We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION Lakehaven Utility District capital project to upgrade the existing sewer system with 6,100 linear feet of replacement sewer main. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Public Works Development Services Division The South 3200' Street crossing shall be completed prior to the City's asphalt overlay scheduled for spring/summer 2014. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. PLANNING DIVISION (Matthew Herrera, 253-835-2638, matt.herrera@cityoffederalway.com) Clearing & Grading Plan Approval — The department has determined that no land use permitting will be required. The applicable clearing and grading regulations set forth in FWRC 19.120.070 et al will be reviewed and approved as part of the Public Works Engineering (EN) review process. 2. Tree Removal — Pursuant to 19.120.030(13), the removal of trees in easements and rights -of -way for the purposes of constructing utilities are exempt from Tree and Vegetation Plan approval and therefore no code -based mitigation is required. Although exempt, the policy makes clear that protection of trees shall be a major factor in the location, design, construction, and maintenance of utilities. Critical Areas — Administrative approval (if needed) for encroachment into wetland/stream buffer areas within the Belmor Mobile Home Park will also be a component of the clearing and grading plan approval. Please submit a final critical areas report with the EN submittal. 4. After Hours Work — Permitted work hours are 7:00am to 8:00pm Monday -Friday and 9:00am to 8:00pm Saturday. Work outside of those hours or on Sundays or holidays observed by the city is not permitted outright and requires written authorization from the Community and Economic Development Department. Please submit any after-hours work requests to the department at least two weeks from the expected start date. Any work near residential areas may require the district to provide mailed notice to property owners. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Kevin Peterson, 253-835-2734, kevin.peterson@cityoffederalway.com) Right -of -Way Permits Current project design proposes work in City Right -of -Way (ROW) in four (4) separate locations — 20'h Avenue South, from South 33& Street to 200'Way South; Crossing South 324" Street; Crossing South 320'' and extending approximately 170 feet north on 21 ' Avenue South; and 20`h Avenue South from South 318ffi Place to South 316`h Place. Streets Division staff have determined that all work in the ROW can be covered under a single ROW Permit. If it is necessary to phase the project over an extended period of time, then additional ROW Permits may be required. Open -cutting of City streets will require full -width asphalt overlays. Streets Division will determine the limits and other requirements of the overlay. 3. City policy is to require that all utility crossings (transverse) are to be pushed or bored. However, the Streets Division Manager has authorized open cuts for crossing South 324"' Street and South 320'' Street. Details of this authorization can be found in letters dated March 4, 2013, addressed to John Bowman, LUD General Manager. 4. In conjunction with the asphalt overlay, all ADA ramps that are adjacent to the overlay sections shall be re -constructed (as necessary) to bring those ramps into compliance with current ADA standards. 5. All traffic calming devices (traffic circles, speed humps, etc.), and channelization markings affected by the asphalt overlay shall be replaced to city standards. 6. Per City standards, all open cuts within the City ROW require 100% crushed rock backfill. 7. Per City standards, pipes shall be removed, rather than abandoned in place, within City ROW. A request for variance to this standard may be submitted to the Streets Division Manager. Temporary traffic control shall be per the current edition of the MUTCD and/or WSDOT Standards. Engineering (EN) Approval Issues City Development Services staff will review the temporary erosion and sediment control measures associated with the project work outside the City ROW (on private property). A separate submittal is required for the EN Approval process. Three (3) sets of the plans shall accompany the application for EN. Erosion control measures, per Appendix D, 2009 KCSWDM, are required. Provide approximate cut and fill quantities on the plans. 4. Provide a copy of the Construction SWPPP with the EN application. CLOSING This letter reflects the information provided at the preapplication meeting and is intended to assist you in preparing plans and materials for formal application. This letter summarizes the findings of this study and details applicable federal, state, and local regulations. The following attachments are included: Wetland and Pond Delineation Figure Wetland Determination Data Forms Project Description The Lakehaven Utility District plans to replace approximately 6,400 linear feet of existing gravity sanitary sewer pipe located within the City of Federal Way's Downtown Core area. The existing sewer pipe is under capacity and needs to be upsized to handle anticipated future flows. Approximately 500 lineal feet of sewer pipe runs through the Belmor Golf and Country Club in a raised berm that separates two water bodies - an equalization pond and an upland stream. The new sewer pipe in this area is proposed to be 27-inch. The District is evaluating two alignment alternatives for replacement of the new sanitary sewer main through the golf course (see Wetland and Pond Delineation Figure). The proposed alignment is to replace the existing pipe in, or near, the current sanitary sewer alignment, located in the raised berm that separates the pond and the stream. The alternative alignment is the installation west of the pond in the ninth fairway of the golf course. January 24, 2013 Page 2 Methods Public -domain information on the subject property was reviewed for this delineation study. These sources include USDA Natural Resources Conservation Service Soil maps, U.S. Fish and Wildlife Service National Wetland Inventory maps, Washington Department of Fish and Wildlife interactive mapping programs (PHS on the Web and SalmonScape), King County's GIS mapping website (iMAP), and the City of Federal Way website. The study area was evaluated for physical wetland characteristics using methodology from the Corps of Engineers Wetland Delineation Manual (Manual) (U.S. Army Corps of Engineers [Corps] 1987) and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Western Mountains, Valleys, and Coast Region Version 2.0 (Regional Supplement) Corps May 2010). Wetland boundary determinations are based on an examination of vegetation, soils, and hydrology. Soil, vegetation, and hydrologic parameters were sampled at several locations to determine wetland presence or absence. Data points on -site are marked with yellow- and black -striped flags. We recorded data at two of these locations. Note that not all areas that meet physical wetland characteristics are necessarily jurisdictional or "legal" wetlands. Therefore, delineated wetland areas covered under this study were also evaluated for their jurisdictional status at the local, state and federal regulatory levels. We also reviewed two documents for background information on the regional stormwater detention facility: Geotechnical Data Report: South 32411, to South 336th Trunk Storm Drainage and Belmor Regional Storage Facility Improvements Project RFB 98-107, Geotechnical Data Report, CH2M HILL,1998. Operations and Maintenance Manual: South 32411, to South 33611 Trunk Storm Drainage and Belmor Regional Storage Facility Improvements Project, Operations and Maintenance Manual, CH2M HILL, 1999. Areas meeting wetland parameters were marked with pink- and black -striped flags. Pond A was marked with 36 flags. The ordinary high water mark (OHWM) of the stream was flagged with blue- and white -striped flags. Stream A was marked with 31 flags on the right bank and 18 flags on the left bank. We assessed the ecological functions and values of the pond area using a credit and debit calculating tool from the Washington State Department of Ecology (Calculating Credits and Debits for Compensatory Mitigation in Wetlands of Western Washington, Publication #10-06-011). Delineation Report Miller, A. January 24, 2013 Page 3 Findings The subject area contains a jurisdictional stream and a constructed detention pond with wetland characteristics located between a golf fairway and a row of mobile homes along Augusta National Lane. Stream A The stream emerges from an 82-inch concrete culvert west of Augusta National Lane and Pebble Beach Circuit (see Figure 1). The culvert carries stormwater from a highly - urbanized basin to the north that contains the Commons Mall, roads, and other commercial activities. Stream A flows south in the subject area for approximately 440 feet, then drains to a concrete control and pump station, then into another culvert that carries the flow beneath The Dunes Court and eventually off -site. Stream A is a perennial watercourse that does not support migratory fish due to several blockages downstream. It does, however, flow to Hylebos Creek, which supports Coho and Fall Chinook, according to SalmonScape (SalmonScape website, data downloaded 12/2012). Figure 1. Federal Way classifies streams as "Major' or "Minor" according to FWRC section 15.05.030 - Additional definitions. A "'Major Stream' means any stream, and the tributaries to any stream, which contains or supports, or under normal circumstances contains or supports, resident or migratory fish." Stream A is a tributary to a salmon - bearing stream, thus is a "Major Stream". Delineation Report Miller, A. January 24, 2013 Page 4 Pond A The storm water detention pond, called the Belmor Regional Storm Water Storage Facility (from here on called the Belmor RSF), is "...an off -channel excavated basin hydraulically interconnected to the existing stream channel aligned through the Belmor golf course (along 9th/18th fairway)" (Operations and Maintenance Manual, CH2M HILL, 1999). It is separated from Stream A by a maintenance access road that acts as a berm. Two sets of culverts provide hydrologic connectivity between Stream A and the Belmore RSF. The pond was built in 1998 to replace and enhance the storm water attenuation functions of the old storm water detention pond on the Commons Mall property to the north (Geotechnical Data Report, CH2M HILL, 1998). The Belmor RSF was designed as a component of a larger drainage improvement project in the West Branch Hylebos Creek Sub basin (City of Federal Way website, data downloaded 12/2012). The reservoir operates at two levels depending on the time of year (Operations and Maintenance Manual, CH2M HILL, 1999). Between October 1 and May 1, the level is reduced to a minimum operating level to increase live storage during the rainy season. Minimum level is achieved by opening a 24-inch sluice gate at the minimum elevation in the concrete control station at the south end of the Belmore RSF. The sluice gate is closed in the summer to raise the level of the water to a 30-inch upper opening with a bottom elevation that is 4 feet higher than the bottom of the sluice gate. Two spillways are situated above the second opening to accommodate storm events: the highest, an emergency spillway 10 feet higher than the lowest 24-inch opening, gives the pond 10 feet of live storage capacity (Operations and Maintenance Manual, CH2M HILL, 1999). The two sets of culverts that provide hydrologic connection between Stream A and the Belmor RSF are eight feet above the minimum pond elevation (Operations and Delineation Report Miller, A. January 24, 2013 Page 5 Maintenance Manual, CH2M HILL,1999). A small amount of water from the stream was flowing into the pond at the time of our visit which was being maintained at the minimum elevation. The seasonally ponded area exhibits wetland characteristics. Rooting zone soil is a yellowish gray (2.5Y 4/1) gravelly sandy clay loam with dark yellowish brown (10YR 4/6) redoximorphic features. Red alder (Alnus rubra, FAC), reed canarygrass (Phalaris arundinacea, FACW), soft rush Uuncus effusus, FACW), and small -fruited bull rush (Scirpus microcarpus, OBL) dominate the area in the sampling area. The water table was noted within 6 inches of the surface in the soil pit. Conditions near Pond A The area near Pond A is characterized by mowed lawn and some scrub shrub vegetation dominated by red -osier dogwood (Cornus sericea, FACW), and young Douglas -fir (Pseudostuga menziesii, FACU) and red alder trees. The soil sampled near the pond was not saturated at the time of our visit after heavy rain events had moved through the area. Local Regulations Pond A Pond A may not be regulated as a wetland by the City of Federal Way despite meeting physical wetland criteria. Per section 19.175.010(3) of the Federal Way Revised Code (FWRC) "Surface water ponds, drainage ditches, and other such facilities which were designed to impound or convey water for an engineered purpose are not considered regulated wetlands under this division provided they meet all of the following criteria:" (a) The drainage facility must have been intentionally human -created. This is to differentiate from those wetland sites that are accidental consequences of development actions, such as road construction or culvert placement. Such sites may be considered regulated wetlands by the director upon a review, under subsection (2)(g) of this section, of the ecological functions and values of the site. (b) The drainage facility must have been originally constructed on uplands (nonwetland areas). If the drainage facility is located within a straightened, channelized, or otherwise disturbed natural watercourse, it may be considered a regulated wetland by the director upon a review, under subsection (2)(g) of this section, of the ecological functions and values of the site. (c) The facility must be actively operated as a surface water drainage facility. Abandoned drainage facilities may be considered regulated wetlands by the director upon a review, under subsection (2)(g) of this section, of the ecological functions and values of the site. Delineation Report Miller, A. January 24, 2013 Page 6 (d) Wetland conditions have not expanded beyond the originally constructed drainage facility boundary. In such a case, the expanded area may be considered a regulated wetland by the director upon review, under subsection (2)(g) of this section, of the ecological functions and values of the site. (e) The drainage facility was not designed or constructed as a requirement to mitigate previous wetland impacts. (f) The director finds that limited ecological functions and values do not warrant application of the city's wetland regulations. The pond meets criteria (a), (c), (d) and (e). With regards to criterion (b), historic aerial photographs from 1998 and 1990 (King County iMap) show that Pond A was excavated from lawn within the golf course. However, it is unclear from the photography whether wetland features were present in the lawn before construction. Peizometer data from the 1998 CH2M HILL study, taken from the pond location, provides additional evidence. A water table "...from approximately 5 to 9 feet below the ground surface..." (pp. 5-2) was observed in a well in the project area, showing the water table was well below the rooting zone and therefore not shallow enough to satisfy wetland hydrology criteria. Furthermore, the study found the Alderwood soil, "...which underlies most of the project alignment..." to be very dark brown (10YR 2/2) to dark brown (10YR 3/3) to a depth of 27 inches, colors that are consistent with non -wetland soils. The report data and the photographic evidence show the pond was built from non wetland, thus subsection (b) is met. Criterion (f) requires a decision of the director based on an assessment of "ecological functions and values". We evaluated the functions of the Belmor RSF using the Ecology Credit and Debit tool. As expected, the pond rates moderate to high for hydrologic function (as it was engineered specifically for flood flow attenuation). However, water quality improvement function is moderate due to the lack of substantial vegetation in the ponded areas. The habitat function is low due to the lack of structural features (e.g., large woody debris, snags, etc.), developed vegetation structures, and lack of connections to undisturbed habitat areas nearby. The functional level of the Belmor RSF would likely be consistent with other engineered storm water detention facilities in the area. Based on our evaluation of this pond using Ecology guidance, the strict application of FWRC wetland regulations are not justified. Stream A Per chapter 19.165.010 of the FWRC, Stream A requires a 100-foot buffer extending horizontally in all directions from the OHWM. Public utilities may be constructed within a stream setback pursuant to requirements in the FWRC, Chapter 19. Artificially created features such as ditches and storm water detention ponds that drain to Waters of the State may also be regulated by the Corps. Any filling of Waters of the State, including wetlands (except isolated wetlands) and some upland ditches or ponds that exhibit wetland characteristics and that are found to be non -isolated, would require notification and permits from the Corps. Pond A would be regulated by the Corps. Federally permitted actions that could affect endangered species (i.e. salmon or bull trout) may also require a biological assessment study and consultation with the U.S. Fish and Wildlife Service and/or the National Marine Fisheries Service. Application for Corps permits may also require an individual 401 Water Quality Certification and Coastal Zone Management Consistency determination from Ecology. In general, neither the Corps nor Ecology regulates wetland or stream buffers, unless direct impacts are proposed. Construction of the proposed alignment is all within this buffer and the alternative alignment includes some construction within the buffer. Therefore, construction of the new sewer will have to be in conformance with City of Federal Way local regulations for construction within a stream buffer. If any construction is proposed within Pond A it will need to be in conformance with the State and Federal regulations listed in the report.
