Dear Mr. Onishchenko:
The Department of Community Development has completed their review of the enclosed Accessory
Dwelling Unit (ADU) application submitted to the city on June 10, 2019. The ADU application is hereby
approved pursuant to the findings presented by the department's Planning Division staff and the conclusions
based on those findings.
FINDINGS OF FACT
The following findings are based on site, elevation, and floor plans received with the land use application and
resubmitted information received September 20, 2019:
1. Proposal— The applicant proposes to construct a 792 square -foot detached ADU accessory to a 2,418
square -foot two-story single-family residence, located on parcel 0121039163, lot B of Boundary Line
Adjustment file number 15-106557-AU, AFN 201609299000.
2. Zoning The lot is 18,516 square -Feet (0.43-acre) within the Single -Family Residential (RS) 15.0 zoning
district. The proposal meets the minimum lot size requirement per Federal Way Revised Code (F`vVRC)
19.200.180, Note 1.
3. Lot Coverage —The lot coverage of the principal dwelling, proposed ADU, and driveway is approximately
50 percent of the lot area. The proposal does not exceed the maximum lot coverage of 60 percent in the
RS 7.2 zone pursuant to FWRC 19.200.180, Note 2.
4. Floor Plan —The total ADU laving area is 792 square feet. The principal dwelling unit contains 2,418
square feet of livable area; therefore, the proposed ADU complies with the maximum allowable livable
area, which is 40 percent of the living area in the primary dwelling unit. The proposal also will not exceed
the maximum accessory dwelling unit size of 800 square feet (FWRC 19.200.180, Note 9).

5. Water dam' Sever— The applicant proposes to serve the ADU with public water and sewer managed by the
Lakehaven Water and Sewer District. Lakehaven issued Certificates of Water and Sewer Availability on
November 15, 2016, and indicated the proposal will connect to an existing eight -inch sewer main and a
10-inch water main that is located 40 feet from the site. These service connections and meters must be
large enough to service the new single-family residence and accessory dwelling unit.
6. Required Yards & Height— The proposed attached ADU and associated improvements must meet the
required 20-foot front yard, and five-foot side and rear yard setbacks.
7. Owner Occupancy — The applicant must submit a signed letter of application and deed restriction stating the
owner shall occupy one of the two dwelling units as a permanent residence for six months or more per
calendar year.
CONCLUSIONS
The following conclusions are based on the above findings of fact.
1. The proposal is consistent with policies of the Federal Way Co�nprehenrive Plan.
2. The proposal meets density, square footage, parking, occupancy, and dimensional requirements of the
ADU Use Zone Chart within FWRC 19.200.180.
3. The ADU is designed to be subordinate and incidental in size, scale, and design of the primary dwelling
unit, and the appearance remains that of a single-family residence.
CONDITION OF APPROVAL
1. The ADU, excluding garage, workshop, and similar non -living areas, shall contain between 300-800
square feet, but shall not exceed 40 percent of the square feet of the primary dwelling unit, excluding
garage, workshop, and similar non -living areas. The unit shall have no more than two bedrooms.
2. Prior to the final building inspection of the new ADU, please record the enclosed Letter of Application
& Deed Restriction with the King County Recorder's Office, and return a copy to my attention with the
enclosed resubmittal form.

1. The single-family home and ADU will require a building permit prior to construction. Please contact the

Mr. Onishchenko;
Per your letter to me on October 1, 2019 and your request to exempt ADUs from school impact fees, I
regret that we cannot do so at this time regardless that no children will live in the units.
FWRC 19.95.060 originally exempted ADU for a one-year period between 1995 and 1996. The "time
clause ("December 21, 1995, and terminating on December 20, 1996") still exists within the Code and we
are obligated to enforce that. We are, at this time, in the process of examining this requirement and
potentially removing the clause.
I am sorry that I cannot provide any more relief from this obligation at this time, but the Code will not
allow it.

I would like to request the City of Federal Way to waive the school impact fee on the
ADU. The ADU will not be occupied with children at any time. The family will live in the

will be paid).
