The BSP amendment application is hereby APPROVED. The BSP is determined to be acceptable for final approval and recording at King County at the expense of the applicant. Please provide two sets of signed mylars, three signed paper copies, and the $121.001 recording fee check payable to the City of Federal Way. One mylar must have original signature(s) for recording at King County, the second may be a photo-mylar, for the City of Federal Way files. The City will record the BSP at King County. SEPA PROCESS As required by the SEPA Rules (WAC 197-11-355), a Notice of Environmental Determination for the proposed parking lot improvements, inviting public comments, was published in the Federal Way Mirror on July 27, 2005. The notice identified the BSP amendment as an additional project component and considered the potential for adverse environmental impacts associated with the amendment to the existing St. Francis Hospital BSP. The notice indicated that a Determination of Nonsignificance (DNS) was issued for the proposal. A 14-day comment period followed the environmental determination. Two comments were received during the comment period, which ended on August 10, 2605. No additional information was received during the comment period that required a modification of the DNS. The appeal period for this determination was completed on August 24, 2005. Pursuant to Federal Way City Code (FWCC) Section 18-78(c) (Federal Way Environmental Protection Ordinance), environmental mitigation measures are enforced in the same manner as conditions of any permit. Failure to comply with environmental mitigation measures is grounds for suspension and/or revocation of any permit issued. OTHER AGENCY PERMITS The applicant is responsible for identifying and obtaining all required state, federal, or other agency permits, as may be required. 1 King County recording fees for the five page BSP: $98.00 for the first page, four additional pages at $5.00 each ($20) and three conformed copies at $1.00 ($3.00), for a total of $121.00. FRANCIS HOSPITAL BINDING SITE PLAN AMENDMENT Application No. 05-100133-00-SU BACKGROUND The subject property address is 34515 9'h Avenue South. The applicant proposes to amend the existing St. Francis Hospital Binding Site Plan (BSP) to establish lot #10 as a new parking lot on a parcel not currently within the existing BSP (file numbers 05-101131-000-00-UP and 05-101132-000-00-SE). FINDINGS 1. The legal owner of the property is the Franciscan Health System, which operates the St. Francis Hospital on the site. 2. The applicant, through its agent Dowl Engineers, proposes an amendment to the existing St. Francis Hospital Binding Site Plan (BSP) to facilitate the construction of the proposed parking lot on a parcel not currently within the BSP. The City has processed land use and environmental applications under file numbers 05-101131-000-00-UP and 05-101132-000-00-SE for construction of up to 60 new parking stalls along the north and western portions of an existing internal roadway, construction of a 375 stall employee parking lot on a vacant site west of the hospital, and the creation of a storm drainage facility on a vacant lot southwest of the hospital. The site is located within the Office Park (OP) zone. The site is designated as Office Park and subject to all policies of the Federal Way Comprehensive Plan (FWCP). The proposed development is permitted, subject to environmental and administrative review and a Director's decision. 4. The City's Community Development Review Committee has reviewed the proposal in relation to the Federal Way City Code (FWCC), FWCP, and all other applicable codes, policies, and regulations. A Notice of Land Use Application was published in the Federal Way Mirror on February 12, 2005, in accordance with code requirements. A 14-day comment period followed the Notice of Land Use Application. Three comment letters were received during the comment period. 6. Current uses of the project site and surrounding areas include: Project Site: St. Francis Hospital & vacant North: U.S. Bulk Mail Facility South: 6" Avenue South, Lakehaven Utility District pump station & wellhead, & commercial East: 9"' Avenue South, parking for St. Francis Hospital & Regional Stormwater Detention Facility Lake No. 6 West: Vacant & single-family residential The Federal Way Public Works Department has determined that existing streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal, subject to compliance with conditions of the DNS for the parking lot improvements. 9. Location and design of the existing access points was previously determined to be the optimal location and configuration. Access to the overall site is provided via 9'h Avenue South, a public right-of-way, and 6"' Avenue South, a private street accessed from South 348a' Street. Access to the proposed new parking lot will be through the existing internal roadway system. The existing internal access roadway system is either partially or wholly contained within Tracts X and Z, which, as the future location of South 344t' Street, will be dedicated as right-of-way at no cost to the City at such time the Public Works Director deems necessary. Therefore, parking stalls proposed to be located in Tract Z are considered to be "temporary" and shall not be eligible for any grandfathering or compensation by the City for removal. 10. New storm drainage facilities are required to be designed in accordance with all Core and Special Requirements outlined in the King County Surface Water Design Manual (KCSWDM) and the City of Federal Way addendum to the manual. The new parking lot is subject to Level 1 Flow Control and Resource Stream Water Quality treatment. The means to achieve the flow control and water quality treatment criteria is via a proposed combined detention and water quality pond, located on Lot 9 of the BSP. 11. The proposal is consistent with the FWCP, all applicable provisions of FWCC Chapter 20, and the public health, safety, and welfare. Thus, the project meets all decisional criteria of FWCC Sections 20-62(c) and 20-93(b). CONCLUSION The proposal has been reviewed for compliance with the FWCC, FWCP, and other applicable City codes, plans, policies, and regulations. The proposal has been found to meet the decisional criteria of FWCC Chapter 20. Based on the findings and conclusions of this review, Binding Site Plan Amendment Approval is recommended. This decision shall not waive compliance with future City of Federal Way codes, policies, or standards relating to this decision.
