After evaluating your request, review of Federal Way Revised Code (FWRC) provisions (Sections 19.135.070), and direction provided by City Council, the Public Works Department provides the following response to each of your requests: 20td Avenue South 20th Avenue South is classified as a Minor Collector, corresponding to City Standard Street Section "R". This section consists of a 40-foot street with curb and gutter, 4-foot planter strips with street trees, 6-foot sidewalk and streetlights in a 66-foot right-of-way. The applicant has requested a modification of the Standard Street Section "R" in the area in close proximity to the identified wetlands. The reduction would be elimination of the 4-foot planter strip and the 8-foot parking strip on the side closest to the wetland. The Public Works Director may grant a waiver in accordance with FWRC 19.135.070 (2) unusual topographic or physical conditions preclude construction of the improvements as required. Your submitted request does not provide sufficient documentation to support the contention that FWRC 19.35.070 (2) applies. In addition the previous street modification request (March 2018) did not include any reduction request along 20th Avenue South. The Public Works Department hereby denies your request to modify the requirements for minimum intersection spacing. South 333`d Street South 333`d Street is classified as a Minor Collector, corresponding to City Standard Street Section "R". This section consists of a 40-foot street with curb and gutter, 4-foot planter strips with street trees, 6-foot sidewalk and streetlights in a 66-foot right-of-way. Currently South 333d Street has a 60-foot right-of-way. The applicant has proposed full dedication of the right-of-way area but a modification of the Standard Street Section "R" in the areas in close proximity to the identified wetlands. The reduction would be elimination of the 4- foot planter strip and the 8-foot parking strip on the side closest to the wetland. A review of previous Street Modification requests indicated that a similar site located along South 304d' Street near Steel Lake Was denied a very similar reduction. The Public Works Department hereby denies your request to reduce the required street section. The developer will be required to install the full City Standard Street Section Type "R" and to dedicate the additional 6-foot of total right-of-way required. The conditions of this modification will be applicable for a period of one year from the date of the letter. If a land use permit is not issued within the one-year time limit, this waiver will be void, and a new request for modification must be submitted. The Applicant has requested a re-examination of modifications to the standard street cross section to minimize intrusion into the site wetlands and wetland buffers within two right-of-ways (S 333`d St. and 20t1i Ave S). Both S 333`d St and 201h Ave S are classified as Minor Collectors with City Standard Street Section "R". The modification request is for the elimination of the required 8-foot parking and 4-foot landscape strip when in close proximity to the wetland/wetland buffer. This request affects: S 333`d Street west of 20th Ave S. 201h Avenue S south of the connection with proposed Road "A" Staff Analysis Discussions with the consulting engineers indicated the primary driver behind the request is to avoid the time required to prepare all of the submittals for a Hydraulic Project Approval (HPA) permit. 1. The street section modification included in the previous Street Modification request for S 333`d Street. The original determination denied the request and required full Street Section Type "R" to be installed. The current modification has reduced the length of the reduction request along the south side of S 333`d Street from approximately 135 feet to 75 feet. Along the north side of S 333`d Street the reduction has shrunk from approximately 120 feet to 35 feet. In addition the current submittal proposes to install a raised pedestrian crosswalk within the reduced area to provide a traffic calming measure along S 333`d St. 2. The previous street modification request did not include any reduction of the Street Section along 20th Ave S. This portion appears to have been added to avoid a HPA permit requirement. The proposed street section reduction is adjacent to Wetland A. (adjacent to request) is located south of the proposed point of connection of Road "A" at 20`l' Ave S. The previous Street Modification acknowledged that Wetland A prevents aligning Road "A" with the existing road, S. 332nd Street. When fully examined the street modification proposal does not appear to meet the criteria established under FWRC 19.135.070 (2) Unusual topographic or physical conditions preclude the construction of the improvements as required. In March the City responded and approved one modification request for an intersection location (Road A intersection with 20th Avenue S.) but denied the remaining modification requests. After a meeting last month with City staff to discuss the issues and potential resolutions, we are requesting that one of the original ROW Improvement Modification Requests related to road section be revisited based on a revised configuration of the proposal. This modification would protect existing natural resources, avoid intrusion into the wetland and/or wetland buffer, provide a traffic calming device, and offer additional pedestrian and school transportation safety. We understand that there are four reasons the City will consider a modification, deferment or waiver. In this circumstance, we believe the unusual topographic or physical conditions make the construction of standard right of way improvements as required exceedingly difficult, time consuming, and expensive. We believe we offer a potential solution that avoids the challenge yet allows the construction of a traffic system which will meet the needs of the City and offers additional benefits to the public at this location. The road standard is listed below with our proposed modification following. However, where those roads are adjacent to critical drainage culverts and wetlands we are proposing a modified street section to avoid impacts to those pipe ends and associated critical areas (wetlands and floodplains). The specific waiver request is the transitioned removal of the 8' street parking and the 4' planter strip primarily on one side of the street section. It is also proposed on north and south sides of South 333rd Street where it is adjacent to Wetland A and Wetland B at the existing twin culvert crossing. The section is extended somewhat farther to the west on the south side to avoid impacting the drainage ditch. See Sheet EX-01 for the locations of the proposed modified street section. This proposed street section provides the same full right of way but reduces the street improvements only where adjacent to three critical storm pipe inlet/outlet locations. Except for one short section on South 3331d, the reduction is limited to one side of the road where it is proposed. This minor reduction in landscape area and parking improvements only where adjacent to critical drainage facilities reduces the overall intrusion into critical natural areas, preserves flood plain capacity, limits disruption to the Mr. Marwan Salloum June 13, 2018 Page 3 existing storm culverts, reduces pollution generating surfaces, and reduces landscape maintenance along the frontage. The benefits of the combined parking and landscape reduction on South 333rd Street are many. The location of the proposed reductions on South 333rd Street offers some opportunity for the benefit of pedestrians and area school children by providing a shortened mid -block crossing between the two access points for the project. The short distance between the curbs limits the amount of time pedestrians are exposed to traffic. By incorporating an elevated surface crossing, the feature becomes a traffic calming and pedestrian safety element used in other locations around the city (e.g., 81h Avenue South near Mirror Lake Elementary School). In addition, with some signing and/or pavement marking to reserve the areas, the shortened parking areas east and west of the combined parking/landscaping reduction offers an opportunity for school bus loading/unloading zones for the benefit of the school district. The benefits of the proposed modification/waiver on 20th Avenue South are fewer, but no less important. This location is complicated due to the existing traffic circle at the intersection of South 332nd Street. The proposal is to relocate this traffic circle to the intersection with the proposed Road A. This works functionally better because a new traffic circle was proposed at the intersection of South 333rd St. Separating the traffic circles provides more effective speed control over a longer length of the street rather than concentrating it in a short section due to the two adjacent traffic circles. Moreover, the new Road A intersection will be located between essentially three intersections (South 332nd Street, South 3315Y Street, and South 331 st Street offset) so it makes sense that creating a slower traffic speed location in this area would be beneficial. Relocating the traffic circle to the Road A intersection allows the reduced landscaping/parking at the culvert outfall and provides most of the same benefits as those found at the South 333rd Street application, less the pedestrian and bus advantages. This modification/waiver will not adversely impact the overall road network. The reduction of street parking adjacent to the wetland will not cause any parking problems for the proposed development because, except for one location where the proposed reduction in parking spaces occurs, there would be few, if any, cars parked as those areas are not near future homes. Internal street parking is provided throughout the plat and along the roads where critical areas and buffers would not be impacted. Additionally, the removal of the planter strip will not result in a reduction in function or value of the streets. In the areas of the wetland buffers there is ample vegetation and planting that will be provided behind the sidewalk to reduce the overall intrusion of hardscapes into the wetland. This landscaping includes native vegetation and trees. The above requested road modification is minor and will not result in an unsafe condition due to the many mitigating improvements to the overall road network that will be provided as part of this plat. We believe that the proposed modification offers considerable benefit through preservation of natural resources, increased practical use of the right of way, and varied aesthetics. We are confident the function, safety, maintainability, and value of the road network will be improved by the granting of this modification request.
