Dear Ms. Morgan:
The City of Federal Way has received and reviewed the proposal to place a temporary job trailer, storage
container, and construction material staging and storage laydown yard at the above -mentioned property
while the Celebration Senior Living West Tower is under construction. Upon review of the Land Use
Process I application, the proposal is conditionally approved.
FINDINGS
The temporary trailer, storage container, and laydown yard was reviewed as an administrative Land Use
Process I pursuant to Federal Way Revised Code (FWRC) 19.275.080, `Regulation of temporary trailers,
buildings, or other structures for construction; temporary business or sales, and outdoor storage containers
for construction -related materials'.
The job trailer and storage container will be located on vacant property owned by Church of Blessing
across the street (S. 3281h St.) from the construction site. The church has given permission to Inter -City
Contractors, Inc. to use the property during construction; anticipated length_ of use is approximately one
year. The construction entrance to the site is located off South 328`h Street. Clearing and removal of the
underbrush of the vacant lot is proposed. The cleared area will have a 4-inch crushed rock base for
storage of equipment, materials, concrete form materials, construction trailer, and storage containers.
The site will have a silt fence around it with temporary chain link fencing. The westernmost 20 feet of the
site will remain undisturbed and no large trees will be removed. The trailer and storage container are
screened from adjacent properties by existing vegetation and fencing. It has been deemed that the
temporary trailer and storage container are not visually intrusive and will not alter the character of the
site, on a temporary basis.
CONDITIONS
1. This approval is for a temporary job trailer, equipment and construction materials storage yard
only. Within 3 weeks of Certificate of Occupancy of the Celebration Senior Living West Tower,
this site shall be returned to its existing condition, and no fill or construction materials shall
remain onsite. Contact Becky Chapin, Associate Planner, at 253-835-2641 for inspection upon
completion of work and site clean-up.

2. Additional land use review is required if the owners of the site, Church of Blessing, propose to
develop the property after construction is complete.
3. A no disturbance area shall be established for each tree to be protected. The no disturbance zone shall
be equal to the critical root zone which is defined as 12 inches radius for every one inch of tree
diameter measured at four and one-half feet above ground. The no disturbance zone shall be
identified during the construction stage with a temporary five-foot chain -link fence. Alternative
protection methods may be used if accepted by the director to provide equal or greater tree protection.
APPEALS
The effective date of this decision is September 7, 2015, or three days from the date of this letter.
Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal
this decision to the Federal Way Hearing Examiner by September 21, 2015. Any appeal must be in the
form of a letter delivered to the Department of Community Development with the established fee. The
appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged
errors in the Director's decision, including the identification of specific findings and conclusions made by
the Director disputed by the person filing.
In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal
this decision). Waiver of the right to appeal does not affect the effective date of this decision. This
decision shall not waive compliance with future City of Federal Way codes, policies, and standards
relating to this development.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of the
building permit.

Thanks for your email, it clarified my earlier question. As it relates to Public Works, your TCO was signed off on last
Monday (the 20"'). At least to my knowledge, within Public Works, there was no attempt to narrow any conversation,
just a restatement of what was previously said and you already acknowledged.
I'll additionally point out that the required As-Builts for the site/frontage improvements for Phase 1 were not submitted,
which were also a condition of the building permit prior to a Certificate of Occupancy. Without being asked, we deferred
them to Phase 2 (NOT a condition of a TCO) to assist in getting Phase 1 to the finish line. They will be required prior to
being able to sign off on Phase 2.
1 deal with outside the building envelope, and elevators and the State L&I Inspectors are way outside of my area.
Although what you wrote sounds very frustrating, I am going to have to defer on that front.
Switching from the TCO to the Right of Way, in summary, it sounds like the conversations between the Church and
Housing For Seniors needs to progress. I hope the Church is willing to work with you on the laydown yard and that and
the ROW dedication can be rolled together into one package.
If there is any merit, or it would help advance your project, I am happy to meet with you and the Church jointly to
discuss. Regardless of if the laydown yard ultimately is used, this also will be required prior to being able to sign off on
Phase 2.

What we agreed to included two (2) options -- one utilizing the Church property for staging and laydown and one
without. Its too early to tell if we will gain the Church's cooperation quickly enough to take advantage of the first
(preferred) option, but its also to early to close that application. I think the concern was that it sounded like the City was
perhaps trying to narrow our options down to just the first option. That would be our only objection.
The other problem is that we have not yet gotten what we bargained for on Phase I -- a temporary Certificate of
Occupancy on the East Tower, followed by the final unconditional Certificate of Occupancy once the small matter with
King County is cleared. The East Tower is undeniably substantially complete and ready for occupancy, but the State L&I
Elevator inspectors are playing politics and are purposely slow -walking the elevator inspections to punish us for utilizing a
non -union Elevator installation company. Sound far-fetched? Its not. Our General Contractor was told by L&I that they
didn't want us to use a non -union elevator installer when he first contacted them to inquire about inspections.
These inspectors are routinely "failing" the inspections after only two (2) issues are identified and then refuse to continue
the inspections and will only reschedule the inspections until after the maximum 10-day waiting period. This is an abuse
of discretion. They are obviously more concerned about politics than they are about safety and about consideration for
the dozens of prospective residents for whom we have had to find temporary accommodations. For example, one
inspection was failed because the floor material in the elevator was vinyl rather than the carpet originally specified in the
plans. We routinely change -out carpeting for vinyl in elevators new and old elevators through out our portfolio without
objectin from L&I. Vinyl in not only acceptable, but it is superior from a maintenance and safety point of view, as we use
slip -resistant textured vinyl products that are also easier to clean. This flimsy excuse to fail an inspection alone proves
that the inspectors have another -- in this case, political -- agenda.
By failing such inspections based on a minimum of only two (2) minor issues increases the likelihood that the next
inspection will fail, too, because any other readily identifiable issues that could otherwise also be identified and resolved
before the next inspection might result in another failed inspection.
We are bringing in a well -respected independent elevator consultant who we have on retainer and our most senior
construction superintendent for the next upcoming inspection to try to prevent this pattern from continuing. We would
appreciate it if the City could also weigh in on this with the state inspectors. Of course, they will deny this, but I think that
its time that they were told in no uncertain terms that they have proved their point and that its time to do their jobs and
let us move on.
If this pattern of slow -walking these elevator inspections continues on into next week, the number of affected residents
who might be prevented from moving into their new apartment homes at Celebration Senior Living East as scheduled will
go from around a couple dozen to somewhere around 70 to 100 seniors. If that is the case, you can be sure that we will
be supplying them with this explanation and with the phone numbers and email addresses of all City and State officials
and lawmakers. I am sure that the 6,000+ seniors in our other 30 locations in Western Washington will also want to pitch
in and help their fellow seniors respond to this abuse of discretion by the State L&I elevator inspectors. I think they have
a right to know what's going on here, to make sure that it doesn't continue and to make sure that it doesn't happen
again. Don't you?

It is up to you who records the covenant, I'm fine with someone from your team recording it. I just need verification
that it has been recorded before the CO is issued. Otherwise, the city can record the covenant, our intern will be
making a trip to the King County Office either Thursday or Friday next week. If the city records the document then we
will need the $79.00 recording fee (check made payable to City of Federal Way) with the original signed covenant to
record.
Regarding the temporary trailers UPI application, it's still under review. I have to discuss a few things with Ann Dower
in PW, but she has been out of the office, returning on Monday. I don't think Planning will have any issues, but
conditions will be placed on the approval letter. I'll have a better idea of the status early next week.

Hi John,
It is up to you who records the covenant, I'm fine with someone from your team recording it. I just need verification
that it has been recorded before the CO is issued. Otherwise, the city can record the covenant, our intern will be
making a trip to the King County Office either Thursday or Friday next week. If the city records the document then we
will need the $79.00 recording fee (check made payable to City of Federal Way) with the original signed covenant to
record.
Regarding the temporary trailers UPI application, it's still under review. I have to discuss a few things with Ann Dower
in,PW, but she has been out of the office, returning on Monday, I don't think Planning will have any issues, but
conditions will be placed on the approval letter. I'll have a better idea of the status early next week.

RE: Celebration Senior Living Apartments — Laydown Staging Area
Project Narrative
The project involves clearing and removing the underbrush of the vacant lot on the corner of S 328th
Street and 13th Ave South for use as a staging area and storage area of construction material and the
location for the job trailer for the construction of Celebration Senior Living Apartments — Phase II.
The property is owned by the Church of Blessing, located at 1430 S 330th Street in Federal Way and
they have given permission to Inter -City Contractors, Inc to use the property during construction.
The work included with the permit will be to clear and grade the vacant lot, except the most western
20' — which will remain undisturbed. All large trees will remain. The site will have a silt fence
around it, with temporary fencing, where existing fencing does not exist. There will be a construction
entrance located off S 328th Street. The cleared area will have a 4" crushed rock base. The site will
be used for the storage of equipment, material storage, concrete form material storage and there will be
a construction trailer and storage containers.
The job trailer will be a typical job trailer with T-111 siding that is light grey in color with green trim,
White vinyl windows and white fiberglass doors. The storage container will be typical per what is on
the first phase of construction. The trailer & storage unit are screened from adjacent properties by
existing planting along the property lines and existing fencing along the property lines. The trailer and
storage unit are place away from the street.
The anticipated length of use of the site is approximately 1 year. Upon completion of Celebration
