Dear Mr. Ellingson:
City Staff has reviewed your request for Administrative Decision to remove trees and brush from your
property. This letter serves as a response to that request and outlines the existing regulatory framework
and information to help you accomplish your timber harvesting and development goals. Per a submitted
memo prepared by Manke Lumber Company, Inc., there is an estimated 40,000 board feet of
merchantable timber on the property that you would like to remove. In order to remove the 40,000 board
feet of timber, you need approval of the following: 1) a Clearing and Grading/Tree Retention plan; 2)
Class IV — General Forest Practices; and 3) land development or building permit. Without such approvals,
you may only remove up to 5,000 board feet of merchantable timber from your property.
It is my understanding that you discussed the Forest Practices Application (FPA) process with
Department of Natural Resource (DNR) staff, but have not yet submitted to them the FPA for approval.
Based on the conversation you had with DNR, you were required to obtain approval of a Conversion
Option Harvest Plan (COHP) by the City before forest practices would be approved by DNR. City staff
contacted DNR for clarification and was provided different information. We were informed that DNR
will not issue Forest Practices approval since the regulatory authority for forest practices has been
transferred to the City and the ownership of contiguous forest land is less than twenty acres; per RCW
76.09.240. The City cannot approve a COHP as there is no regulatory framework/development code in
place to support such aq approval.
The removal of 40,000 board feet of merchantable timber requires Class IV — General FPA approval by
the City. According to Chapter 19.120 of the Federal Way Revised Code (FWRC), Clearing, Grading,
and Tree and Vegetation Retention and Chapter 76.09 RCW, a Class IV —General FPA must be
submitted to the City whenever more than 5,000 board feet of merchantable timber is harvested from a
property. A Class IV — General Application shall be reviewed by the City based on an approved clearing
and grading plan and tree and vegetation retention plan per FWRC 19.120.200.
Pursuant to FWRC 19.120.020(4)(b), proposed clearing, grading, and/or tree and vegetation removal
activities that are not associated with a proposed building or land development activity, may be approved
through a Use Process III. The proposed removal of trees from your property for firewood and logging
purposes does not meet the criteria for approval because it is not necessary to correct an erosion or
drainage problem, it is not necessary to create new utility or access corridors, and no unusual
circumstance exists which make it reasonable to permit the activity in advance of a land development or
building permit. Per FWRC 19.120.020(4)(a), you will need to submit and receive approval of a building

permit or land development in order to be issued a clearing and grading or tree retention permit and Class
IV- General FPA. In other words, to remove the proposed amount of timber, it must be done in the
context of a development.
Absent a building or land development pennit, you are still authorized to remove a limited number of
trees, but no more than 5,000 board feet of merchantable timber, pursuant to FWRC 19.120.030(9),
Exemptions. Trees and vegetation removal actions conducted on a residential lot that contains a detached
dwelling unit together with any contiguous lot under the same ownership that are being maintained for the
use and enjoyment of the homeowner must comply with the following criteria:
a) Any trees or vegetation removed must be outside any area that is within the jurisdiction of
Chapter 19.145 FWRC [Environmentally Critical Areas].
b) No trees or vegetation will be removed if that vegetation was required to be retained by or
through any development pen -nit issued under this chapter or any prior zoning code.
c) Tree and vegetation removal will not change the points where the stormwater or groundwater
enters or exits the subject property and will not change the quality, or velocity of stormwater or
groundwater.
d) Trees with a diameter at breast height (dbh) of up to six inches and vegetation may be removed
without city review and approval if criteria (9)(a) through (c) of this section [listed above] are
met.
e) Trees with a dbh of six inches or greater may be removed subject to the minimum tree units per
acre standard established by Table 19.120.130-1 and subject to criteria (9)(a) through (c) of this
section [listed above].
f) Removal of trees with a dbh of six inches or greater that will result in the subject property falling
below the minimum tree units per acre standard per Table 19.120.130-1 shall require planting of
replacement trees as necessary to meet the minimum tree units per acre standard, or the existing
tree units per acre represented by the trees proposed for removal, whichever is less.
g) Hazard trees and nuisance vegetation may be removed without city review and approval if criteria
(9)(a) through (c) of this section [listed above] are met.
Because drainage plans were not submitted to the City, staff cannot verify that tree removal will not
change the point storm water or groundwater enters or exits the site, or that it will not change the quality
or velocity of stormwater and groundwater as listed in item (c), above.
Any tree removal on the site may also require Full Drainage Review, per the 2016 King County Szoface
Water Design Manual (KCSWDM), if 7,000 square feet or more of land disturbing activity is proposed.
The applicant must demonstrate compliance with requirements outlined in the 2016 KCSWDM. A
drainage report stamped and signed by a licensed civil engineer must be provided. The drainage report
will be reviewed as part of an Engineering Approval. Plans will be required showing, at a minimum,
temporary and pennanent erosion control and site restoration.
In response to the letter that was read during the July 5, 2016, City Council Citizen Comments, the reason
that developers can remove trees is that a development application was submitted to the City which
included a clearing and grading plan reviewed and approved by staff. The trees are then removed prior to
construction of the approved development project.
In summary, you are authorized to remove trees from the subject property if you meet the exemptions in
FWRC 19.120.030 and remove less than 5,000 board feet of merchantable timber. To remove 40,000
board feet of merchantable timber you need to submit a land development proposal or building permit

application for review and approval, which includes a clearing and grading and/or tree retention plan and
Class -IV General FPA, to the City. The Class IV — General FPA would not be approved until the building

On March 20, 1 decided to develop my 4 pieces of property on 376t" St. & Milton
Road. I have 13 acres. I talked to Becky Chapin and she gave me the paperwork to
fill out to leave 25 trees per acre. I counted all trees and marked 86 trees to leave
like she asked me to. I waited for 7 weeks with no permission. After 2 months
she told me Federal Way has no ordinance to remove trees. She turned the
paperwork over to Isaac he told me he would have an answer in a week. I went
back 8 days later. He said 2 more days. 3 days later he told me he had no
ordinance to cover tree cutting so he turned it over to the Cities Attorneys. The
City Attorneys had the paperwork for two weeks and the outcome was a call from
Isaac stating I could not take the trees down. At that point Isaac told me he was
quitting two days later.
Three months I am back to square one. I already have a permit approved by the
Dept. of Natural Resources. Maybe if the city does not have an ordinance for the
tree removal they should accept the One from DNR.
it seems funny that big developers can take trees down but a private person can't.
It is only 8 truckloads of trees.

Hi Mark,
I'm hoping you can provide some guidance on an issue regarding forest practices. This is an unusual circumstance so it's never come
up before so Isaac wanted me to run it past you.
I'm working with a property owner who is requesting to remove 40,000 board feet of timber from his property. He owns four adjacent
properties and two have homes on them. He is looking to sell the timber now and at a later date potentially sell the properties to a
developer for a future subdivision. He is still uncertain about his development plans but wants to move forward with logging his
property.
The City assumed jurisdiction over the review and approval of Class IV -General Forest Practices in 2009 see FWRC Chapter 19.120
Article IV. Typically a Class IV - General Permit is required when more than 5,000 board feet of merchantable timber is harvested from
developed land. The City will process a Class IV- General Permit with applicable building or land development permit. However, there
is no development action associated with logging at this time so no Class IV -General Permit.
Instead, per discussion with the Department of Natural Resources, in this instance, DNR issues a Class III permit for homeowners to
log their land. As part of the Class III permit the applicant must either provide a Ten Year Forest Management Plan or Conversion
Optional Harvest Plan (COHP). DNR provided the attached document for the Ten Year Forest Management Plan, however, it won't
work in this situation because the landowner wants to develop the property in the next year or two. The other option is for the applicant
to submit a COHP approved by the City. We do not have language in our codes to directly address COHP requirements but there is
state law.
Per WAC 222-20-051 - Conversion option harvest plans.
(1) For Class II, III, and IV -special forest practices, if a landowner wishes to maintain the option to convert forest land
to a use other than commercial timber operations, the landowner may request the appropriate local governmental
entity to approve a conversion option harvest plan.
(2) If a local governmental entity approves a plan, the landowner must attach it to the forest practices application or
notification.
(3) The plan will be a condition of the approved application or notification.
(4) Violation of the plan will result in the development prohibitions or the conditions described in RCW 76.09.460.
(5) Reforestation requirements will not be waived regardless of the existence of a conversion option harvest plan.
King County has information regarding COHPs and handouts - King County CDHP websit_e. The question is, can we use something
similar to KC requirements or do we need language in our code to review/approve a COHP?
