The area was indicated for type three landscaping in a five foot strip between the building and the property line. A solid six foot wood fence extends along the east property line and a six foot chain -link fence extends along the north property line. A four foot walkway abuts the building on the north and east sides connecting the emergency door on the east side to the emergency door on the north side. This only allows a one foot planting strip, instead of five feet between the building and the fence. The strip is to be planted with Vinca minor (Common Periwinkle) groundcover at a three foot spacing. This walk was installed to provide necessary emergency access, security and maintenance access. The are no windows on the walls on those sides and the adjoining property is wooded and covered with native growth on a slope next to the chain -link fence. Land use approval for the new church was granted on May 23, 2003, and an Environmental Determination of Nonsignificance (DNS) was issued on February 22, 2003.1 Previous site modifications dated July 3, 2003,2 and June 10, 2004,3 have been granted. Landscape Modification The applicant submitted a landscape modification request dated August 26, 2002, to modify the Type III landscape requirements along the east side of the site based on topographic constraints in this area. This request was approved in the land use decision. The landscape planting areas along the east and north perimeters constrained by the grade change are further impacted by a four -foot wide walkway around the exterior of the building. The walkway required by the Fire Department for emergency exiting, extends along the north and east portions of the building, leaving only a one -foot wide planting area. There are existing fences along the north and east property lines. The applicant proposes to install Vinca Minor in the remaining planter area to grow up the fencing and provide a vertical screen. Shrubs planted in the narrow planting strip would soon outgrow the bed and impact the required emergency access. Due to the nature of the special circumstance of the north and east portions of the site, it is appropriate to reduce the perimeter landscape area to one foot and plant a climbing ground cover to provide screening within the reduced planter island. This landscape modification request is approved as provided for in Federal Way City Code (FWCC) Section 22-1570(d). Parking Lot Modification Request Under Phase 1, 68 existing parking stalls are proposed to be used for the Church project. In a March 3, 2005, letter with site plan exhibit, the Landscape Architect demonstrated that 2,119 square feet of interior parking lot landscaping has been installed at the Church site in new and existing landscape islands, and requests that a 300 square -foot landscape island originally proposed for the western side of the parking lot not be installed in Phase I. In addition, existing stormwater drainage patterns, maintained for the subject site during Phase I, will not be not impacted by the elimination of the interior parking lot landscape island. The 300 square -foot parking lot landscape island will be installed in the Phase II portion of the project consistent with interior parking lot landscape requirements. FINDINGS OF FACT 1) Interior parking lot landscaping in the amount of 2,119 square feet is provided for the 68 parking stalls in excess of the code requirements for interior parking lot landscaping FWCC Section 22- 1567(b)(1)(a)(1). 2) There are no changes to access points, easements, utilities, or impacts to sensitive areas, significant trees, or the environment with the site plan change request. Pursuant to FWCC Section 22-411, "Subsequent Modification," the site plan modification request to defer installation of the 300 square -foot interior parking lot landscape island from Phase I to Phase 11 does not constitute a change in use and is determined to have no substantial changes to the impacts on the neighborhood or the City as a result of the change, and is hereby approved. Land use approval for the new church was granted on May 23, 2003, and an Environmental Determination of Nonsignificance (DNS) was issued on February 22, 2003.2 Based on the information depicted in the revised site plans, floor blahs, landscape plans, and canopy details, (copies enclosed), you have proposed to expand Phase I of the new church to include limited concrete decking work on the second floor; construction of a Phase II entrance canopy on the west portion of the south fagade; creation of a church -related classroom, storage room, and hallway west of the church stage; and installation of kitchen facilities. The second floor concrete work is included in Phase I in conjunction with the stabilization of the south fagade, and is also necessary so that first floor restrooms can be finished. The entrance canopy and the kitchen are proposed as an expansion of Phase 1. The storage and classroom west of the stage are created when an accessible ramp to the stage is provided. Previous modifications dated July 3, 2003,2 and June 10, 2004,3 have been granted. Based on the information depicted in the revised elevations, you have proposed to change the existing concrete tilt -up building facade by refacing it with stucco and brick. The stucco walls will be painted Taupe,4 with new stucco'window trim painted Malt color. A three-foot wide brick band along the base of the south facade will be Granville Grey.5 The flat roof will be concealed with the addition of a stepped stucco parapet topped by wide cornices. A three-foot wide frieze sits below the corniced portions of the building. The height of the parapet wall ranges from 37 feet over the western facade, 30 feet over the Phase II entrance to 15 feet over the eastern portion of the building. Turned columns on brick bases support the Phase I and Phase II entrance canopies. Windows along the first floor of the two-story section of the building are rectangular, while upper level and single story windows would reflect a compound arch. New windows are proposed for the entire south facade as noted on the revised elevations. A five-foot tall electrical box to accommodate electrical system upgrades has been installed outside the southeast corner of the building, necessitating the relocation of the four -foot wide pedestrian corridor around this mechanical unit. This pedestrian corridor will extend from the front to the rear of the building along the east side of the site. Conditions of Approval 1) The landscape plan shall be revised to include foundation landscaping in front of the building next to the new electrical box. These proposed modifications include the following: ■ Revised erosion control plan to depict erosion control for installation of a water line. ■ Regrading of the NW portion of the site to accommodate the installation of the Phase I storm drainage system and the Phase I water main extension. ■ Placement of crushed surfacing near the South 330`h Street driveway entrance to prevent erosion. ■ Stockpile areas adjacent to the water line and north of the building. As you are aware, the above information was submitted after the site had been regraded without City approval and after erosion control had been improperly placed as installation of the water main began. Indeed, this seems to be an ongoing problem in that you continue to perform work on the site and then present the City with revised plans to review. This is not how the development process is conducted and can lead to City enforcement action to stop remediate-unauthorized work. Based on site inspections and requested modifications, the following is provided: 1) The proposed silt fence along 131h Avenue South is approved. The silt fence must be located BEHIND the drip line of street trees planted on 13`h Avenue South and on private property. The silt fence must be installed per the detail provided on the revised erosion control plans. 2) The regrading of the NW portion of the site and stockpiling of soils is not approved under Phase I. This disturbed area must be restored to the previous condition, including elimination of the stockpiled soils. Following installation of the water line, the entire disturbed area must be immediately stabilized with a minimum of 2 inches of straw mulch. Permanent stabilization in the form of hydroseeding must occur no later than May 1, 2005. 3) The driveway entrance to South 330'" Street must be improved with asphalt. Crushed surfacing is not an acceptable alternative. 4) Grading has occurred within the South 330`h Street right-of-way without authorization. No further grading shall occur as part of Phase 1, and the areas that have been graded must be stabilized with erosion control measures. Slopes must be temporarily stabilized with either plastic or jute matting, Mr. Tishchuk January 14, 2005 Page 2 and flat areas must be immediately stabilized with two inches of straw mulch. Permanent stabilization in the form of hydroseeding must occur no later than May 1, 2005. 5) The City prohibited through -traffic on South 3301h Street with an environmental block and signs. These items have been moved and/or damaged by Church construction activities. The environmental block must be immediately put back in place. The "No Dumping" and "Road Closed Ahead" signs must be replaced. You are responsible for sign replacement costs of $186.00 payable to the City of Federal Way no later than February 1, 2005. No further "Phase II" grading, clearing, or construction activities may occur until Phase II plans have been formally submitted, reviewed, and approved, and required performance and maintenance bonding is in place. If you are found to be working on anything other than approved Phase 1 items, the City's Public Works inspectors will place a Stop Work Order on the entire project. The order will not be removed until Phase II plans are approved and bonding is in place. The applicant proposed to phase the church project, since Phase II work requires extensive capital outlay for right-of-way improvements. Based on the approved phasing, no occupancy of the phase II portions of the building was to be done under Phase I as stated in the following condition of land use approval: Prior to granting Certificate of Occupancy for Phase I for the church use, an agreement that demonstrates that access into the Phase II portions of the building will not be attempted by the property owner or any agents of the property owner unless approved in writing by the Director of Community shall be recorded at King County against the property at the expense of the owner. The agreement shall be inform acceptable to the City Attorney. The attached draft agreement has been prepared to address this condition. It has been reviewed by Greg Fewins and Kathy McClung. ADDITIONAL INFORMATION REQUESTED On March 30, 2004, the City received a plan labeled, "An Addition to the Church of Blessing" dated March 17, 2004, and an undated letter. The plan is of the Phase II' portion of the project and contains the following highlighted notes: * New second floor construction for Phase I. * Phase I development to include canopy. * Phase I development to include 9,598 square feet of existing building. * Phase I development to include 2"d floor structure with concrete finish. The undated letter identifies the following changes to the approved plans: * Second floor construction; specifically concrete decking in order to finish the restroom on the first floor without causing considerable damage when pouring the concrete deck in the future. * A 1, 029 square foot expansion of Phase Ito provide an access ramp to the stage. * Completed kitchen under Phase I. * Phase II entry canopy proposed in conjunction with windows and building modulation improvements under Phase I. According to the letter, the plan is intended to clarify Phase I construction that was previously approved and seek approval for additional construction under Phase I, which is currently under construction. 1 According to the Land Use Approval issued on May 23, 2003, Phase II consists of an 876 seat new sanctuary, kitchen, dining room, offices, nursery, and classrooms for up to 300 students for a K-12 school, with new building entries, parking lot expansion, and on and off site improvements. Second floor additions of 8,334 square feet for classrooms and sanctuary will lead to eventual 30,124 square feet of gross floor area. In order for staff to review the requests, the following bulleted information must be provided for each item: 1. New Second Floor Construction for Phase I — Phase I work is proposed within the Phase II portions of the building. The only work within the Phase I1 portions of the building that is approved under Phase I is installation of HVAC, fire sprinklers, second floor joists, and exterior wall modifications associated with the windows on the south elevation only. All other work on the second floor is to be done in Phase II, including classrooms, sanctuary, seating, hallways, restrooms, and access. In order to review this request for work on the second floor, specific information about the following is required: Depict and list all specific work proposed on the second floor under Phase I. List the exact square footage of the proposed work on the second floor under Phase I. State why this work is to be done under Phase I instead of Phase II. 2. Phase I Development to Include Canopy — The entrance canopy to the Phase II portion of the building is proposed to be constructed during Phase I improvements in conjunction with windows and building modulation improvements. The canopy is depicted on the Phase II site plan. The canopy columns have been approved to be installed within the interior parking lot landscaping proposed for this area under Phase I, and footings have been framed. In order to review this request for the Phase I1 canopy, provide the following information: ■ Depict the Phase II canopy on the revised Phase I site plan. ■ Submit a revised landscape plan for review and approval. • Depict the Phase I building entrances on the Phase I site plan. ■ State why this work is to be done under Phase I instead of Phase II. Phase I Development to Include 9,598 Square Feet of Existing Building — The May 23, 2003, site plan approval approves 8,569 square feet of work within the building under Phase I. The letter states that a 1,029 square feet gross floor area expansion is intended to provide an access ramp to the 729 square foot stage. Provide the following information about this additional square footage: List all specific work areas and proposed uses associated with the increase of Phase I floor area. List the exact square footage of these work areas and proposed uses. State why this work is to be done under Phase I instead of Phase 1I. 4. Phase I Development to Include Second Floor Structure with Concrete Finish — According to the letter, second floor construction including bearing walls at the first floor was approved with construction permits. The installation of concrete decking is requested in order to finish the first floor restroom without causing considerable damage when pouring the concrete deck in the future. Completed Kitchen — The letter proposes that the entire kitchen be completed under Phase I instead of Phase II. Provide information as follows: ■ A copy of the King County Health Department approval for the kitchen facility is required before construction permits can be issued as stated in the January 8, 2004, letter from Scott Sproul. • State why this work is to be done under Phase I instead of Phase II. 6. Value oflmprovements — As previously noted, Phase II work will create classrooms for a new K-12 school and relocate and expand the church sanctuary. The Phase II sanctuary requires the installation of the new parking lot to accommodate church attendees, while the school use will require loading areas and play areas for children. Right-of-way improvements need to be installed along South 330`h Street and 131h Place South during Phase Il work as required under Federal Way City Code (FWCC) Section 22-1473. According to the construction cost breakdown provided by the applicant submitted December 30, 2002, the total Phase I improvement value is $383,955.00, while Phase II work is calculated at $1,640,401.00. With the current request for site plan modification (see #7 below), please provide a revised construction cost breakdown that identifies proposed improvements and proposed costs to the project site based on the March 30, 2004, resubmittal. Staff will recalculate the value of improvements added to the project in accordance with FWCC Section 22-1473(a). Please be advised that tenant improvements that add additional floor area are to be counted as value-added pursuant to FWCC Section 22-1473(a)(5). 7. Site Plan Modification — The proposed work exceeds the work that was approved under Phase I and must be reviewed as a formal modification to the approved site plan and the May 23, 2003, land use decision. Please be advised that the information requested in this letter must be submitted before staff can authorize the modification request in accordance with FWCC Section 22-411. OTHER Building Division — Building Division staff have determined that work has been done at the site without benefit of building permit approval. This work may or may not have been depicted or proposed on the March 30, 2004, plans. A stop work order was posted at the site on January 23, 2004, for work identified in the January 23, 2004, inspection notice which states: 1. Provide plans including isometric drawings for all plumbing in Phase I to the City for review.2 No framing or plumbing is to be done anywhere inside the building until the stop work has been lifted. 4. Further incidents of this nature may result in further and more extensive stoppages, fines, or removal of offending material. Fire Department — The Federal Way Fire Marshal's office reports that as of March 18, 2004, required permits have not been obtained for installation of the underground supply for the sprinkler system as noted in the building permit and the sprinkler permit. As noted in the March 12, 2004, message from Chris Ingham, the applicant is in the process with Lakehaven Utility District for the supply up to the vault, but a separate permit is required from the vault to the building and the fire department connection (two pipes, one permit). In addition, the Fire Department notes that the approved fire alarm is only for a small portion of the church at the east end of the building and not the entire building. Fire alarm requirements apply to the additional areas developed under Phase 1. Additional permits may be required. Mechanical Screening — According to March 19, 2004, photographs, the mechanical screening does not adequately screen the mechanical units from the right-of-way as required under FWCC Section 22-946. King County Public Health Department — In response to your request, the contact at King County Environmental Health Department that was contacted regarding the health and safety review of the proposed school use was Larry French, 206-296-9805. SUMMARY The information requested above is necessary for the City to understand the change of the scope of the phased church project. The City issued the building permit based on the Phase I and II improvements as proposed by the applicant. The City has previously accommodated various requests to use the building for church services in advance of completed construction. The August letter requested a cross section be provided to show the effectiveness of vegetative screening along South 3301h and 131h Avenue South. Vegetative screening is proposed with a row of Otto Luyken Laurel shrubs planted at five-foot centers slightly below the parking lot according to the cross-section and the January landscape plans. This wide spacing does not provide for effective vehicular screening as required under FWCC Section 22-1567(e). Several options are to reduce the shrub planting distance to three-foot centers, plant larger shrubs, or plant additional shrubs in between the Otto Luyken Laurel. 4. Lawn is proposed west of the church building. Will it be a sod or seed lawn? If a seed lawn, provide appropriate seeding specifications. If all work is not completed by the established date, the Certificate of Occupancy would be revoked. 2. Street lights, planter strip, and curbing —For safety reasons, installation of the remaining street lights on 13'4 Avenue South, backfill, and finish grading of the planter strip on 13th Avenue South, and installation of the curbing around the perimeter of the parking lot must be completed prior to issuance of a Temporary Certificate of Occupancy. Phase Land II are to be completed within five years unless extensions to the land use decision are granted. Before the Planning Division can consider a temporary certificate of occupancy for the project, an extension request must be submitted for review, including a letter detailing how the criteria of FWRC 19.15.110(2)(b) through (2) (d) are met and an $80 review fee. 2) Scope of Occupancy — Please submit a written scope of work that clearly details the rooms that would be in use with a temporary certificate of occupancy, along with a list of their intended users. Landscape Plan Revision The land use decision dated May 23, 2003,1 reflected retention of five significant trees in the new parking lot landscape islands during Phase II of the Church of Blessing expansion_ This land use application was vested to the Federal Way City Code (FWCC) in effect in 2003. However, on May 6, 2010, Vince DeNapoli, project manager with Home Sewer Services, determined that the rock tree wells would not offer adequate protection to the five large trees and requested that the trees be removed in conjunction with site clearing actions. In support of the request, the City received revised civil plan page C2.1 dated May 12, 2010, which eliminated the rock wells, and a revised landscape plan L-1 (May 14, 2010), which shows four new trees and shrubs planted in place of the removed trees. The findings of approval from the original 2003 Church Expansion project noted that there were 36 trees that met the FWCC definition of a significant tree. Fourteen of these trees (or 39 percent) were to be removed with Phase II construction; five of the remaining significant trees were to be located in two new parking lot landscape islands. With these five trees removed, a total of 19 significant trees (or 52 percent of the 36 significant trees) are removed. The FWCC required that if more than 75 percent of the significant trees were removed, tree replacement would be required. In this case, only 52 percent of the significant trees are proposed for removal and tree replacement will not be required. Revised landscape plan L-1 and revised site plan C-3 are approved as modified. Forest Practices Permit - Under the Federal 6Vay Revised Code (FWRC), which superseded the FWCC, a Class IV Forest Practices Application must be submitted whenever more than 5,000 board feet of merchantable timber is harvested from an area or property. This is approximately equal to one log truck of timber. With the removal of the five additional trees, the amount of timber appears to have increased to require a Class IV Forest Practices permit. William Popp Associates Subject: Sight Distance at Proposed Site Access to 13th Ave S Re: Church of Blessing The purpose of this memo is to present findings regarding the City's request to evaluate the sight distance conditions at the proposed church site access to 131h Ave S as well as the road coming out of the park. An evaluation of Intersection Sight Distance (ISD) is included. The proposed church access to 13th Ave S would align directly opposite Celebration Park Rd. The existing conditions on 13th Ave S is a 36' wide roadway that includes one lane in each direction with a center two-way left turn lane. The roadway terminates approximately 100 feet south of park road. Celebration Park Road connects to 13t1' Ave S and is currently controlled by a stop sign at the intersection. With the completion of the project, 13'b Ave S will connect with S 330`h St. However, due to some topography constraints and right-of-way acquisition issues, the extension of 13th Ave S to S 3301h St involves a narrowing of the roadway along a tangent section, with one 65-degree curve with a 45-foot centerline radius. The curb -to -curb width is 36 feet on 13th Ave S through the Celebration Park Rd intersection and narrows to approximately 30 feet as it runs south to east and becomes S 330th St. An analysis of two opposing SU-30 vehicles through the curve indicates this width would be the minimum acceptable width. The roadway ultimately widens back to 36 feet. The analyses presented here are based on standards set forth in "A Policy on Geometric Design of Highways and Streets" 2004 (a.k.a. The Green Book), published by the American Association of State Highway and Transportation Officials (AASHTO). The sight distance requirement and are based on a posted speed limit of 25 mph for 13`h Ave S and S 330'h St. However, it is important to note that design speed through the 13t11 Ave S- S 330th St curve is calculated to be approximately 15 mph; based on Equation 3-9 and Exhibit 3-11 in AASHTO. In computing and measuring intersection sight distance, the height of the driver's eye is assumed to be 3.5 ft above grade where the entering vehicle sits, and the height of the object car to be seen by the driver is 3.5 ft. The location of the driver's eye is assumed to be 14.5 feet back from edge of the major -road traveled way. For this analysis, it is estimated the driver's eye height will be 3.9 feet above the centerline profile of 13th Ave S; the elevation point of the driveway at 14.5 feet back from edge of traveled way is estimated to be 4.4 feet greater than the 13th Ave S centerline elevation. This estimate is based on information from the civil engineer. The left turn out, and left turn in movements only have to cross one opposing lane of traffic, whereas the crossing movement has to cross more than two lanes. Therefore, the crossing movement time gap was adjusted from 6.5 seconds to 7.0 seconds. AASHTO suggests the minimum required ISD based on a posted speed limit of 25 mph for a left turn from stop should be 280 feet, 240 feet for a right turn from stop, 205 feet for a left turn from the major road, and 260 feet for a crossing movement. The available sight distance at the proposed driveway is shown in Table 2. From a profile perspective, the rockery will not be an issues however, if a vehicle were parked in that stall then the occupied parking stall would be the governing factor for the sight line. This line is shown from Point A to B on Attachment 1 as well as 2. The vehicle traversed distance from Point B back to the driveway at Point C is 246 feet. Given this measurement based on a 25 mph speed, the right turn out and left turn in conditions are adequate, the left turn out and crossing movements are not. The inadequacies lie in viewing to the south from the driveway. All sight lines to the north are presumed adequate. The ISD looking south is measured to be 246 feet. Keep in mind this is the approaching vehicle's traversed distance back to the driveway. The required minimum ISD for the left turn out movement is 280 feet. The required minimum ISD for the crossing maneuver is 260 feet. However, it is important to note that the design speed through the 13tk Ave S/S 330th St curve is calculated to be approximately 15 mph given the radius, therefore, using a design speed of 25 mph (which is the posted speed north of Celebration Park Rd) is probably an overly conservative design approach. Utilizing a design speed of 20 mph would result in a required minimum ISD for the left turn of 225 feet and a required minimum ISD for the crossing maneuver of 210 feet; both shown in Table 1. These values are notably less than measured distance of 246 feet. Other factors to consider in this case are: 1) given that there will be a church driveway to S 330th St, it is estimated that there will be very few if any vehicles turning left turn out of the subject driveway, and 2) the minimum safe stopping distance for a 25 mph design speed is 155 feet, which is clearly less than the 246 observed. Celebration Park Rd For the left -turn -out and crossing movements, the sight line to the south was measured from the park road keeping within the proposed roadway right-of-way. This line is shown from Point D to E on Attachment 1. The vehicle traversed distance from Point E back to the park road intersect at Point C' is 272 feet; which is only 8 feet shy of the minimum. However, if the sight line were extended across the church property cutting across the corner of the parking lot (Point D to E'), the traversed distance back would increased to 285 feet; Point E' to C'. All sight lines to the north are presumed adequate. As noted earlier, it is important to note that the design speed through the 13th Ave S/S 330th St curve is calculated to be approximately 15 mph given the radius, therefore, using a design speed of 25 mph (which is the posted speed north of Celebration Park Rd) is considered an overly conservative design approach. Utilizing a design speed of 20 mph would result in a required minimum ISD for the critical movement (left turn out) of 225 feet. This requirement is notably less than measured distance of 272 feet that is based on the sight line that stays within the right-of-way (Point D to E). Conclusions There are two road approach intersection sight distance conditions analyzed herein with the extension of 131h Ave S to S 330th St. The first is the church driveway and the second is the existing Celebration Park Rd. Church Driveway The Intersection Sight Distance (ISD) at this driveway is substandard for the left turn out and crossing movements based on a posted speed limit of 25 mph. However, the 13th Ave S/S 330th St roadway curve consists of a low speed 45-foot radius that would suggest a design speed of approximately 15 mph with standard 2% crown. Assuming a 20 mph design speed and utilizing this as the basis for the ISD at the church driveway, all entering and exiting movement ISD conditions are adequate. In order to alert the motorist to these conditions, it is recommended that appropriate curve arrows (W1-1) accompanied with warning speed signs (W13-1, 20 mph) be installed in advance of the proposed curve, for both approaches. In addition, a sight line easement should be defined between the driveway and the parking lot corner (13th Ave S stationing 4+00 to 5+60 approximately) in order to maintain adequate sight lines. Celebration Park Rd Based on the sight line from Point D to E', which cuts through the church property, all ISD conditions are adequate based on a 25 mph design speed. The resultant ISD distance would be 285 feet whereas the critical minimum ISD is 280 feet. The resultant ISD distance would be 272 feet whereas the critical minimum ISD is 225 feet. Thus, the available ISD would be more than adequate based on a 20 mph design speed.
