This office and other City staff have reviewed the environmental checklist you submitted. We have determined
that the proposal will not have a probable significant adverse impact on the environment, if the conditions noted in
the enclosed Mitigated Detennination of Nonsignificance (MDNS) are implemented. As a result, an
environmental impact statement (EIS) is not required.
The final determination may be appealed within 14 days following the date of issuance. No licenses, permits, or
approvals will be issued until completion of the appeal period.
Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from the City
has been granted. Approval or denial of the proposal will be made by the appropriate administrative or legislative
body vested with that authority. The environmental record is considered by the decision maker(s) and conditions
will be imposed to reduce identified environmental impacts, as long as the conditions are based on adopted and
designated City policy.
After a final decision has been made on your proposal (i.e., after a permit has been issued or City Council action
taken, as applicable), you may, but are not required to, publish a Notice of Action as set forth in RCW
43.21C.075. The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's
compliance with SEPA can be made. A copy of the Notice of Action form and copies of Revised Code of
Washington (RCW) 43.21C.080 and WAC 197-11-680 providing instructions for giving this notice are available
from the Department of Community Development Services.
The City is not responsible for publishing the Notice of Action. However, the City is responsible for giving a
notice (to parties of record) stating the date for commencing a judicial appeal (including the SEPA portion of that
appeal) if your proposal is one for which the City's action on it has a specified time period within which any court
appeals must be made_

Description of Proposal: The applicant proposes construction of a 20,670 square -foot medical
office building. The applicant also proposes parking, landscaping,
outdoor trash enclosure, and other site improvements.

The Responsible Official of the City of Federal Way hereby makes the following decisions based upon
impacts identified in the environmental checklist, Federal Way Comprehensive Plan, Final Staff
Evaluation (incorporated herein by reference as though set forth in full), and other municipal policies,
plans, rules, and regulations designated as a basis for exercise of substantive authority under the
Washington State Environmental Policy Act Rules (SEPA) pursuant to the Revised Code of Washington
(RCW) 43.21C.060.
The lead agency for this proposal has determined that the proposed action does not have probable
significant adverse impact on the environment, and an Environmental Impact Statement (EIS) is not
required under RCW 43.2 1 C.030(2)(c), only if the below condition is met. This decision was made after
review of a completed environmental checklist and other information on file with the lead agency. This
information is available to the public on request.
Findings of Fact
1. .The applicant proposes to develop a 20,670 square -foot medical office building on a vacant 2.72-acre
site. Associated parking, landscaping, and frontage improvements are also proposed.
2. The subject property is zoned Office Park (OP). The comprehensive plan designation for the site is
Office Park_ A medical office is a permitted use in the OP zoning classification.
Based on the Traffic Impact Analysis (TIA), prepared by Heath & Associates, Inc., dated February
22, 2005, the development would generate 73 new weekday evening peak hour trips and 710 daily
trips. The new trips generated by the development would have significant impact on the City's
transportation network. The City of Federal Way has identified three (3) TIP projects impacted by 10
or more trips.
4. Street improvements for the project must comply with adopted City codes. The applicant must
construct street frontage improvements along 04 Avenue South and along the access easement on the
south side of the site.
5. The "Final Staff Evaluation for Environmental Checklist, File No. 05-102389-00-SE," is hereby
incorporated by reference as though set forth in full.
Conclusions of Law
The following are components of the City of Federal Way Comprehensive Plan supporting the
recommended conditions for the development.
TG1 .Maintain mobility for residents and businesses through a balanced, integrated system of
transportation alternatives that:
a. Meet local and regional needs though inter jurisdictionally coordinated and integrated
systems-
b. Reduces auto dependency, especially SOY use.
C. Supports the land use vision and plan.
d Protects and enhances the environment and quality of life.
e. Provides acceptable levels of service for each transportation mode that is also
commensurate with the planned levels offunding.
TG2 Provide a safe, efficient, convenient, and financially sustainable transportation system with
sufficient capacity to move people, goods, and services at an acceptable level of service.
The City shall develop and adopt policies for the construction, reconstruction, maintenance, and
preservation of new and existing facilities.
TP16 The City's LOS standard shall be'E. This is defined herein as a volume/capacity ratio less than
1.00-in accordance with Highway Capacity Manual (2000) operational analysis procedures. At
signalized intersections, the analysis shall be conducted using a 120-second cycle length and level
of service E is defined as less than 80 seconds of delay per vehicle. Where transit or HOV
facilities are provided, the LOS shall be measured by average delay and volume/capacity ratio per
person rather than per vehicle. This standard shall be used to identify concurrency needs and
mitigation of development impacts. For long-range transportation planning, a volume/capacity
ratio of 0.90 or greater will be used to identify locations for the more detailed operational
analysis.
TP17 Expand arterial capacity by constructing channelization improvements at intersections when they
are an alternative to creating new lanes along a roadway corridor.
TP24 Consider safety first in the design of intersection improvements.
TP43 Minor capacity projects, placing spot (localized) traffic improvements, will be carried out to
extend the capacity of system components.
TP62 Modify the development review process by:
■ Incorporating revised impact analysis procedures that comply with GMA concurrency and
other requirements. The revisions need to include revised Level of Service standards.
■ Streamlining it to the extent possible to minimize private development costs_ Where
developments are consistent with this plan, they should be allowed to proceed by mitigating

site impacts; developing appropriate components of the HOV, transit, non -motorized and
motorized chapters; and participating in an equitable citywide improvement funding or
mitigation payment program.
■ Incorporating requirements of the Americans with Disabilities Act.
Requiring explicit consideration of pedestrian and bicycle circulation, as well as parking and
general circulation needs.
SEPA Conditions
In order to mitigate for the adverse transportation impacts of the new trips generated by the development
on the existing transportation network, prior to the issuance of Certificate of Occupancy, the applicant
shall:
1_ Construct impacted TIP projects at the following locations:
a. South 320'h Street at IS` Avenue South: Add 2"d NB and 2nd WB left -turn lanes, WB right turn
lanes, and widen I' Avenue South to five lanes to South 316'h Street. - $5,500,000
b. South 336d` Street @ 9"' Avenue South: Signal modifications - $100,000
C. SR 18 @ SR 161: Add 3rd westbound left -turn lane, eastbound and westbound right -turn lanes,
2°d NB right-tum lane, add third southbound lane on SR 161 to South 352°d Street — $3,000,000
Channelization and street improvement plans shall be prepared by a professional engineer registered in
the State of Washington and submitted for City of Federal Way's review and approval in concurrence
with building permit application and constructed prior to the issuance of Certificate of Occupancy.
In lieu of constructing the above 2004 — 2009 TIP improvements projects (a — c), prior to the issuance of
building permits, the applicant may voluntarily pay the project's pro-rata share contribution calculated in
the amount of $26,600 towards the TIP projects. The pro-rata share contribution for each project is
calculated based on the formula below:

This MDNS is issued under the Washington Administrative Code (WAC) 197-11-340(2). A 14-day
comment period was provided fallowing the notice of application. No additional comment period is
required. Any person aggrieved of the City's final determination may file an appeal with the City within

PURPOSE OF CHECKLIST
The State Environmental Policy Act (SEPA), RCW Chapter 43.21 C, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An environmental impact
statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the quality
of the environment. The purpose of this checklist is to provide information to help you and the agency
identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done)
and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your proposal
are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise

The proposed project consists of the construction of a 20,800 square foot, single -story Medical Office
Building with associated parking and a detached storage building. The subject site is approximately
118,428 square feet (2.72 acres) in size.

The King County Soils Maps indicate that generally, the area where this site is located is underlain
by Everett — Alderwood Gravelly Sandy Loams (EwC) generally with slopes between 6 —15%.

There are no known indications of unstable soils on or in the immediate vicinity of the subject site.
e. Describe the purpose, type, and approximate quantities of any filling or grading proposed.

This project will include the import of approximately 5,000 CY of material, including
asphalt base, in order to grade in the building pad and site as proposed. Material imported
to the site will be obtained from an approved source.

Erosion could occur as a direct result of clearing or construction activities on the subject site.
Measures will be taken to minimize the possibility of erosion and the keep all sediments on the
subject site.

It is estimated that approximately 65% of the subject site will be covered with impervious surfaces
after the project is constructed.

Standard procedures as required by the City of Federal Way to include filter fabric fencing as
required and placed to avoid/prevent soil movement. In addition, rock construction entrances will
be used to keep sediment from the public roads. Catch basin inserts and other erosion and sediment
control measures will be used as needed to keep sediment -laden run-off from leaving the site.
a. What types of emissions to the air would result from the proposal (i.e., dust, automobile, odors,
industrial wood smoke) during construction and when the project is completed? If any, generally

Minimal emissions are anticipated as a direct result of the construction workers use of

As indicated on the City of Federal Way Wetland Inventory, there is a small lake
to the west of the subject site. The City has indicated that this feature is also a
stormwater detention facility and is considered to be a "regulated lake."

The proposed project is located within 200 feet of the described lake. All necessary
setbacks and buffers will be adhered to. Please see the attached Site Plan.

The proposed project does not require any fill or dredge of the described lake or the on -site

No waste materials will be directly discharged into the ground as a result of the proposed
project. The subject property is served by public sanitary sewers. A certificate of Sewer
Availability has been issued by Lakehaven Utility District for the proposed project.
c. Water runoff (including stormwater):
1) Describe the source of runoff (including storm water) and method of collection and
disposal, if any (include quantities, if known). Where will this water flow? Will this
water flow into other waters? If so, describe.
The site grading and storm drainage design takes advantage of the regional storm water
detention provided for the West Campus Storm Drainage detention system designed by
Quadrant Corporation for this entire area. This site drains to Lake 3, immediately
adjacent to the project site. This storm drainage ultimately finds its way to Lake #1
through the existing pipe network. The omission of the on -site detention system is allowed
because of the provision of detention immediately downstream of the site, an approach
approved by Mr. Kevin Peterson of the City of Federal Way. Water quality is being
provided by way of a bio-swale which discharges to an existing storm drainage pipe
running to Lake #3. The site grading is designed to direct on -site runoff to this water
quality system as well as to minimize the amount of imported material needed for the site.
2) Could waste materials enter ground or surface waters? If so, generally describe.
It is unlikely that significant amounts of waste material could enter ground or surface
waters.
d. Proposed measures to reduce or control surface, ground, and runoff water impacts, if any:
Minimize excavations required for foundations, utilities, walkways, driveway/parking. Filter fabric
fence and other erosion Best Management Practice's per City of Federal Way and Washington
State Department of Ecology requirements will be utilized as necessary.

Short term noises related to the proposed project include typical construction -related noises that will
occur on the subject site typically from 7:00 AM to 5:OOPM Monday through Saturday. Long term
noises associated with the proposed project will include those typically generated by an increase in the
number of vehicles coming to and from the site. Mechanical equipment serving the building will not
be a significant source of noise.

Current Use: The subject sit is currently vacant. To the north of the site is the
Windermere Real Estate Office Building. To the south is the old City Hall Building and
associated parking areas. To the west of the subject site there are several office buildings.
To the east is undeveloped land that is zoned for more office buildings.
b. Has the site been used for agriculture? If so, describe.
There is no indication that the subject site has ever been used for agricultural purposes.
c. Describe any structures on the site.
The subject site is vacant.

The subject site is vacant and no structures will be demolished as a direct result of the proposed
project.

The subject site is currently designated as "Office Park" (OP) on the City of Federal Way's official

Portions of the subject site contain an identified Class 2 wetland. This wetland has been delineated
previous to this project by Talasaea Consultant's, Inc. (07/11/02). This wetland is also indicated on
the City of Federal Way Wetland Inventory Maps.

It is anticipated that the proposed building, at full occupancy, will be occupied by approximately 10
doctors and 30 staff members for a total of approximately 40 full-time employees on site.

The completed project will not displace anyone.

10. Aesthetics

The maximum building height proposed is approximately 22 feet. The exterior finish materials are
proposed to include masonry veneer, wood or wood -like siding, ("Hardi-plank"), glazed entry
storefront systems. The roof is proposed to be laminated architectural composition shingles.
Horizontal banding features are proposed around the building exterior walls using wood trim, roof
fascias, masonry coursing possibly with accent bricks and alignment of window head/sill/mullion.
The proposed color pallet being considered for the exterior materials include natural tones for the
"field colors" of both masonry and painted/stained materials. Deeply saturated hues and/or the use
of natural stained wood components/features are also being proposed. Focus will be to blend,
highlight, and compliment colors with the available colors for masonry veneer.
b. What views in the immediate vicinity would be altered or obstructed?
Views onto the subject site will change from that of vacant land to a developed commercial site with
parking, landscaping and other commercial site features. Views off of the subject site will not be
altered as a direct result of the proposed project. However, the surrounding properties are
currently being planned for future commercial and mixed use development.
c. Proposed measures to reduce or control aesthetic impacts, if any:
The proposed development will conform to the applicable City of Federal Way's Design Guidelines.

11. Light and glare
a. What type of light or glare will the proposal produce? What time of day would it mainly occur?
The proposed project will result in an increase in the amount of light and glare over current un-
developed site conditions. The proposed project will utilize low glare, high cut-off shielded parking
lot lights. These lights would typically be on from late afternoon/early evening to early morning
hours. In addition there will be an increase in the amount of vehicle traffic on the subject site
resulting in additional light and glare typical for a commercial development.
b. Could light or glare from the finished project be a safety hazard or interfere with views?
It is not anticipated that the glare resulting from the proposed project will create a safety hazard or
interfere with views.
c. What existing off -site sources of light or glare may affect your proposal?
There are no known off -site sources of glare that will affect the proposed project.
d. Proposed measures to reduce or control light and glare impacts, if any:
The use of industry standard high cut-off shielded light standards in all parking and drive areas will
help limit the amount of light and glare generated from the subject site. In addition, perimeter
landscaping in the parking areas will help control vehicle headlight glare from leaving the subject
site.

a. What designated and informal recreational opportunities are in the immediate vicinity?
There are various informal and formal recreational activities provided within the City of Federal
Way.
b. Would the proposed project displace any existing recreational uses? If so, describe.
The proposed project will not displace any recreational uses.

Access to the proposed project will be via two driveways directly off of 6`" Avenue South to the east
of the site. Please see the attached Site Plan.

transit stop?
Metro Transit currently operates several Park and Ride facilities in the City of Federal Way that
provide connections to the entire Seattle / Tacoma area on a regular daily basis. In the immediate
vicinity of the proposed project there are several Metro Transit stops.
c. How many parking spaces would the completed project have? How many would the project
eliminate?
The proposed project is anticipated to provide a total of 164 standard parking stalls and 6
handicapped stalls. No parking spaces are being eliminated by the proposed project.
d. Will the proposal require any new roads or streets, or improvements to existing roads or streets,
not including driveways? If so, generally describe (indicate whether public or private).
The proposed project will not require the construction of any new roads or streets. Nor will it
require improvements to the existing roadways in the immediate vicinity of the subject site.
e. Will the project use (or occur in the immediate vicinity of) water, rail, or air transportation? If
so, generally describe.
The proposed project does not require the use of, nor will it occur in the immediate vicinity of
water, rail or air transportation systems.
f. How many vehicular trips per day would be generated by the completed project? If known,

Based on the proposed Medical Office use of the proposed structure, it is anticipated that the
project will generate approximately 710 (vpd) Average Weekday 2-way Trips (AWDT). It is
anticipated that there will be approximately 49(vph) AM Peak Hour trips (7:00 to 9:00 AM) and 73
(vph) PM Peak Hour trips (4:00 to 6:00 PM). Please see the attached Traffic Impact Analysis
prepared by Greg Heath (February 2005) for the proposed project.
g. Proposed measures to reduce or control transportation impacts, if any:
Proposed mitigation is pro-rata share contribution towards the Federal Way TIP projects that
