On November 30, 2016, the City of Federal Way's Department of Community Development received
your zoning inquiry regarding Fountain Plaza I and 11 at 501 and 505 S 336th Street, Federal Way,
Washington; Parcels 4926480-0280, 926480-0240 and 926480-0270. The following information
addresses specific questions included in the request. In the interest in clarity, the questions are listed
below in bold, with the city's response following.
1. The zoning designation of the property.
Parcels #926480-0280, 926480-0240 and 926480-0270 current zoning designations are (OP)
Office Park.
2. Whether or not the Property has been cited with a notice of violation of any applicable
zoning codes or building codes, or complaints related thereto.
According to the city's database, the subject property has not been cited with a notice of violation
of any applicable zoning codes or building codes, or complaints related thereto at this time.
3. Whether the Property complies with the zoning codes and building codes, including all
building setback requirements, lot size, lot coverage and parking requirements, maximum
allowable density, and all applicable subdivision laws.
No site plan approval is available as this property was developed prior to Federal Way's
incorporation under the authority of King County. The most efficient means of attaining this
documentation would be to direct your requests to. the King County Department of Permitting and
Environmental Review (DPER) Records Center at 206-296-6696.
4. Whether the current use is a permitted use.
The current use is an outright permitted use per Federal Way Revised Code 19.235.010.
5. That if any building located on the Property is in any way damaged or destroyed, that it
may be reconstructed in its entirety, and upon such reconstruction may be again operated
as previously operated prior to such damage or destruction.
Nonconformance analysis has not been conducted. If after such analysis the structure located on
the subject property was determined to be nonconforming, Federal Way Revised Cocle (FWRC)
19.30.200 would apply:

19.30.200 Special provision for damaged improvements.
If a nonconforming use or development is damaged by sudden accidental cause, that use
or development, including associated improvements, may be reconstructed if it meets the
following requirements:
(1) The use or development, including associated improvements, as reconstructed, is not
any more nonconforming than it was immediately prior to the damage.
(2) The applicant applies for building and any land use permits to reconstruct the
damaged improvement within six months of the date of the damage and reconstructs the
improvement pursuant to such pen -nits.
6. The certificate number for the last certificate of occupancy issued for the Property, whether
it has been amended, and whether it remains in full force and effect.
The City of Federal Way requires a (PDA) or Public Records Request regarding any Certificates
Of Occupancy issued by the City of Federal Way. Furthermore, please be advised that any
Certificates of Occupancy that may have been issued prior to the incorporation of the City of
Federal Way will need to be requested and processed through the King County Department of
Permitting and Environmental Review (DPER) Records Center at 206-296-6696 for city records.

We are a potential purchaser of the property referenced above (the "Property"). In connection
with this transaction, we are investigating zoning and land use matters, and request your confirmation
of the following information:
1. The zoning designation of the Property;
2. Whether or not the Property has been cited with a notice of violation of any applicable
zoning codes or building codes, or complaints related thereto;
3. Whether the Property complies with the zoning codes and building codes, including all
building setback requirements, lot size, lot coverage and parking requirements, maximum
allowable density, and all applicable subdivision laws;
4. Whether the current use is a permitted use;
5. That if any building located on the Property is in any way damaged or destroyed, that it
may be reconstructed in its entirety, and upon such reconstruction may be again operated

the formula for determining the required number of parking spaces and density bonuses, if applicable;
and copies of any conditional use permits/ variances/ PUD approvals issued in connection with
construction of the improvements located on the Property.
