Dear Mr. McKean:
The City of Federal Way received your request dated February 9, 2000, to waive the required right of way
improvements for the property located at 1430 South 3300 Street. As we discussed during our telephone
conversation, Federal Way City Code (FWCC) Section 22-1477 requires that the Public Works Director
base his decision to waive the modifications solely on one or more of the four criteria outlined in FWCC
Section 22-1477.
I have enclosed an informational sheet outlining the requirements of FWCC Section 22-1477 to help you
in your preparation of a right of way modification request. Please resubmit your request, specifying the
particular improvements you would like waived, and explain how your request meets the modification
criteria.

Dear Cary:
We are writing this letter in response to Hazem EI-Assar's 12/16/99 memo to Deb Barker
(attached) regarding the frontage improvement requirements he is requesting in conjunction
with the minor tenant improvements Washington State Youth Soccer (WSYSA) is proposing.
WSYSA has just received the MAI appraisal which indicated that the current property value is
$996,000+ of which $310,000+ is attributed to the building improvements. The current tenant
improvement proposal is in the range of $100,000 - 120,000 which is above the 25% threshold
requiring frontage improvements.
We have spoken with Mr. El-Assar regarding the viability of the city granting a waiver of these
requirements. Mr. EI-Assar indicated that the city has in the past has allowed waivers for these
type of improvements. He indicated that we would need to formally request a waiver per
FWCC Sec. 22-1477 directed to your office.
WSYSA is a non-profit corporation chartered to promote, organize and govern youth soccer in
the state of Washington. Currently, WSYSA serves over 125,000 registered youth soccer players in
this state. The vast majority of those players live in King County and many of them live and play
in Federal Way. The organization operates on a very limited budget based primarily on fees
paid by its youth players. Currently WSYSA leases a small office in Federal Way for its
administrative needs and conducts its other activities, such as training for coaches and youth
soccer participants at borrowed locations as they can schedule the use of the space.
For many years WSYSA has been creating a fund for the future acquisition of its own facility. The
fund was created from fees paid by youth players. The facility under consideration (although a
large financial commitment by WSYSA) would be an ideal location to house WSYSA's
administrative offices and would allow training and classroom meetings for coaches and youth
soccer participants on -site. WSYSA has plans to continue to improve the facility over the long
term as they can fund the additional improvements according to what the board of directors
feel the youth players are able to pay to play.
The addition of the WSYSA and its services to the neighborhood that now contains Federal Way's
"jewel" of an athletic facility is not only a compatible use of the property that will clean-up a site
which has sat vacant for a number of years, but also makes Federal Way and Celebration Park
the center for youth soccer in this state. Federal Way was among the original founding soccer

communities for WSYSA and has produced many state championship teams and collegiate and
professional players.
Consequently, WSYSA will not be able to complete the purchase of the property if it is required
to complete the off -site improvements suggested by Mr. Assar. WSYSA is agreeing to improve
the parking areas and upgrade the building exterior (not originally planned as an expense) as
requested by the planning department and is working to procure funds to purchase and
improve the facility. We would respectfully request that the City of Federal Way waive the
frontage improvements and any other off -site requirements for this project, so that WSYSA may
proceed with its plans to purchase the property.

Based on my review of the submitted materials and a site visit, I have the following comments:
Traffic Impacts
The project may impact some intersections by 10 or more PM peak hour trips, which would require a
traffic impact analysis (TIA). To make that determination, a trip gene*on/distribution study is required.
Frontage Improvements
Per FWCC Sec. 22-1474, half width frontage improvements are required if the value of the proposed
improvements exceeds 25% of the value of all existing structures on the subject property. On S 330'
Street and the unimproved part of 13`h Place S, improvements shall conform to standard cross section R,
which includes 20' pavement from centerline to curb, curb, gutter, 4' planter with trees, 6' sidewalk, 3'
utility strip, and street lights. On the improved part of 13d' Place S, improvements shall include the
addition of a 4' planter, 6' sidewak 3' utility strip, and street lights. To accommodate the above
improvements, a 33' right-of-way dedication is required on S 330' Street and the unimproved part of 13''
Place S and a 13' right-of-way dedication in required on the improved part of 13`' Place S.
Per FWCC Sec. 22-1477, the Public Works Director may modify, defer, or waive the above requirements
after consideration of a written request for specific reasons outlined under that code section.
Site Access and Circulation
Per FWCC Sec. 22-1543, a minimum driveway spacing of 150' on S 330' Street is 150' shall be
maintained. An additional driveway may be installed on 130' Place S under the same requirements.

Dear Mr. McKean:
This letter responds to your request to waive required street improvements along S 330' Street
and along 13' Place S associated with the proposed development.
After evaluating the existing conditions along S 330`' Street and 13`h Place S, review of Federal
Way City Code (FWCC) provisions (Sections 22-1496, 22-1477), and the direction provided by
the City Council, the Public Works Department has determined the requirements for street
improvements on both streets to be applicable to the development of the property.
FWCC Section 22-1477 Modification of Improvements Along Property Frontage:
This code section allows the Public Works Director to grant a request to modify, defer, or waive
the required street improvements only after consideration of specific criteria. These criteria were
reviewed to determine their application with respect to this request, as summarized below:
(1) The improvements as required would not be harmonious with existing street

improvements, would not function properly or safely or would not be advantageous to

the neighborhood or cityas a whole.

While it is true that the connection of S 330`h Street and 13`h Place S will increase

traffic in the area, this connection is anticipated by the City's Comprehensive
Transportation Plan and provides an important link for commercially zoned properties

in the area. , This criteria does not apply.
(2) Unusual topographic or physical conditions preclude the construction of the
improvements as required.
Slopes within--the-subjectmrea -do -riot exceed four feet in height. Construction of the
improvements would not be substantially affected by the difference in grade.
Therefore, this criteria does not apply.
(3) Proper vertical or horizontal alignments cannot be determined because the existing
streets do not have correct alignments.
Alignments have been determined. This criteria does not apply.
(4) The required improvement is part of a larger project that has been scheduled for
construction in the city's adopted six -year transportation improvement program.
There are no City of Federal Way projects identified for this area. This criteria does �,rk—
not apply.

In summary, as a part of this building permit, the applicant is required to install full frontage _�-
improvements on both S 330'' Street and 13' Place S. On S. 330`' Street and the unimproved
part of 13th Place S., this shall include 20' pavement from centerline to curb; curb, gutter, 4'
wide planter strip with street trees, 6' wide sidewalk, 3' wide utility strip, aXid street lights. On
the improved portion of 13`' Place S, improvements shall include the -addition of a 4' planters
strip with street trees, 6' wide sidewalk, 3' wide utility strip, and street lights. To accommodate
the above improvements, a 33' right-of-way dedication is required on S. 330t' Street and the
unimproved part of 13'' Place S. A 0' wide right-of-way dedication is required on the improved
portion of 13`' Place S.
