This letter updates and supersedes the City response on June 15, 2016 in regards to your
request to waive the required street improvements along S 32e Street, which abuts the above -
referenced property. After evaluating the existing conditions along the referenced street,
review of Federal Way City Code (FWCC) provisions (Section 22-1477, 22-1496), and direction
provided by the City Council, the Public Works Department hereby modifies the requirements
for the street improvements.
Code Section (FWCC) 22-1477; Modifications of Improvements Along Property Frontage allows
the Public Works Department to grant a request to modify, defer, or waive the required street
improvements only after consideration of four specific reasons. The reason most applicable
here is contained in FWCC Section 22-1477(1), "Improvements as required would not be
harmonious with existing street improvements."
S 328th Street is classified as a minor collector street, corresponding to Federal Way Roadway
Section "S". This roadway section requires a 36-foot paved roadway, a four -foot planter strip, a
five-foot sidewalk, and a three-foot utility strip, all within a 60-foot right-of-way. Application of
the required street improvements would result in an improved street section that is not
harmonious with existing street improvements, which consists of a 20-foot paved roadway
within a 60-foot right-of-way. ,
Therefore, the applicant is required to widen the existing road to a minimum of eighteen feet
from the centerline of the right-of-way by placing crushed surfacing base course (CSBC) outside
of the existing asphalt. 4:1 tapers must be provided for safe travel. The widening shall consist
of a minimum thickness of 0.50' of crushed surfacing base course (CSBC).

The conditions of this right-of-way modification will be applicable for a period of one year from
the date of this letter. If a building permit is not issued within the one-year time limit, this
waiver will be void and a new request for modification must be submitted.
The applicant must also execute a City of Federal Way Local Improvement District Waiver of
Protest Covenant ('No -Protest LID% in the event a future LID is formed to bring S 328th Street
up to required street improvement standards. The No -Protest LID will be sent under separate
cover and must be signed, notarized, and returned to the City prior to issuance of a building
permit.

Subject: Mironyuk Parcel Site Distance Verification
This letter addresses the available sight distance for the one new single family house on parcel
#6143600570. The site is located on the south side S 328th street. Figure 1 shows the vicinity
map and local street network. Figure 2 shows the driveway location.
The proposed site will have one new access driveway onto S 328th Street. Assessments of the
driveway were made to establish whether sufficient entering sight distance is available.
AASHTO Green Book standards require a minimum entering sight distance of 280 feet for the
25 mph posted speed limit on S 328th Street. Preliminary measurements indicate sight distance
is not met. Sight distance to the west measured at approximately 145 feet and is limited by
vegetation followed by horizontal curvature. There is no impedance on sight distance to the east.
Proposed Mitigations:
1. Clear as much westerly vegetation as possible to increase sight visibility.
2. Place driveway as far east as possible.
3. Create a turnaround around area for head -out egress from the driveway (see figure 2).
Given the area, the proposed mitigations are the safest, most viable options the parcel can
support. It should also be noted that there is an advisory posted speed limit of 20 mph for the
westerly horizontal curvature as well as a speed -bump approximately 300 feet to the east with a
15 mph advisory posted speed limit. The posted signage paired with the speed -bump will
effectively lower traveling speeds along S 328th Street in the vicinity of the parcel and,
ultimately, reduce the amount of sight distance needed to safely exit the driveway.
A site visit indicated lower vehicular volumes as well as slower traveling speeds around the
curvature. Vegetation clearance may allow approximately 200 feet, plus or minus, of sight
distance to the west. With the decreased traveling speeds and a turnaround option for head -out
exiting from the driveway, lower vehicle volumes, and the only area for a driveway access, the
proposed driveway should allow for safe travel.
