According to your October 1, 2007 letter, the western portion of the site is modified to eliminate vehicular access into a private property located west of the subject property. As depicted on the revised site plan, vehicular access from the rear of the project site now terminates into the existing ingress/egress easement which runs south of the subject property and is consistent with vehicular access from the front of the site. No new easements are required to facilitate this modification, and no new access points are created. Process III land use approval for the office building was granted on July 20, 2007, and amended on August 15, 2007.1 A foundation only building permit was issued on August 31, 2007. There are no changes to site access points, easements, utilities, or impacts to sensitive areas, significant trees, or the environment with the requested fagade modifications. Compliance with Community Design Guideline standards is maintained. Pursuant to Federal Way City Code (FWCC) Section 22-411, "Subsequent Modification," the modification request does not constitute a change in use and is determined to have no substantial changes to the impacts on the neighborhood or the City as a result of the change. We thought the solution would be to obtain an access easement at the same time as the temporary construction easement. As it turned out, the owner to the west is not receptive to any easement. Our owner has instructed us to revise the access to the site via the existing access easement to the south of the property. If you look at the attached proposed site plan, moving the driveway to the south would eliminate (4) parking stalls. We would provide 5 feet of landscaping next to the existing 5 feet at the neighbors property to the west. End of stall landscaping would be provided as well. If this looks acceptable to you, we plan on having the civil engineer revise the drainage so that it does not cross the property to the west.
