concerns.
The mentioned property has been a continuing problem with homeless individuals on our property, leaving an unsanitary and dangerous
condition to the public and employees. It has been a constant battle to keep up with the garbage they leave behind. We are continuously
removing garbage and needles with no end in sight. We have also had illegal dumping of tires, construction debris, and other refuse over the
years. We have installed signage many times stating "No Trespassing" which get removed, tagged and vandalized. The City of Federal Way
Police have removed trespassers numerous times.
We believe this is a public safety issue and request approval to open up the property from 0-7 feet of underbrush and branches using a brush
hog excavator and hand tools. We will leave all trees larger than twelve feet or three inches caliper at 4.5 feet above ground. We will not
disturb wet land with power equipment.
