The formal Process I application was submitted on December 15, 2010, with resubmitted information received on March 17, 2011. Zoning for the site is Office Park (OP). Office uses are permitted in the OP zoning district pursuant to Federal Way Revised Code (FWRC) 19.235.10 (Office/Retail). According to plans dated March 15, 2011, a 20KW generator is proposed to be placed inside a nine -foot - tall concrete three -sided enclosure located adjacent to the south side of the existing building. The building wall will serve as the fourth wall of the generator enclosure, and the enclosure will be painted to match the existing building. A gate on the west side of the enclosure will provide service access to the generator. The proposed location for the new generator currently contains ivy ground -cover. The ivy will be maintained outside of the generator installation following construction. The proposed location of the enclosure does not reduce required parking, landscaping, buffering, open space, or public areas; does not change the location of utilities or easements; maintains pedestrian connections; is consistent with the approved architectural design of the site; and creates no impacts to sensitive areas or tree canopy. Based on the City's review, the Process I application to install an enclosure for the new generator is administratively approved. This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this project site. The effective date of decision is April 3, 2011, or three days from the date of this letter. Pursuant to FWRC 19.55.050(1), any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by April 18, 2011 (14 days from the effective date of decision). In that you are the only party of record, you may waive your right to appeal by submitting a letter to this effect to the City of Federal Way, Department of Community and Economic Development. If you waive your right to appeal, you may begin work on April 4, 2011, PROVIDING you have obtained the Ms. Somppi wMarA31, 2011 Page 2 necessary building and electrical permits. Building permits for the wall (permit #10-105209-CO) and gcncrator (permit #11-100928-EL) are pending. Please submit updated information for these two permits so they reflect consistent information with this land use decision. The total Process I application fee is $302 (one hour at $80/hour and three additional hours at $74/hour). The application was formally submitted on December 15, 2010, and deemed complete on that date. ADDITIONAL INFORMATION REQUESTED Additional information as discussed below is required before a land use decision can be issued. Generator Location The subject property is zoned Office Park (OP). Office uses are permitted in this zone pursuant to Federal way Revised Code (FWRC) 19.235.10 (Office/Retail). Development standards for the office uses include required side yard setbacks of 20 feet. The generator and a six -foot -tall three -sided CMU wall are proposed to be located in the side yard setback between the existing office building and South 336`h Street.' Under FWRC 19.125.160, only specific features can intrude into a required yard. The proposed wall and generator exceed the intent of the permitted required yard intrusions and cannot be permitted in the setback unless they meet code as discussed below. However, it appears that there are other locations for the generator and wall as discussed below: (1) Generator and wall in the set back: In order to approve the generator and wall in the setback as depicted on the site plan, the generator and wall cannot extend more than 18 inches above finished grade and can extend no more than five feet into a required yard pursuant to FWRC 19.125.160(3). If this is proposed, please provide a cross section that shows how the generator and wall will be no taller than 18 inches above finished grade, revise the site plan to show that the generator and wall are no more than five feet into the required yard setback, and identify any shoring and footings necessary. (2) Generator and wall in the parking lot: Based on FWRC 19.235.10, 29 parking stalls are required for an 8,640 square -foot office building. There are 37 parking stalls available on this property according to the site plan submitted with the Process I application. As there is an excess of parking, the wall and generator can be located in the parking lot. Revise the site plan to depict the generator and wall located in the parking lot, and revise the total parking stall count. January 14, 2011 Page 2 (3) Generator and wall south of the building: According to the Fire Marshal's office, the Fire Code does not regulate the self-contained diesel generator. Further, they are not dictating a setback from the building wall. Therefore, it appears that there are other locations to place the generator and wall that are not located in a required yard, such as immediately south of the office building at the drive aisle or the triangular area off the parking lot. Revise the site plan to depict the generator and any required screening south of the office building. Variance Under FWRC 19.45, the City may grant a variance to the FWRC only if it finds that all of the criteria for granting a variance [FWRC 19.45.030(1) through (4)] are met. The Federal Way Hearing Examiner conducts the public hearing and issues the decision on the variance request. Given that there are several potential locations for locating the generator, it is unclear how the variance criteria are met. Variance fees are $3,961.50, and variance requests require review under Process IV Hearing Examiner. Chain Link Fencing If utilized within the OP zone, chain link fences that are visible from the public right-of-way or adjacent properties, and not screened by Type I landscaping, shall utilize vinyl coated mesh, powder coated poles, dark colors, and architectural elements per FWRC 19.115.090(2)(d). Any revised plans should reflect this requirement. South King Fire and Rescue, Chris Ingham, 253-946-7244 According to South King Fire, the generator has a diesel belly tank. South King Fire will require that the generator meet the minimum clearances as specified by the manufacturer. The cut sheets e-mailed to the City did not have this information. Also, a 5' x 5' NFPA 704 placard that identifies the hazard for the fuel source shall be located on all sides of the enclosure. Fire review will be required if an auxiliary external tank is proposed. Building Department, Scott Sproul, 253-835-2633 The electrical permit issued on December 29, 2010, under permit #10-105403-00-EL, did not include the required electrical review. Please provide electrical plans that comply with the enclosed electrical review handout. The building permit for the screening wall over four feet in height, permit # 10-105209-CO, is pending. See also the changes in location and construction of the enclosure provided here along with the Engineer's packet for the details, specifications and stamp for the slab and retaining wall of the enclosure. The overall site locations and details with photos are shown on both Sheets T1.0 and Sheet A1.0 for the change in location to the Southeast adjacency of the building as shown. The elevations for the enclosure and the section provided by the Engineer are located on Sheet A1.0.
