Please consider this correspondence a formal Letter of Complete Application. Pursuant to Federal Way
Revised Code (FWRC) 18.30.050, the application is deemed complete as of August 31, 2018. The complete
application determination is based on a review of your submittal relative to those requirements as set forth in
FWRC 18.30.030. The submittal requirements are not intended to determine if an application conforms to the
City of Federal Way codes; they are used only to determine if all required materials have been submitted.
Having met the submittal requirements, a Notice of Application (NOA) will be published in the Federal Way
Mirror and posted on the city's official notice boards within 14 days of this letter. The applicant is responsible
for posting one notice board on site. The notice board will be available for pick up at City Hall will call on
September 10, 2018, and must be installed by Friday, September 14, 2018.

for the Short Subdivision of two parcels to create five new parcels. Pursuant to Federal Way Revised
Code (FWRC) i 8-30.050, within 28 days of receiving an application, the city shall determine whether all
information and documentation required fora complete application has been submitted.
NOTICE OF INCOMPLETE APPLICATION
Please consider this correspondence a formal Notice. of Incomplete Application. The Short Subdivision
application is deemed incomplete as of December 20,2016. The incomplete application determination is
based on a review Of your submittal relative to those requirements as set forth in FWRC 18.30.030. The
submittal requirements are not intended to determine if an application conforms to the City of Federal
Way codes; they are used only to determine if all required materials have been submitted.
Per FWRC 18-30.30, "All short subdivision applications must at the minimum provide the information
contained within City of Federal Way Department of Community Development Services Bulletin No.
010, Short Subdivision Submittal Requirements." In order for your application to be considered complete
and ready for processing, the items below must be provided:
A statement explaining how open space shall be provided. For a conventional short subdivision,
open space in the amount Of 15 percent of the gross land area of the subdivision site is required to
be provided. If the city determines that the location, quality, or extent of the required open space
would not fulfill the intent or purpose of useful common open space, a payment of an equivalent
fee -in -lieu of the required project open space shall be paid pursuant to FWRC 18.55.060(2).

Staff Respoijse — No open space is shown on the proposed plat, nor is an explanatory statement
provided. Please either shore the required open space or provide a written request if you would
prefer to pay a fee in Iieu of Open space.
2. Short Subdivision Drawing: Indication of perimeter boundary, lot, and right-of-way lines with a
notation of bearings or azimuth from the north, distances, and curve data. (Subdivision Submittal
Requirements, page 5.)
Staff Response — The perimeter boundary lot line includes a portion of parcel #614360-0617,
which is part of a separate proposed short plat to the south. The complete parcel boundaries of the

entire acreage in question must be shown. if it is your intention to transfer ownership of the
panhandle portion of the parcel, then city approval of a Boundary Line Adjustment (BLA) is
required through a separate application. Please see the enclosed BLA requirements and Master
Land Use application form. Revisions to the short plat are needed or a full subdivision application
will be required, as both projects have a parcel in common.
PRELIMINARY TECHNICAL COMMENTS
Since the application is incomplete, a technical review nF the proposal has not been conducted. ar
complete technical review of the application will occur after the missing items identified above are
submitted.
A preliminary review has determined the following.
1. The proposed road improvements do not address comments provided by the City Traffic Engineer
in the preapplication meeting summary letter dated July 24, 2015. Further plan modifications may
be required to accommodate the required road improvements.
2. Additionally, the plat submitted lists Pamela Millard as an owner of property to be subdivided,
yet her name is not listed in the title report provided.
Any resubtnittals for this application must be accompanied with a resubmittal fortis (enclosed). After
receipt of the requested information noted in the incomplete application seetion of this letter; the
department will notify you within 14 days whether your appIicatioll is considered complete for
processing, or what, if any. information is still needed. The review clock for processing your formal
application will not begin until all items are submitted.
Pursuant to FWRC 18.05.080, all items identified above must be submitted to the City within 180 days or
the application is void.

Short Plat application. City departments have provided the following comments that will need to be
addressed prior to preliminary approval of your application, or as otherwise noted. Questions regarding the

1. Content & Form of Application — Please provide the following applicable items as identified in Bulletin #010
and content requirements of Federal lay Revised Code (FWRC) 18.30.030 on the short plat document:
• Comprehensive plan and zoning classification of adjoining properties.
• Adjacent ownerships and the land or lot divisions of adjoining properties not in common ownership,
for a distance of at least 100 feet around the perimeter of the property. A separate list of names may
be used for clarification purposes.
• Acreage dedicated for public rights -of -way, as well as private tracts, alleys, and ingress/egress and
utilities easement created for the purpose of providing access to lots within subdivisions.
• Calculation of the net plat area, which is gross plat area minus critical areas, right-of-way, private
open space, and public purpose lands (tracts).
2. Building Footprints — Remove the proposed building footprint outlines from each lot.
3. Required Yard Setbacks —Lot land Lot 2 are considered panhandle/flag lots. Refer to FWRC 19.05.160,
`Property Line " (enclosed) for how required yards are applied for flag lots.
4. Opens Space — It does not appear that the 15 percent open space will be provided on site. A fee -in -lieu
payment may be made to satisfy open space requirements at the discretion of the Parks Director. The fee
in lieu of open space shall be calculated on 15 pment of the most recent assessed Value of the property
and paid prior to recording the short subdivision. A written request to Parks Director John Hutton must
be submitted if the open space shall be paid as a fee -in -lieu, pursuant to FVVRC 18.55.060(2).

5. Tree Retention — Pursuant to FWRC 19.120.130(1), all single-family zoned sites are required to maintain at
least 25 tree -units per acre. The total number of tree units required to be provided is calculated by
multiplying gross site acreage, minus any proposed public or private streets. This can be met via
preserving onsite trees (preferably) and/or planting new trees. A tree unit is a credit assigned to existing
and replacement trees based on their size and species, respectively. Please provide a tree retention plan
that includes the tree unit c-alculattoh,for the site and how the tree unit standards will be met.

Short Plat Drawing
1. The title block is an older version. Please use the city's current short plat title block (available by
contacting me at kevin.peterson@cityoffederalway.com).
2. Add the city file number in the space provided in the upper left-hand corner.
3. Vertical datum shall be NGVD-29.
4. 'the proposed lot lines and right-of-way lines shall be solid lines. Existing lot lines can be dashed.
5. Use a larger font for the interior lot dimensions (bearings and distances).
6. Provide a physical description and a date visited for all monuments used in the survey to establish the
property boundaries.
7. Show lot corner symbols (where rebar and cap will be set).
8. Roadway Section A -A on Sheet 3 shall be revised to show the two percent cross -slope extending as a
constant slope across the roadway to the (left) south property line, rather than as a "crowned" section as
currently shown. The curbing on the left side shall be shown as extruded concrete curb per city Standard
Detail 34A. The curb and gutter on the right shall be identified as per city Standard Detail 3-4.
9. The private access tract shall be per city Standard Roadway Section 3-2DD, with a 25 foot wide tractor
easement. This will need to be revised on Sheet 2.
10. Roadway Section B-B on sheet 3 should be identified as "Tract B Private Access." The tract or easement
lines need to be shown, and shall be per Section 3-2DD, noted above.
11. A note will need to be provided that indicates Lots 1- 4, inclusive, shall have undivided interest in the
tract, and that all maintenance of the tract shall be shared among those four lots.
12. The lot areas will need to be revised, due to the wider tract width. Lot closure calculations will need to be
revised accordingly as well.

13. Remove the proposed infrastructure improvement elements from the drawing on sheet 2.
14. Remove the reference that the new (main) roadway is a "Tract." This will be a public roadway that will be
dedicated to the city by a statutory warranty deed.
15. The lot closure calculations shall be sealed by the PLS.
16. A note will be required that indicates that the property owners of this short plat (Lots 1-5 inclusive),
together with the.owners (Lots 1-7 inclusive) of the Russell Short Plat, recorded under recording
## (the space will need to be filled -in at the time of plat recording) shall share in the
ownership and maintenance responsibility of stormwater Tract A of the Russell Short Plat.
17. Sheet 3 indicates "Russell Short Plat," instead of "Jon."
Preliminary Engineering Plan
1. In general, the preliminary engineering plan appears to comply with the roadway requirements set ford-i
in the city's August 16, 2017, right-oF way modiFication resgot3se letter. A detailed review of a full
engineering plan set will be performed when the applicant submits for their Engineering (EN) Approval.
Preliminary Technical Information Report (TIR)
1. Page 6, bullet point #5, describes an off -site closed depression. Based on as -built information for the plat
of Northlake Ridge Division 4, this depression has an outflow structure, and therefore, should not be
considered a closed depression.
2. Page 6, bullet point #9, mentions that roof runoff will be handled by rain gardens; however, on page 16,
the first paragraph indicates all roof runoff will be conveyed to the storm pond. The engineer needs to
resolve the discrepancy.
3. Page 9, Core Requirement #9 shall be included.
4. Page 12 indicates a downstream wetland in one paragraph, yet in the following paragraphs indicates there
are "...no ... wetlands... -adjacent to ... the site."
5. On Page 13, again it's indicated that runoff from this project discharges to a closed depression (see
comment #1, above). The downstream analysis shall extend a minimum of 1/4 mile downstream of the
site, and shall include descriptions of the downstream conveyance system and identify if any problems are
discovered and/or anticipated.
6. On Page 16, under Drainage Concept, refer to comment #2, above (Page 2, bullet point #9).
7. On Page 16, the pre -developed conditions shall be identified/modelled as "historic site conditions," as
defined in the 2016 KCS1WDM; not the conditions as they exist today.
8. On Pages 17 and 21, refer to comment #7 regarding modelling the pre -developed condition.

Lakehaven issued updates to these water and sewer certificates in June 2018. Future short platting of the
properties will require extension of water and sewer system facilities under a Lakehaven Developer Extension
Agreement.

1. A Certificate of Water Availability shall be provided indicating the fire flow available at the site. A hydraulic
fire flow model shall be requested from the water district.
Fire Hydrants
2. This project will require two fire hydrants; one existing on the street and anew hydrant in an approved
location on the right-of-way.
3. Fire hydrants shall be in service prior to and during the time of construction.
Fire Access Roads
4. Fire apparatus access roads shall be provided when any portion of the facility, or any portion of an exterior
wall of the first story of the building, is located more than 150 feet from fire apparatus access as measured by
an approved route around the exterior of the building or facility.
EXCEPTION When buildings are completely protected with an approved automatic fire sprinkler system
the distance can be increase 20 percent.
5. Fire apparatus access roads:
1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not
less than 13 feet 6 inches.
2) Shall be designed and maintained to support the imposed load of a 75,000-pound fire apparatus and shall
be provided with a surface so as to provide all-weather driving capabilities.
3) Shall be not less than a 32 foot inside turning radius and not less than a 40 foot outside turning radius.
4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac or fire department
approved alternative at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter.
5) Gradient shall not exceed 12 percent.
6. Designated fire lanes may be required for emergency access. This may be done during the plans check or
prior to building final.
7. Fire apparatus access roads shall be installed and made serviceable prior to and during the time of construction.

Fire Sprinkler System
8. Due to lack of adequate fire department access lots 3 and 4 will require an NFPA 13D fire sprinkler system.
Depending on structure placement and access, an NFPA 13D fire sprinkler system may be required. This will
be detennined at the time of building permit submittal on lots 1 and 2.
CLOSING
Please make the following corrections and resubmit six copies of the short plat drawing accompanied by the
completed "Resubmittal Information Form." Pursuant to FCC 18.05.080, if an applicant fails to provide
additional information to the city within 180 days of being notified that such information is requested, the
application shall be deemed null and void and the city shall have no duty to process, review, or issue any
decisions with respect to such an application.

Comments on Jon Short Plat and Russell Short Plat, File #16-105594-00-SU and #16-105598-00-SU
Dear Ms. Chapin,
I am a North Lake resident living just a few lots away from the properties being developed under the Jon Short Plat and
Russell Short Plat applications. I am also a longtime member of the North Lake Improvement Club (NLIC), whose property
abuts the proposed developments. I offer these comments on the development applications:
I am pleased to see that the developers are planning to build within the existing RS9.6 zoning, to blend with the existing
neighborhood to the north, south and west.
However, since the road through these small subdivisions will connect the large subdivision to the east with 38th Avenue
South, I believe a road -width reduction isn't warranted. I anticipate a lot of residents from the existing subdivision will
discover that this is a quicker, shortcut route when they are headed to Weyerhaeuser Way and Highway 18. This will
increase the level of traffic on a narrow road, as well as accessing 38th Avenue South at a less than optimal location. If
the city approves the reduced -width road, it should also require speed humps on at least two locations of this new road, to
reduce speed and improve safety.
In addition, the developer's proposal to prohibit parking on this connecting street in exchange for a narrower street seems
problematic. The North Lake Improvement Club regularly rents out its clubhouse for children's birthday parties and other
gatherings, where people park in the grass -and -gravel clubhouse lot. With a new paved street immediately adjacent to the
north boundary of the clubhouse property, it's likely that event attendees may also try parking on the street, or half on -half
off the street.
Many children attend these rental events at the clubhouse and have a great time running around the property, which is
park -like. The laurel hedge along the north/south property line between the short plat property and the NLIC property
provides a natural barrier that helps keep children safe. This hedge has been routinely maintained by the NLIC for many
of the 25+ years that I have lived here, and so it raises the question of whether the hedge actually sits on NLIC property
rather than the developer's land.
If the developer is successful in demonstrating that the hedge is on his property and must be removed to accommodate
road construction, he should be required to erect a fence or other barrier between the new road and the NLIC property (in
consultation with the NLIC board) to maintain the safe environment that has existed for the clubhouse's many decades.

Dear Mr. Hansen:
We are writing as board members of the North Lake Improve Club (NLIC) located adjacent to the proposed Jon
and Russell Short Plat. We represent 65 families who belong to the NLIC. The board and these 65 families
have participated in the upkeep of the club and grounds since the mid- 1960's.
Part of the property maintenance has been an bi-annual pruning of the large laurel hedge that runs the length of
the property on the north side on the club house which was built in the 1960's. The North Lake Improvement
Club is used for numerous neighborhood functions along with being rented to other community groups outside
our neighborhood. The hedge has provided privacy and a boundary for these activities and has been especially
helpful in keeping young children safe from road activity.
The North Lake Improvement Club has been in possession of this property for at least 40 years and has honestly
held possession with the belief that this land belonged to the North Lake Improvement Club. We have
continued to maintain the hedge and no owner has ever contacted us about the hedge or our continued
maintenance over this time.
We understand the City is requiring a road through the developments to connect 38th Avenue South with a now
dead-end road to the southeast in North Lake Ridge. If the hedge, we have been maintaining for 40 plus years,
is removed it will dramatically change the dynamics of the safe usage of the property. We would like the hedge
to remain as it is. If that cannot be done, we request that the developer replace the hedge with a barrier to the
road that provides the privacy and boundary needed for us to continue to use our club house as it is currently
being used.

to Federal Way Revised Code (FWRC) Chapter 18.30. Additional permits and/or approvals in conjunction

Boundary Line Adjustment — The Boundary Line Adjustment (BLA) has been approved and is in the City's
Will Call area waiting to be picked up. Please check in with the second floor receptionist for assistance
with Will Call. The BLA drawing must be recorded by the applicant prior to recording the short plat. You
will need to make two full size copies of the BLA (one for the assessor and one conformed copy for the
City). Please return the conformed copy of the BLA to the City immediately after recording. No changes
to the BLA document are allowed following city signature. If the county recording process necessitates
revisions to the BLA map, please run it past me prior to recording. NOTE: since the properties are
currently on septic system, you will need to obtain a Kinja County Health Dept. signature on the BLA
prior to recording.
2. Required Yard Setbacks — Lot 1 and Lot 2 do not accurately depict the required front yard setback for a flag
lot. Refer to the redlined drawings. Please revise the short plat drawing accordingly.
3. Tree Retention — It is unclear how the required tree units will be met on -site. This site has a net area (gross
site acreage minus any proposed public or private streets) of 57,972 sq. ft or 1.33 acres, which requires 34
tree units (1.33 acres x 25 tree units per acre). Street trees do not count as part of the tree unit
calculation. Please revise the tree retention plan to include the tree unit calculation and where each
existing tree is located and where replacement trees will be located.

Engineering Plans and TIR:
The previous submittal indicated that a Modular Wetland system was proposed to provide water quality
treatment. This submittal now indicates that a wetpond is proposed for water quality treatment, which
does not meet the required Enhanced Basic Treatment criteria. A Water Quality treatment facility shall be
proposed that meets the Enhanced Basic criteria. A facility or system that is recognized by either the
King County Surface Water Design Manual or the Washington State Department of Ecology with
General Use Level Designation (GULD) for Enhanced Basic Treatment may be used.
2. Street lighting that meets City standards is required along the entire roadway length. A street lighting plan
will be required as part of the Final engineering approval for the plat(s).

Please make the following corrections and resubmit four copies of the drawings and two copies of revised
documents accompanied by the completed "Resubmittal Information Form" (enclosed). Pursuant to Federal

Dear Mr. Chaosilapakul:
The city's Community Development Department hereby grants your 60-day time limit extension request for
the Jon Short Plat until May 23, 2019. If materials requested in the September 25, 2018, technical continent
letter are not submitted by the May deadline, the application will expire. No additional time extensions will be
granted. This decision is based on the findings/conclusions in the discussion below. Authority to grant such
an extension is set forth in Federal lVay RwEred Cade (bWRC) 18.05.080(3).
BACKGROUND
This is the second time extension request for this short plat application. The short plat application was
granted the first 180-day time limit extension on May, 9, 2018, when the applicant failed to provide requested
information to the city within 180 days of the issuance of a Notice of Incomplete Application letter, issued on
December 20, 2016, The applicant resubmitted additional information on August 17, 2018, and the
application was deemed complete on September 6, 2018. In the September 25, 2018, letter, the applicant
received technical comments that were required to be addressed before short subdivision preliminary
approval would be granted. The applicant is requesting additional 60-days to provide the requested materials
in the above -referenced technical comment letter.
EXTENSION CRITERIA
The following is an excerpt of the plat time extension criteria from FWRC 18.05.080(2). Staff responses have
been provided to each criterion in bold.
(a) Circumstances beyond the applicant's control prevent compliance with the time limits of the subdivision
code;
The applicant incurred survey datum conflict (multiple surveys on different/assumed datums)
that caused issues with the stormwater design and associated elevations which was beyond the
applicant's control.

(b) The applicant is making substantial progress in responding to the request for information so that review
of the application can be furthered when that information is submitted;

(c) The number of additional calendar days necessary to provide the requested information.
The applicant is requesting a 60-day time extension.
CLOSING
The 180-day time limit extension is hereby approved. If you fail to provide the requested information to the
city by May 23, 2019, 60-days from the date of the 180-day time limit on the above -mentioned technical
comment letter, the application shall be deemed null and void and the city shall have no duty to process,
review, or issue any decisions with respect to the short plat application. No additional time extensions will be
granted. Please provide six copies of plans and two copies of reports when resubmitting requested materials.

This letter, as well as the resubmitted drawings and documents, are provided to address
the City's comment letter dated July 3rd, 2019. We have used the same numbering system
as found in your comment letter.
Planning Division Comments:
1. We are in process of obtaining signatures from King County Health Department for the
BLA. We will provide a copy of the BLA once recorded with King County.
2. Setbacks for Lots 1 and 2 have been revised per the redlines.
3. Tree retention plan has been updated, the lot area is 53,334 sf after removal of ROW
and Tract Areas, yielding 30.6 tree units required. The project will provide 35.0 total
existing and proposed Tree Units. Please see Preliminary Planting Plan and Calculating
Tree Units Form provided by Glenn Takagi as part of this submittal.
Public Works Comments:
Engineering, LS Plans, and TIR:
1. A Stormwater Wetland providing Enhanced Basic Treatment is proposed. Revisions are
reflected on the Plans as well as the TIR.

Boundag Line#Autment — The Boundary Line Adjustment (BLA) has been approved And is in the City's
Will Call area waiting to be picked up. Please check in with the second floor receptionist for assistance
with Will Call. The BLA drawing must be recorded by the applicant prior to recording the short plat. You
will need to make two full size copies of the BLA (one for the assessor and one conformed copy for the
City). Please return the conformed copy of the BLA to the City immediately after recording. No changes
to the BLA document are allowed following city signature. If the county recording process necessitates
revisions to the BLA map, please run it past me prior to recording. NOTE: since the properties are
currently on septic system, you will need to obtain a King Coun1yHealth Dept. signature on the BLA
prior to recording.
2. Required }lard Setback.- — Lot 1 and Lot 2 do not accurately depict the required front yard setback for a flag
lot. Refer to the redlined drawings. Please revise the short plat drawing accordingly.
3. Tree Retention — It is unclear how the required tree units will be met on -site. This site has a net area (gross
site acreage minus any proposed public or private streets) of 57,972 sq. ft or 1.33 acres, which requires 34
tree units (1.33 acres x 25 tree units per acre). Street trees do not count as part of the tree unit
calculation. Please revise the tree retention plan to include the tree unit calculation and where each
existing tree is located and where replacement trees will be located.

Engineering Plans and TIR:
1. The previous submittal indicated that a Modular Wetland system was proposed to provide water quality
treatment. This submittal now indicates that a wetpond is proposed for water quality treatment, which
does not meet the required Enhanced Basic Treatment criteria. A Water Quality treatment facility shall be
proposed that meets the Enhanced Basic criteria. A facility or system that is recognized by either the
King County Surface Water Design Manual or the Washington State Department of Ecology with
General Use Level Designation (GULD) for Enhanced Basic Treatment may be used.
2. Street lighting that meets City standards is required along the entire roadway length. A street lighting plan
will be required as part of the Final engineering approval for the plat(s).

L WHY SHOULD THIS INVENTORY STATEMENT BE FILLED OUT?
Critical Aquifer Recharge (CARAs) and Wellhead Protection Areas (WHPAs) are considered
"critical areas" pursuant to Federal Way Revised Code (FWCC), Title 14, "Environmental Policy."
This inventory statement must be filled out by the applicant or agent for any proposed activity listed
in Section II of this handout, and which are located within Wellhead Capture Zones 1, 5, and 10 as
shown on the Critical Aquifer Recharge and Wellhead Protection Areas Maps. Please refer to the
handout on Critical Aquifer Recharge and Wellhead Protection Areas for a description of the review
process.
U. ACTIVITIES GOVERNED BY CARA AND WHPA REGULATIONS
The Inventory statement must be filled out for the following activities:
• Construction of any residential structure, including single-family development
+ Construction of any barn or other agricultural structure
+ Construction of any office, school, commercial, recreational, service, or storage building
