If materials requested in the September 25, 2018, technical comment letter are not submitted by the May deadline, the application will expire. No additional time extensions will be granted. This decision is based on the findings/conclusions in the discussion below. Authority to grant such an extension is set forth in Federal Way Devised Code (FWRC) 18.05.080(3). BACKGROUND This is the second time extension request for this short plat application. The short plat application was granted the First 180-day time limit extension on May, 9, 2018, when the applicant failed to provide requested information to the city within 180 days of the issuance of a Notice of Incomplete Application letter, issued on December 20, 2016. The applicant resubmitted additional information on August 17, 2018, and the application was deemed complete on September 6, 2018. In the September 25, 2018, letter, the applicant received technical comments that were required to be addressed before short subdivision preliminary approval would be granted. The applicant is requesting additional 60-days to provide the requested materials in the above -referenced technical comment letter. EXTENSION CRITERIA The followingis an excerpt of the plat time extension criteria from FWRC 18.05.080(2). Staff responses have been provided to each criterion in bold. (a) Circumstances beyond the applicant's control prevent compliance with the time limits of the subdivision code; The applicant incurred survey datum conflict (multiple surveys on different/assumed datums) that caused issues with the stormwater design and associated elevations, which was beyond the applicant's control. Building Footprints —Remove the proposed building footprint outlines from each lot. 2. Required Yard Setbacks — The existing house on Lot 5 must meet all required yard setbacks. It appears that the roofline is projected into the south side yard and the entry stairs are within the front yard setback. Pursuant to Federal Way 1ievisad Code (BVRC) 19.125.160, no improvement or structure may be in a required yard except as follows: a. A driveway and/or parking area subject to the standards of FWRC 19.130.240. b. Any improvement or structure, other than a driveway and/or parking area, that is not more than four inches above finished grade may be anywhere in a required setback yard. c. An improvement or structure that is not more than 18 inches above finished grade may extend not more than five feet into a required yard. d. Chimneys, bay windows, greenhouse windows, eaves, awnings and similar elements of a structure that customarily extend beyond the exterior galls of a structure may extend up to 18 inches into any required yard. The total horizontal dimension of the elements that extend into a required yard, excluding eaves, may not exceed 25 percent of the length of the facade of the structure from which the elements extend. Opens Space— It does not appear that the 15 percent open space will be provided on site. A fee -in -lieu payment may be made to satisfy open space requirements at the discretion of the Parks Director. Tree Retention — Pursuant to FkVRC 19.120.130(1), all single-family zoned sites are required to maintain at least 25 tree -units per acre. The total number of tree units required to be provided is calculated by multiplying gross site acreage, tniniis any proposed public or private streets. This can be met via preserving onsite trees (preferably) and/or planting new trees. A tree unit is a credit assigned to existing and replacement trees based on their size and species, respectively. Please provide a tree retention plan that includes the tree unit calculation for the site and how the tree unit standards will be met. Mr. Perez did provide a suggestion that we approach the Public Works Department for a modification to the road standards and provide a roadway section that would provide the City with a fully functional road, reduce the amount of impervious surface and hopefully keep the two lots that would have been deleted. We believe we have developed such a roadway section! We would like to request the following modification to the City's current roadway requirements as outline below and presented in Exhibit C - sketch of modified roadway, for the Jon Short Plat: 1. Reduce the required pavement width to 20-feet from face of curb to face of curb across the Russell Short Plat and continue that pavement width of 20 feet across the Jon Short Plat from the face of curb southerly to the edge of the south property line. 2. Establish "no parking" zones on both sides of the street through the entire length of the roadway. 3. Mitigate the "no parking" zones by placing conditions on the Jon and Russel Short Plats that requires additional on -site parking for each lot. Conditioning the lots to three -car garages, longer driveways, and/or additional parking pads adjacent to the driveways comes immediately to mind. (Adding additional on -site parking constraints does not necessarily increase the added impervious area for the lots since the City's stormwater management requirements offer more flexibility in managing storm runoff within the lots versus in the street ROW's.) 4. Provide all other street improvements such as curbs, gutters, sidewalks, landscape buffers street trees, street lights, etc., as required by current street standards on the Russell Short Plat and on the north side of the Jon Short Plat. This modification to standards would still provide the City with a street that would be harmonious with the existing streets in the immediate community, would function properly and safely for both pedestrian and vehicle traffic, and more importantly, would provide the City with an interconnection street between two neighborhoods. We are requesting this modification based upon the Public Works Director authority under FWRC Title 19, Chapter 135, "Development Improvements", Item 2; That the physical conditions of the parcels, their narrow linear shape, are such that a standard city roadway section will have such a large footprint that the owner will likely have a lot reduction of some 30% (from 7 lots to 5 lots) from the normally allowable lot densities on the Russell Short Plat and have a non -conforming setback issue on the existing residence occupying the Jon Short Plat.
