Subject
The size, frequency, and duration allowed for residential garage/yard sales.
Interpreted Code Section
Federal Way Revised Code (FWRC) 19.275.O40(1)(c)(ii)(a), exempts residential garage or yard sales of typical
size and duration from the need to obtain a temporary use permit. The code section; however, does not define,
"typical size or duration."
Interpretation
■ Typical size means that the sale takes place entirely on the subject property (or joint properties if a joint sale).
• Typical duration means not more than four (4) garage sales within a calendar year, not more than two (2)
in one (1) month, and each instance may not exceed four (4) days.
Discussion
The intent of the language in FWRC 19.275.04O(1)(c)(ii)(a) is to clarify that garage (and yard) sales are not
treated as business activities, provided they are of a traditional, residential -compatible scale, and frequency/
duration. When garage sales exceed this traditional scale, the activity crosses the line into business activity. In
several instances, summer -time garage sales within the city have been occurring with such frequency that they
cross the line of, "typical size or duration' for an accessory residential activity and are therefore, considered to
be business activities. Certain business activities are allowed as home occupations in the city, but garage sales
do not meet the approval criteria for home occupations and thus are not allowed. Notice also that garage sales
are accessory to residential uses. Therefore, a garage sale may not be conducted on property that is not the
residence of the person(s) conducting the garage sale.
The code does not define the point at which a garage sale transitions to a business activity. Therefore, it is
necessary to interpret the parameters of, "typical size and duration."
The numbers established in the interpretation (4 sales/year, 2 sales/month, and 4 days/event) are based on a
reasonableness test. Four (4) garage sales per year is more than generous and is in keeping with the traditional
ability to conduct occasional residential garage sales. It is hard to imagine it would be necessary to hold more
than four (4) sales in a year for the purpose of disposing of regular household items. If the items are collected/
gathered for the specific purpose of sale on a continual basis, such activity crosses the line into business activity
and is not allowed as a residential accessory use. Similarly, the restriction to no more than two (2) per month
recognizes that typically it will not be necessary to hold multiple sales in close proximity as household sale
items will not accumulate that quickly. The allowance of four (4) days per occurrence recognizes that a resident
may wish to begin a sale on a Friday, go through the weekend, and extend to an additional day in the case of a
holiday weekend. The provisions adopted in this interpretation are similar to those adopted by other local
jurisdictions (our interpretation tends to be slightly less restrictive overall).

Criteria
Pursuant to FWRC 19.50.040(2), the Director shall base an interpretation on:
(a) The defined or common meaning, as applicable, of the words in the provision;
Response: The words are used in their common meaning in the interpretation.
(b) The general purpose of the provision as expressed in the provision; and
Response: The statement that introduces those activities exempt from the requirement to obtain a
temporary use permit states the activities shall be exempt, "...if generally consistent with their
surroundings." This language establishes the intent, which is that garage sales operate at a scale, duration,
and frequency that does not interfere with the primary residential use of the area. The interpretation is
consistent with the general purpose of the provision.
(c) The logical or likely meaning of the provision viewed in relation to the comprehensive plan, the FWRC
as a whole, or other plans or studies prepared or adopted by the city.
Response: The following Federal Way Comprehensive Plan goals and policies are relevant.
LUG3 Preserve and protect Federal Way's single-family neighborhoods
LUP14 Maintain and protect the character of existing and future single-family
neighborhoods through strict enforcement of the city's land use regulations.
LUP15 Protect residential areas from impacts of adjacent non-residential uses.
The interpretation is fully consistent with the above goal and policies. Such an interpretation is
necessary to protect residents from the undue impacts (including noise, traffic congestion, and
parking congestion) associated with continual or overly frequent garage sale activity, which is a
business activity rather than a residential accessory activity.
The interpretation is also consistent with the overall purpose of the FWRC, which is to promote and
protect the general health, safety, and welfare of the citizens of Federal Way.
Conclusion
This interpretation is necessary to clarify an ambiguous provision of the zoning code, is necessary to protect
residents from undue impacts associated with inappropriate commercial activity in residential neighborhoods,
and is supported by the criteria for interpretation.

We do not allow perpetual garage sales in our jurisdiction. We do have a portion of our Home Occupation
regulations 03MC 19.17.090.6.D) that relates to garage sale length:
D. Garage sales, yard sales, temporary home boutiques or bazaars for handcrafted items, parties for display of domestic
products, and other such wes are not subject to the regulations of this section, provided that any such Ave does not
exceed three (3) days in duration and does not operate more than nine (9) days in a calendar year. [Ord. 355 51, 2002]
Garage sales can never be considered a home occupation under our code because they do not meet the definition
of allowed home occupation retail sales found in BMC 19.17.090.5.E:
E. Retail Sales. Retail sales shall be limited to items produced on -site or incidental sales of items associated with a service
provided by the home occupation.
The only other avenue available in our code would be a temporary use permit, but we have never had a
perpetual garage sale request that. Hope this helps. Chip

I am once again conducting some research for our Planning Manager here in Federal Way and was hoping we could get
some further inter -governmental assistance. This time we are interested in what we would consider perpetual garage
sales. Please feel free to forward these questions along to your staff.
In particular we are interested in knowing:
1. Do you have codes, policies or interpretations that address the length of time/days a garage sale is permitted?
2. Do you have any codes that address garage sales at all?
3. At what point would you consider perpetual garage sales as 'home occupationsT
A little background about this question. A complaint came from a resident against their neighbor who is having a garage
sale almost every weekend and that a U-Haul truck brings in new inventory to sell each time. Typical garage sales do not
meet our definition of 'home occupation/ but a temporary or conditional use permit could be considered. We are
simply curious how other jurisdictions have addressed this issues, if at all.

Hi Kenneth,
Jennifer Henning asked me to respond to your email. Renton's home occupation regulations do not permit retail sales at
all (unless the items for sale are made at the residence) so we do not consider these sales under our home occupation
rules. Instead, we deal with this issue solely through our garage sale regulations which areas follows:
4-4-050 GARAGE SALES - REQUIREMENTS FOR:
A. APPLICABILITY:
A garage sale which does not comply with the following conditions shall be considered a business and must be brought
into compliance with all requirements for business uses, including compliance with the Zoning Code.
B. CONDITIONS:
Conditions for garage sales shall include
1. Maximum Time and Number: Incidental garage sales consisting of no more than one such sale per calendar quarter,
and no more. than three (3) within the same calendar year and with no such sale continuing for more than two (2) days.
2. Supervision of Vehicles Required: Garage sales shall be supervised and are the responsibility of the occupant or the
tenant who occupies the dwelling unit. This person shall not permit vehicles to impede the passage of traffic on any roads
or streets in the area of the person's property.
3. Use of Right -of -Way Prohibited: Goods are not to be displayed in public rights -of -way.
4. Signage Installation and Removal Requirements: Signs advertising such sales shall not be attached to any public
structures, signs or traffic control devices or utility poles.
Signs may only be placed on property owned by the person conducting the sale or on property where an owner gives
consent to post such sign. All such signs shall be removed twenty four (24) hours after the sale is completed.
5. Special Restriction for Self Storage Uses in RM-F Zone: No garage, yard, or estate sales are allowed from leased
storage units. (Ord. 4736, 8-24-1998)
C. VIOLATIONS OF THIS SECTION AND PENALTIES:
Any person in violation of this Section shall be informed in writing of the violation and shall be given fourteen (14) days to
comply with this Section. Following this action, if a subsequent garage sale is conducted in violation of this Section, each
day the sale is conducted shall be considered a separate violation and shall be subject to the following penalty.
Any person conducting any "garage sale" as defined herein in RMC 4-11-070 without being properly licensed therefor or
who shall violate any of the other terms and regulations of this Section shall be guilty of a misdemeanor subject to RMC 1-
3-1.

15.17.030 Sales Exempt from Regulation
Garage sales, yard sales, bake sales, temporary home boutiques or bazaars for handcrafted items, parties for the
display of domestic products, and other like uses shall not be considered home occupations subject to regulation
pursuant to SMC 15.17.020; provided, that any such use shall not be in existence for more than twenty (20)
days in any one (1) calendar year, and shall not be in violation of any other chapter in this code, or City
ordinance; and provided further, that any such garage sales and yard sales involve only the sale of household
goods, none of which were purchased for the purpose of resale. (Ord. 92-1041 § 1)
15.16.089 Garage and Yard Sale Signs
Garage sales, yard sales, and other exempt sales as allowed by SMC 15.17.030 shall be allowed the following
signage limited to display on Fridays, Saturdays and Sundays. All signs shall comply with the "sight distance"
requirements of SMC 15.13.100.
A. On -Premises Signs. Garage sales, yard sales, and other exempt sales shall be allowed the on -site temporary
signage not exceeding eight (8) square feet in surface area, or six (6) feet in height.
B. Off -Premises Signs. Garage sales, yard sales, and other exempt sales shall be allowed display of three (3)
off -premises portable signs; provided, that such signs shall not exceed four (4) square feet in area nor two (2)
feet in height, shall be displayed only from dawn to dusk on the days of the sale, and shall be removed promptly
after the close of the sale.
Off -premises garage sale signs may be located on private property with the permission of the owner of the
property on which the sign is placed and within the public right-of-way; provided, that the signs do not
encroach into a driveway, parking area, sidewalk, pedestrian pathway, vehicular travel lane, median or traffic
island, and is at least four (4) feet from the outer pavement edge of a roadway when curb and gutter are not
present. No signs shall be posted, tacked, nailed or in any manner affixed upon any utility pole, tree or public or
private sign. (Ord. 02-1023 § 1)

1. Do you have codes, policies or interpretations that address the length of time/days a garage sale is permitted?
2. Do you have any codes that address garage sales at all?
3. At what point would you consider perpetual garage sales as 'home occupationsT
A little background about this question. A complaint came from a resident against their neighbor who is having a garage
sale almost every weekend and that a U-Haul truck brings in new inventory to sell each time. Typical garage sales do not
meet our definition of 'home occupation,' but a temporary or conditional use permit could be considered. We are
simply curious how other jurisdictions have addressed this issues, if at all.
