Dear Ms. Ausink:
The Community and Economic Development Department bas completed administrative land use review
of the proposed Personal Wireless Service Facility (PWSF) improvements located at 2041 South 324`h
Street, Federal Way. The applicant proposes to add three new LTE antennas and six remote radio heads to
an American Tower 120-foot monopole; no additional height is to be added. The proposal also includes
ground equipment upgrades within the existing fenced -in equipment shelter area.
The Process III Master Land Use (MLU) application submitted March 30, 2012, is hereby approved
based on the enclosed findings of fact, incorporated into this decision in full, and the following
conclusions based on those facts:
1. The proposal is consistent with the comprehensive plan;
2. The proposal is consistent with all applicable provisions of Federal Way Revised Code (FWRC);
3. The proposal is consistent with the public health, safety, and welfare;
4. The streets and utilities in the area of the subject property are adequate to serve the anticipated
demand from the proposal;
5. The proposed access to the subject property is at the optimal location and configuration; and
6. Traffic safety impacts for all modes of transportation, both on and off site, are adequately
mitigated.
The remainder of this letter outlines the land use review process required for this particular site
improvement; summarizes the State Environmental Policy Act (SEPA) process; and provides other
procedural information. This land use decision does not authorize initiation of construction activities.
REVIEW PROCESSES REQUMED
Pursuant to FWRC 19.15.030(3), improvements and/or additions to an existing developed site that are not
exempt from SEPA shall be processed under Use Process III. The Director of Community and Economic
Development will make the initial land use decision based on written comments and information gathered
during site plan review. Any appeals of the decision will be decided by the Hearing Examiner after a
public hearing.
SEPA PROCESS
The City of Federal Way issued a Determination of Nonsignificance (DNS) on May 15, 2012, pursuant to
Washington Administrative Code 197-11-350. Following review of the environmental checklist, the city

determined the proposal would not have a probable significant adverse impact on the environment, and an
Environmental Impact Statement would not be required, and no SEPA based mitigation was necessary.
CONDITIONS OF APPROVAL
The following condition of approval is a component of this land use decision:
■ Prior to any site work, the applicant shall obtain an electrical permit from the city's Department of
Community and Economic Development. For further information regarding electrical permits, please
contact the department's permit center at 253-835-2607.
REQUESTS FOR CHANGE OF VALUATION
Any affected property owners may request a change in valuation for property tax purposes, not
withstanding any program of revaluation.
APPROVAL DURATION
Unless modified or appealed, the Process III decision is valid for five years from the date of issuance of
the decision. Time extensions to the decision may be requested prior to the lapse of approval following
the provisions listed in FWRC 19.15.110.
APPEALS
The effective date of issuance is three calendar days following the date of this letter, or June 8, 2012.
Pursuant to FWRC 19.65.120, this land use decision may be appealed by any person who submitted
written comments or any person who has specifically requested a copy of the decision. Any appeal must
be in the form of a letter delivered to the Community and Economic Development Department with the
established fee and within 14 days after the effective date of issuance of this decision, or June 22, 2012.
The appeal letter must contain a clear reference to the matter being appealed and a statement of the factual
findings and conclusion of the Director disputed by the person filing the appeal. The Federal .Way
Hearing Examiner will hear any appeals of the Process III decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development.

Federal Way Revised Code (FWRC) Chapter 19.65 `Process III Project Approval'

The Planning Division hereby presents the following analysis to the Director of Community and Economic
Development pursuant to content requirements of the Process III written decision as set forth in Federal Way
Revised Code (FWRC) 19.65.100(4).
1. Proposal — The applicant proposes to modify an existing Personal Wireless Service Facility (PWSF) by
adding three new LTE antennas and six remote radio heads to an American Tower 120-foot monopole;
no additional height is to be added. The proposal also includes ground equipment upgrades within the
existing fenced -in equipment shelter area. The proposed modification is part of AT&T's network
implementation plan to provide 4G LTE coverage in the Federal Way area to better serve customers.
2. Site Conditions — The PWSF is located on an existing 120-foot monopole and the ground equipment is
to be located in an existing fenced area at 2101 South 324`h Street, Federal Way.
Comprehensive Plan and Zoning — The City's Comprehensive Plan designation is Multi -family and
the zoning is Multi -family Residential (RM3600). PWSFs are permitted in the RM zone pursuant to
FWRC 19.205.200.
4. Review Process — The replacement and addition of antennas to the existing PWSF is not exempt from
State Environmental Policy Act (SEPA) review and is subject to Process III `Project Approval' review.
State Environmental Policy Act (SEPA) — The proposal is not exempt from environmental review
pursuant to Washington Administrative Code 197-11-800(25)(a)(iii). The city utilized the Optional DNS
process as allowed by SEPA Rules. A combined Notice of Application and Optional Determination of
Nonsignificance was issued April 20, 2012. No comments were received during the integrated comment
period. The city's Responsible Official issued a Determination of Nonsignificance May 15, 2012. The
threshold determination appeal period ended May 29, 2012, with no appeals submitted to the Federal
Way City Clerk.
Public Notice — Pursuant to Process III and SEPA regulations, a Notice of Land Use Application and
Optional DNS were published in the Federal Way Mirror, posted at two locations at the subject site,
and displayed on the designated city notice boards on April 20, 2012. Notices were also mailed to
property owners within 300 feet of the subject property. No comments were received on the land use
application or SEPA DNS notice.
7. Prioritized Locations — The applicant proposes to locate the PWSF on "Existing broadcast, relay and
transmission towers," which is the second priority location of the five prescribed in FWRC
19.255.010(4). Higher prioritized location, Structures located in the BPA trail, is not feasible as this
proposal is an upgrade to an existing facility. There are no alternative BPA towers in the proposed
vicinity. Staff finds the applicant has met the burden to utilize the second prioritized location. The
addition of three LTE antennas should provide the full benefit of service to the area.
8. PWSF Development Standards — PWSFs located on existing structures shall meet development
standards prescribed in FWRC 19.255.020(1). The following are staff responses to each criterion:
a. (ii) The PWSF exceeds the minor facility thresholds for number of antennas and size, but creates
no more adverse impacts than a minor facility. Based on site photos and detailed drawings, the
proposed addition will be installed in the same manner as the previously approved antennas and
the visual impact will be unchanged.
b. The combined antennas will not exceed 15 feet above the existing structure. The monopole is 120
feet tall; the new antenna will be placed below the existing array; no additional height is proposed.
C. This section does not apply as the proposed PWSF is not in a right-of-way.
d. The proposed antennas will be painted to match existing tower. The impacts to surrounding uses
will be no greater than the existing facility.
e. The proposed size and number of the PWSF is necessary to meet coverage objectives as depicted
in the project narrative provided by applicant.
f. The proposed ground equipment will be added to an existing fenced lease area. The footprint of
the facility will not be enlarged and will meet the setback requirements originally approved in
2004.
9. Screening Standards — PWSFs are required to be screened using best available technology and design.
The proposed antennas will be screened and painted to match the existing antennas. These measures
appropriately mitigate visual impacts of the facility, cause no adverse cumulative effects, and meet
aesthetic standards set forth in FWRC 19.255.020(1)(d).
10. Electronics Equipment Standards — Applicant proposes to upgrade the existing equipment enclosure
with ancillary equipment. Proposed upgrades will occur within enclosure and no material expansions or
changes to the architectural design of the enclosure are proposed. Therefore, these changes are exempt
from PWSF standards set forth in FWRC Chapter 19.255 and are permitted outright with no further
regulatory action required pursuant to FWRC 19.255.010(3)(g).
11. Security Screening — The PWSF includes existing structure and fencing; no new fencing or
expansion of existing fencing is proposed.
12. Cumulative Effects — The city must consider the cumulative visual effects of the PWSF mounted on
an existing structure in determining whether additional permits may be granted so as to not adversely
affect the visual character of the city. Based on the plans and photo -simulations of the proposed
modifications, the PWSF will not adversely affect the visual character of the city. The additional
antennas will be camouflaged through best available technology and design and will have less of an
impact than creating a new PWSF site.
13. Conditions of Approval — The following conditions of approval shall be a component of the
Process III land use decision:
• Prior to any site work, the applicant shall obtain an electrical permit from the city's Department
of Community and Economic Development.
14. Process III Decision Criteria — Based on the above findings, staff has determined the proposal is
consistent with applicable site plan approval criteria required for Process III `Project Approval'
pursuant to the following FWRC 19.65.100(2) items. Staff responses (italicized) follow each
criterion:
a. It is consistent with the comprehensive plan;

timely service that meets the needs of the city s residents and businesses, both
present and future.
PUG2 — Work with private utility companies to allow them to provide service in
a way that balances cost-effectiveness with environmental protection, aesthetic
impact, public safety, and public health.
PUPI 7 — The city should require that site specific utility facilities such as
antennas and substations be reasonably and appropriately sited and screened to
mitigate adverse aesthetic impacts.
b. It is consistent with all applicable provisions of this title;
The site plan has been reviewed under FWRC Title 19, "Zoning and Development
Code, " with specific attention to the following divisions and/or chapters: Division I,
Administration; Chapter 19.65, Process III Project Approval, Chapter 19.200, Single
Family Residential (RS); and Chapter 19.255, Personal Wireless Service Facilities.
c. It is consistent with the public health, safety, and welfare;
No adverse impacts are anticipated as a result of the proposal. The PWSF has received
approval from Lakehaven Utility District. The Process Ill ML U application has been
reviewed under SEPA, FWCP, and applicable provisions of the FWRC.
d. The streets and utilities in the area of the subject property are adequate to serve the
anticipated demand from the proposal;
The city's Traffic Division has determined the PWSF will not require concurrency
review and will not adversely affect the current level of service. The Lakehaven Utility
District has determined no sewer or water improvements are required for the PWSF.
e. The proposed access to the subject property is at the optimal location and configuration;
The facility is an existing site and no changes are proposed to the access points to the
facility.
f. Traffic safety impacts for all modes of transportation, both on or offsite, are adequately
mitigated.
As the facility is unmanned, this criterion is not applicable.
These findings shall not waive compliance with future City of Federal Way codes, policies, and standards
relating to this development.

NOTICE OF COMPLETE APPLICATION
Please consider this letter as a Notice of Complete Application. Pursuant to the FWRC, the application is
deemed complete as of April 16, 2012, based on a review of your submittal relative to those requirements as set
out in the Development Requirements checklist. The submittal requirements are not intended to determine if an
application conforms to the City of Federal Way codes; they are used only to determine if all required materials
have been submitted.
Having met the submittal requirements, a Notice of Application and Optional Environmental Determination of
Nonsignificance (DNS) will be published in the Federal Way Mirror and posted at the subject property and on
the City's official notice boards within 14 days of this letter. Notification will also be mailed to persons
receiving property tax statements for property within 300 feet of the subject property.

Dear Sir or Madam,
Enclosed please find an the Master Land Use Application and eight (8) sets of drawings for a proposed
AT&T modification to an existing wireless site located at 2101 South 324th Street.
The proposed modification consists of adding (3) new LTE antennas, (6) remote radio heads, ancillary
equipment to the existing wireless facility located at the above referenced address. No height increase
proposed. Proposed modifications do not change the use of the existing tower. There is no reduction,
material change or adverse impact to landscaping, parking, utilities, approved architectural design, or
environmentally critical areas as defined by FWRC 19.145.
ANALYSIS OF STEALTH SCREENING FOR PROPOSED FACILITY PER FWRC 19.225.020[4
The modification will not result in a change in visual impact, and is part of a technology upgrade being
performed on AT&T/New Cingular Wireless's network, in order to improve service to its customers and
strengthen reliability and capacity in its network. No height increase is proposed.
Pursuant to FWRC 19.255.020(20, PWSFs shall be screened or camouflaged through employing the best
available technology and design. As proposed, the antennas are not overtly obtrusive. The proposed
antennas will be painted to match the existing.
The proposed equipment additions are exempt and no review is required as there are no material area
expansion of the equipment area. Per the pre -application conference summary (#12-100538-00-PC), the
submitted site plans do not need to depict existing landscaping around the existing enclosures.
This is an existing wireless telecommunications facility located at the address referenced above. AT&T
proposes to amend the facility to keep up with the demand while continuing to offer customers in the area
quality service and access to greater and more advanced wireless services. The proposed change would
add 4G technology to the site and would expand AT&T's 4G network footprint into and the immediate
surrounding area. This proposed change would improve the on -street and in -car availability of 4G
services (voice and data support for iPhone 4G phones for example) and would add in -building 4G
services in the immediate vicinity of the site. Our current volume and payload data on this site shows a
high amount of 3G data traffic. The new 4G technology will improve the overall internet/data experience
of the customers in the area. This will mean faster data rate and higher efficiency. The proposed
modification is part of an integrated network and if it is located too far or too close to an adjacent facility
the network will not work. u
The location of the site was picked because it is an existing facility. The proposed modification is part of o
AT&T's network implementation plan to provide 4G LTE coverage in the Federal Way area. The 3
proposed installation of the antennas/ancillary equipment is intended to operate using the xistin basit�

building a completely new site, thus doubling the presence of wireless facilities within the same quarter
mile area. There are no alternative sites that would provide the needed height to allow for the proper
functioning of the equipment. There are no multifamily, commercial, or industrial structures tall enough to
meet the required height coverage for this site. Alternative sites that would provide the needed height
coverage would mean that AT&T would need to propose a new wireless tower or utilization of a city light
pole and locate its antennas on it or locate on a new multifamily structure and increase its height — these
proposals would aesthetically be more detrimental to the neighborhood.
A new facility would not be less intrusive than what is being proposed. The proposed location not only will
provide the needed coverage for AT&T it will also lead to fewer adverse impacts on adjacent land uses.
Here, collocating the replacing the antennas contains the impacts of the additional antennas to a single
location, thus impacting fewer properties. In addition, utilizing the existing equipment lease area and
ground equipment further reduces impacts to other properties in the area by avoiding duplicate ground
installations at multiple locations, eliminating the need for extensive trenching between the existing
ground equipment and alternative locations.
In addition, the proposed facility is a passive use; there are no activities that will produce airborne
emissions, odor, vibration, heat, glare, or noxious/toxic materials.
The site will operate continually, 24 hours a day for seven days a week. The site will be unmanned,
requiring only frequent visits by maintenance personnel, typically once a month. Due to the limited
amount of traffic generated by the proposal, no off -site street improvements are required for this
application. The facility will not require water or wastewater facilities or contribute to erosion due to storm
water run-off.
The construction valuation is $15,000.
The above statements are true and complete to the best of my knowledge. I understand City of Federal
Way is relying on them to make its decision.

THIRD AMENDMENT TO AGREEMENT
This Third Amendment (the "Third Amendment") to that certain Schedule Tower Space License
for Modified Sites dated February 1, 2006 by and between American Towers, Inc. and New Cingular
Wireless PCS, LLC, as amended by that certain First Amendment to Schedule Tower Space License for
Modified Sites dated September 30, 2009, as amended by that certain Second Amendment to Schedule
Tower Space License for Modified Sites dated June 25, 2010 (as amended, the "Agreement'), is made
and entered into as of the latter signature date hereof, by and between American Tower Delaware
Corporation, a Delaware corporation, as successor -in -interest to the Agreement C Licensor' and New
Cingular Wireless PCS, LLC, a Delaware limited liability company ("Licensee").
RECITALS
WHEREAS, Licensee desires to modify its equipment and/or ground space at the Tower Facility
described below.
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein and
other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the
parties hereby agree as follows:
1. Tower Facility. The Agreement being amended by this Third Amendment is for the
Tower Facility identified below:

2. Modification To Equipment. Notwithstanding anything to the contrary in the Agreement,
Licensee's current permitted equipment configuration and ground space under the Agreement is hereby
-modified to be as set forth on Exhibit C-3 attached hereto.
3. License Fee. The increase to the License Fee applicable to this Third Amendment i,
per month, payment of which has previously been
arranged by Licensor and Licensee.
4. Right of First Refusal. Licensor hereby represents that, on or before the date of the full
execution of this Third Amendment, a Right of First Refusal applicable to the Tower Facility by
AirTouch Communications, Inc. or its affiliates has either lapsed or was not exercised.
5. Required NTP Information. A copy of the plans and specifications for the proposed
equipment installation, together with certain information regarding Licensee's contractors and work
schedule, are attached hereto as Attachment 1. (If applicable)
6. Full Force and Effect. All terms and conditions set forth in the Agreement shall continue
in full force and effect unless specifically modified herein.
- 7. Capitalized Terms. Capitalized terms contained herein, unless otherwise defined, are
intended to have the same meaning and effect as set forth in the Agreement.

PURPOSE OF CHECKLIST
The State Environmental Policy Act (SEPA), Revised Code of Washington (RCW) Chapter 43.21 C,
requires all governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for all proposals with probable
significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide
information to help you and the agency identify impacts from your proposal (and to reduce or avoid
impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about our proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your proposal
are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise
information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you
should be able to answer the questions from your own observations or project plans without the need to
hire experts. If you do not know the answer, or if a question does not apply to your proposal, write "do not
know" or "does not apply." Complete answers to questions now may avoid unnecessary delays later.
