We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and Federal Way Fire Department. Some sections of the Federal Way City Code (FWCC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION Proposal to collocate a new, Clearwire personal wireless service facility (PWSF) on an existing American tower, including antennae and ground -equipment support cabinet. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. PWSF Review Process — Pursuant to FWCC Chapter 22, Article XIII, Division 1, Section 22- 967(10), "Development Standards," PWSF applications are administratively processed using the appropriate permit process as outlined in the use zone charts (Article XI of this chapter, "District Regulations"). This proposal is located in RM 3600 (multi -family residential) zone; the application will be processed through a Use Process III. Once the PWSF application -is deemed complete, public notice of the complete proposal is required, followed by a 14-day public comment period. At the conclusion of the staff review process, recommendations are forwarded to the Director of Community Development Services, who then issues a written decision, which is also followed by a 14-day public comment period. No public hearing is required unless there is an appeal of the director's decision. I have enclosed a land -use application, copy of the FWCC related to PWSFs, and other relevant code sections. 2. Use Process Fees — The fee associated with a PWSF reviewed under Use Process III is $2,071.50. A check for the full amount of the fees must accompany the application at the time of submittal. Fees are subject to change annually. 3. Critical Areas - This project does not appear to be affected by any critical areas as defined by the FWCC. A formal review of the status of this project relative to critical areas will be completed at the time a for :ial application is submitted. 4. State Environmental Policy Act (SEPA) — The proposed PWSF appears to be exempt from SEPA review because it does not appear to be in a critical area and is by definition a microcell, which is to be attached to an existing structure that is not a residence or school and does not contain a residence or a school. A formal review and verification of the status of this project relative to SEPA review will be completed at the time a formal application is submitted. If SEPA review is required, there is an additional fee of $832.50. Fees are subject to change annually. Nonconformance Thresholds — This project does not appear meet any of the conditions outlined in FWCC Section 22-334 that would require the applicant to rectify existing nonconformances. 6. PWSF Development Requirements —City code requires a minimum five feet of Type III landscaping to screen the fenced, ground -equipment enclosure. You can verify existing screening with photos of the ground -equipment enclosure. 7. Prioritized Locations —Pursuant to FWCC Section 22-966, PWSF sites must be considered in priority order. In your application, please include a feasibility study for locating in a higher priority location; the BPA Trail in this case, and indicate why the higher priority location is not being proposed. 8. Development Standards — Building or structure mounted PWSF outside the public right -of --way must meet certain development standards. I have enclosed a copy of the relevant FWCC section. 9. Pursuant to FWCC Section 22-967, "Development Standards," ground equipment locations must be considered in priority order. In your application, please include a feasibility study for locating ground equipment in the existing equipment shelter at this location and indicate why the higher priority location is not being proposed.
