The proposed modifications consist of the replacement of nine (9) antennas and the addition of associated ancillary equipment. The Process I application was submitted January 29, 2014. Your proposal is found to be consistent with provisions of Federal Way Revised Code (FWRC) Chapter 19.55, `Process I — Director's Approval', and Chapter 19.255, `Personal Wireless Services Facilities.' Your Process I proposal is hereby approved. FINDINGS The Process I land use approval is supported by the following statement of facts: 1. Zoning & Land Use —The zoning designation for the subject property is Multi -Family Residential (RM 3600). PWSFs are permitted in the RM 3600 zone pursuant to FWRC 19.205.200. 2. Review Process — According to submitted materials, the applicant proposes to replace nine existing panel antennas with nine upgraded panel antennas. Of the proposed replacement antennas, six will be 6'3" in height and three will be 8' in height. In addition, the following ancillary equipment has been proposed: remote radio units, a tower mounted amplifier, and surge protectors. The new additions to the existing PWSF are subject to Process I Director's Approval pursuant to FWRC 19.15.030(1) "Minor improvements." 3. Development Standards — Pursuant to FWRC 19.255.020(1)(a)(i), PWSFs located on an existing structure shall meet the definition of a microcell or a minor facility. According to FWRC 19.05.130, the proposed modifications to the existing monotower exceed the maximum threshold for size and number of antennas. As a result, the upgraded antenna array could not be classified as a minor facility or microcell. However, pursuant to FWRC 19.255.020(1)(a)(ii), if the following conditions are met the proposed PWSF may be allowed: `A PWSF that exceeds the minor facility thresholds for number of antennas, dimensions, and/or area, but creates no more adverse impacts than a minor facility, as determined by the director of community development services, subject to meeting all of the following standards: (A) The facility shall not create substantially more adverse visual impact than a minor facility; and Ms. Telschow February 20, 2014 Page 2 (B) The equipment cabinet for the PWSF shall meet all requirements of subsection (4) of this section; and (C) The maximum size of the PWSF panels and number of antennas shall be determined by the director of community development services, based on the specific project location, surrounding environment, and potential visual impacts; and (D) The PWSF shall comply with all other applicable standards of the Federal Way Revised Code.' The proposed replacement antennas are taller and wider than some of the existing antennas. However, the proposed modifications create no more adverse impacts than a minor facility. The, visual effect of the size difference between existing and proposed antennas is negligible. Three of the existing antennas on the array are approximately the same size as the largest of the replacement antennas. The antenna array is located at the top of a 120' monopole that is already screened by nearby trees. Filially; the applicant has indicated that the new antennas will be painted to match the existing structure. For these reasons, the proposed modifications satisfy all development standards. 4. Cumulative Effects — The City must consider the cumulative visual effects of PWSFs mounted on existing structures and/or located on a given permitted site in determining whether additional permits may be granted so as to not adversely affect the visual character of the City. As shown on the site plan, the replacement of the nine antennas and additional ancillary equipment are not a substantial increase to the existing site. The site has heavy tree coverage and natural screening elements. The applicant has also proposed to paint the antennas to match the existing utility pole so the PWSF will not adversely affect the visual character of the City. 5. State Environmental Policy Act (SEPA) — The project is exempt from SEPA review as it meets the exemptions of WAC 197-11-800(3), as it is a minor repair/maintenance activity of an existing facility; no additional antennas are to be added. 6. Additional Permits — A separate electrical permit will be required. Please contact a Development Specialist at 253-835-2607 if you have questions regarding the electrical permit application process. 7. Process I Thresholds — The proposed improvements do not reduce required parking, landscaping, buffering, open space, or public areas; do not change the location of utilities or easements; and create no impacts to sensitive areas or significant trees. Since there are additions and improvements to a developed site, it is subject to Process I Land Use Review. CLOSING This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this site. This Process I approval does not constitute approval of an electrical permit. The effective date of this decision is February 23, 2014, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who received notice of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by March 9, 2014. Any appeal must be in the form of a letter delivered to the Department of Community and Economic Development with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision. Verizon Wireless's proposed modification meets all of the above standards. Existing Use The property has existing telecommunication facilities. FCC Time Period Guidelines On November 18, 2009, the FCC issued a Declaratory Ruling (FCC-09-99A1) that created periods of time under the Telecommunications Act (TCA) in which zoning authorities must act upon siting applications filed by wireless carriers or be in violation of die TCA. Specifically, the timelines are as follows: ninety (90) days for co -locations and one hundred fifty (150) days for all other sites including new towers. Please see the FCC Declaratory Ruling 09-99A1 for more detailed information. Federal Requirements Verizon's telecommunication facility will meet or exceed current standards and regulations of the FAA, the FCC, and any other agency of the Federal government with the authority to regulate towers and antennas. Verizon's site will conform to all FAA/FCC regulations, and because die maximum ERP is less than two thousand (2,000) watts and/or the height of the facility is greater than ten meters (10m), an environmental evaluation of radio frequency emissions is exempted per CFR Title 47 Part 24, Subpart E.
