Mirror Lake Heights Short Plat - Request for Extension
Dear Mr. Snoey:

This letter grants approval to your request dated August 29, 2009, for a one-year extension to the Short Plat
Approval effective October 16, 2008. To date, engineering plans have not been submitted for the nine -lot
short plat.
Pursuant to Federal Way Revised Code (FWRC) 18.30.270, "Time Extension," the director may grant a one-
time, one-year extension to the short plat approval, subject to criteria. Your request demonstrates that the
economic climate has changed significantly, resulting in a change in credit markets with regard to the proposed
residential development and creating circumstances beyond your control The time extension request is hereby
approved. Unless modified or appealed, this one-time extension is valid until October 16, 2010. If the short plat
is not completed by this deadline, the short plat decision becomes void.
Under FWRC 1830.270(5), this extension decision may be appealed by any person who is aggrieved by this
decision. The appeal must be in the form of a letter delivered to the Department of Community Development
Services, and be accompanied by the established fee, within 14 calendar days of the date of this extension
decision.
As you are aware, a code amendment that provides additional construction timelines for active subdivision
projects is nearing completion with the anticipated adoption date of September 30, 2009. Once the code is
modified, this short plat project would be eligible for the following:
➢ FWRC 18.05.090 "Lapse of Approval -Time extension" supersedes FWRC 18.30270 and establishes
additional two-year extension opportunities for completion of the infrastructure beyond the one-year
construction timeline. Extension requests are subject to specific criteria and fees_

Good afternoon Nir. Snoey,
with regard to your Plat status, go ahead and submit a request for extension tinder the current code. That was/ you
don't take any chances with it expiring - even after Council acts it takes a while for publishing, etc. before it takes effect.
See FWRC 1.8.30.270. The fee is $79, 0,
You do need a permit for tree removal ilnless you meet one of t'T,io exemptions.

(steep slope", wetland. wetland buffer, stream buffer, etc), not located in a .greenbelt or tree protection area, and will no

below this tree density you must do re -planting to achieve the minimum density. For residential property the tree

2) FWRC 19.120.030(12) allows rernoval of dead, dangerous or diseased trees when authorizzed by the Director.
Generally speaking, it sounds like the trees in question are diseased or dying. In this circurnstance, I will typically send a
staff person to look at the trees. If they are obviously dead'/diseased or dying we ill authorize rernoval. If it's not
obvious to a layperson we ask for an arborist's r eport. Re --planting is not required in this circurnstance unless the trees
in question are located In a critical area or green belt.
Assuming the trees are riot located In a critical area or greenbelt, you are exerr-1pt for sere under option 1) above (but
there is a possibility you may have -to replant). You are lll.ely exempt under- option 2) as well. Why don't YOU give me a

Subject: Extension for Short Plat
I just realized that I am just less than 60 days from the one year point from my Preliminary Plat Approval. I
believe that the full Council has not yet voted on the automatic 5 year timeline for these. Do I need to submit
an Extension request just in case or would it be required anyway? I don't want to get caught without the right
paperwork in place.
Also, there are some huge Alder trees on my property that are endangering the home. All have some form of
trunk rot or tops that are dying. I asked once before and I recall being told that I don't need a permit to
remove these. Is this accurate? I had a logger look at them and they have no value except for firewood
because of the rot. Also, there is one nearly dead Madronna that lost part of its top and has trunk rot. The
only think holding it up is one of the Alders I need to remove. Do I have a separate process for this thing? Or
do I remove the Alder and when this falls, too?
