In addition, the house intrudes 2.5 feet into the 20-foot front yard setback along 28th Avenue SW. The city became aware of the issues and received a survey drawing from the applicant that depicts all of the intrusions.A street vacation request was submitted to the city on February 28,2014,and is currently under review.The following issues must still be addressed. • Per Federal Way Revised Code(FWRC) 19.125.160,Structures and improvements,no improvement or structure may be in a required yard. As constructed,the house intrudes into the 20-foot front yard setback by 2.5 feet. In order to meet setback requirements one of the following options may be utilized. 1. Relocate the house back 2.5 feet. 2. Demolish the portion of the house located within the front yard setback. 3. Apply for a setback variance.The applicant may apply for a Process IV`Hearing Examiner'decision to review and decide upon an application for a variance to the setback requirements.However,it is unlikely the city will be supportive of such a request as the applicant has created the hardship and would not meet the variance criteria per FWRC 19.45.030. Please note:if the city does not grant approval for the ROW vacation along Marine View Drive,the house will have to meet the 5-foot side yard setback requirement as well.Please let us know how you intend to address the 28th Avenue SW setback encroachment.
