Dear Mr. Hsiao:
This letter responds to your request to waive the required street improvements associated with the
proposed, future, development of the above -referenced property. After evaluating your request and
review of Federal Way Revised Code (FWRC) provisions (Section 19.135.070), the Public Works
Department provides the following response to each of your requests:
24th Ave S:
The applicant is requesting to waive construction of street improvements within this currently
undeveloped City right-of-way.
24th Ave S is classified as a Minor Collector, corresponding to City Standard Street Section
`R', which requires a 40-foot paved roadway, 4-foot planter strips, 6-foot sidewalks, and a a-
foot utility strip within a 66-f6ot right of way.
Application of the required street improvements would result in an improved street section
within the undeveloped right of way that isn't warranted with the development of one single-
family home on the lot, especially since the applicant is not proposing to gain access off of this
street.
Therefore, the Public Works Department hereby approves your request to waive the requirements
for the street improvements, with the following conditions:
• The owner will be required to dedicate 3-feet of property for additional City right of way
along this frontage in order to provide the necessary width should development of this
street take place in the future. The dedication shall occur prior to the final sign -off of any
future building permit;
• Should the owner develop the property, there can be no direct vehicular access to 24th
Ave S.

S 330th St is also classified as a Minor Collector, corresponding to City Standard Street
Section `R', which requires a 40-foot paved roadway, 4-foot planter strips, 6-foot sidewalks,
and a 3-foot utility strip within a 66-foot right of way.
The existing street improvements along this property frontage generally consist of a 22-foot
wide roadway with 2-foot gravel shoulders, and a 3-foot (+/-) deep ditch.
Approximately 140-feet to the west of this site, there is a section of 330th that consists of a
34-foot roadway, with curb and gutter and a 5-foot wide sidewalk adjacent to the back of
curb.
FWRC Section 19.135.070; Modifications of Improvements Along Property Frontage allows
the Public Works Director to grant a request to modify, defer, or waive the required street
improvements.
Since there are existing improvements to the west of your site, the Public Works Department
hereby denies your request to waive the required street improvements, and will require the
following modified street section be constructed with development of the property:
C The developer will be required to constmet street improvements along the property
frontage to match those currently installed approximately 140-feet west of your site (and
identified above), i.e., widen the pavement by approximately 9-feet, and construct curb
and gutter and a 5-foot wide sidewalk adjacent to the back of the curb.
• Dedicate 3-feet of property for additional City right of way along this frontage in order to
provide the necessary width should this street get developed to the City's standards in the
future. The dedication shall occur prior to the final sign -off of any future building permit;
The conditions of this letter will be applicable for a period of one year from the date of this letter. If a
land use approval or building permit is not issued within the one-year time limit, this waiver will be void,
and a new request for modification must be submitted.

Approximately 140-feet to the west of this site, there is a section of 330th that consists of a 34-
foot roadway, with curb and gutter and a 5-foot wide sidewalk adjacent to the back of curb.
The subject property is approximately 3-feet below the grade of existing road/right of ways.
Requirements / Conditions of Approval With input from Traffic Division, Development
Services staff recommends the following:
S 330th St: Deny the request to waive all improvements, and instead recommend modifying
the required improvements to match that of the existing improvements that lie
west of this site, i.e., widen the pavement (approximately 18-feet from centerline),
aligning the new curb -line with the existing, and construct a 5-foot wide sidewalk
behind the curb (eliminating the planter strip), and require the additional 3-feet of
right of way dedication. By eliminating the planter strip, we reduce intrusions into
the stream and wetland buffers and help reduce the limitations of construction due
to the topographic difference between the roadway and property.

Hi, My name is David Hsiao. My house hold is currently on the process of building a
Single -Family house in Federal Way, Washington. The Parcel number of the property we
will be working on is 797880-0581. (File#18-100896-00-PC) We would like to request a
Waiver for the Right -Of -Way Improvement for our single-family house building
proj ect.
First of all, since there is no side walk on S 3301 Street, also due to the reason that we
are the last property on the street, and constructions would not help the Federal Way City's
improvement. Not only the constructions would not offer any improvement, but also can
cause trip hazard. Which means that constructions would be unnecessary.
Since our drive way is on S 330'i' Street, which is unnecessary to build a Road and
improve the 241 Ave South, since the back area is the mobile house communily with the
back blocked off. Unless the mobile house community is planning on a huge upgrade, which
the mobile house community would not and does not have any upgrade within the six years.
It would be unnecessary for us to upgrade the road. Also, sidewalk can cause trip hazard.
Therefore, for all those reasons above, we are requesting the Waiver for the Right -Of -
Way improvement.

This letter replies to your April 1 e-mail requesting an extension of time on the City's previous (April 30,
2018) right of way modification response letter.
After reviewing your request, it's been determined that the Public Works Department will grant a 1 (one)
year extension of time, and the new expiration date on your request is now April 30, 2020.
Please note that if you do not apply to the City for the Use Process III (UP3) to establish reasonable use
on the property before April 30, 2020, this time extension will be void and a new request for street
modification must be submitted.

Kevin,
Yes, my phone message to Marwan Salloum was following up on this and a few other questions. I came across Mr.
Salloum's name and contact information from email correspondence he had with Lillian Hsiao in May of this year. Mr.
Salloum's email response to Ms. Hsiao noted that the Federal Way City Council has directed a change in policy which
requires the installation of curb, gutter and sidewalks "whenever possible." As such, this triggered the required street
improvements fronting the Hsiao parcel as part of their proposal to construct a single-family residence on their property.
it's agreed that requiring street improvements for typical projects without existing curb, gutter and sidewalks is good
practice as it benefits both the general public and the City. However, it is also assumed that requiring such street
improvements is done on a case -by -case basis. With that being said and after reviewing the existing site conditions along
S. 330F" St. and 241" Ave S., including the rural residential character of the area, vehicular traffic volume/local use of
streets, existing and potential future pedestrian linkages, and adjacent critical areas (stream, wetlands and associated
buffers), it's not clear as to why street improvements are being required for this single-family residential project for the
following reasons:
The proposed street widening (approx. 9 feet), curb/gutter/sidewalk (5.5 feet), 2% shoulder from back of
sidewalk (2 feet), and embankment/fill at 2:1 slope to match existing grades (approx. 10 to 11 feet) will
significantly encroach upon and impact the stream corridor, wetlands and their buffers on the north side of S.
330'h St. Minimum area of impact: approx. 3,000 sq ft. (not including the area being proposed for the single-
family residential structure and its driveway connection to S. 330`h St.). Most of the impacted area is within city
right-of-way. As I questioned earlier, who is responsible for the mitigation of the impacted critical areas due to
construction of the required street improvements?
2. Who is responsible for stormwater collection, control and treatment from the added impervious and pollution

3. It's assumed that a transition/taper from the widened street fronting the Hsiao parcel to the existing roadway
will be needed at the west end of the Hsiao parcel. Correct? Or is there some sort of traffic barrier installed
here? If a transition/taper is required it will impact additional stream and wetland buffer areas. 5=- s 25= SO
4. The required sidewalk improvements end at the SW corner of the parcel. Is it expected that pedestrians will
continue westbound along the edge of the transition/taper to existing conditions? Are ADA ramps required at
each end of the new section of isolated sidewalk? tie-(2 S Aw? 3, c) tv
5. A vehicle traveling northbound on 24" Ave S. and negotiating the westbound turn onto S. 330`' will experience a
widened roadway for approx. 135 feet and then throated back down to existing roadway. This introduces an odd
roadway configuration within the street corridor and could pose a significant vehicular and/or pedestrian safety
issue.
The above were the topics i wanted to discuss with Mr. Salloum but, as you've noted below, he's forwarded my
voicemail message I left him to you. I fully understand the rationale for requiring street improvements, but am struggling
with the overall low public benefit of requiring such for the Hsiao's project when considering the significant impacts to
the adjacent critical areas (function, vegetation and habitat) and other potential safety issues associated the limited
roadway widening and transitions.

Hi Matt,
We spoke last week about street improvements as part of the development of the Hsiao property.
I'm still looking into the question of whether or not `additional' mitigation is required for the intrusions into the wetland
and stream buffer for street improvements (above and beyond what's required to build a single-family home).
I will send that info along, once I have answers.
I was also asked by the Public Works Director to contact you in regard to a phone message you left with him. I'm just
wondering if that message was in reference to what we've been discussing, or was there another question you had?
