The following information addresses specific questions included in the request. In the interest of clarity, the questions are listed below in bold, with the city's response following. The current zoning classification for the subject properties are: Office Park (OP) Are the subject properties part of an Overlay District? This property is not part of an Overlay District. Adjacent property zoning designations: North: Office Park (OP) South: Office Park (OP) East: Commercial Enterprise (CE) West: Office Park (OP) Did the properties receive any variance; conditional or special permits issued or require site plan approval? According to our records, the property did not receive any variance or conditional/special permits. Uses of the properties and nonconformance: Pursuant to Federal Way Revised Zone (FWRC) 19.235.010, offices are allowed in the OP zone; whereas, warehouse/industrial uses are not allowed in the OP zone. If present on the properties, industrial/warehouse uses would legally nonconforming. If the development is found nonconforming at the time of casualty, then it would have to comply with FWRC 19.30.200, which states: Nis. Laura Beaver Page 2 of 2 April 5, 2019 "If a nonconforming use or development is damaged by sudden accidental cause, that use or development, including associated.improvements, may be reconstructed if it meets the following requirements: "(1) The use or development, including associated improvements, as reconstructed, is not any more nonconforming than it was immediately prior to the damage. "(2) The applicant applies for building and any land use permits to reconstruct the damaged improvement within six months of the date of the damage and reconstructs the improvement pursuant to such permits." If it is a conforming development, then the structure may be rebuilt according to code. Are there any outstanding zoning, building or fire code violations on file? There are no unresolved building, fire, or zoning code violations. Was a certificate of occupancy issued and if so, may we obtain a copy? If a certificate of occupancy was issued for this building, it will be with King County. Are there any current pending road projects that will require additional right of way from the properties? There are no current or penaig capital projccts on either South 336th Street or 91h Avenue South that will require additional right-of-way on file.
