The Process I application is hereby approved based on the enclosed Findings for Site Plan Approval — File No: 01-100363. Please be advised that a building permit, plumbing permit and electrical permit are required from the City of Federal Way before doing any work. You are also required to obtain a sign permit from the City. Enclosed are the development comments from the Building Department. Please review these for further development regulations. This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this project site. The effective date of this decision is February 26, 2001. Pursuant to Federal Way City Code (FWCC) Section 22-356, any -person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by March 12, 2001. However, since you are the only party of record for this application, you may waive your right to appeal. The City must receive this waiver in writing. Waiver of the right to appeal does not effect the three-day waiting period. Therefore, if you choose to waive your right to appeal, you could begin work on the proposal on March 1, 2001, provided you have obtained the necessary permits by that date. Please find enclosed the additional technical comments from Joan Hermle of the Federal Way Building Division, and Mary Young of Lakehaven Water Utility District. A Process I application fee of $96 is now due (two hours at $48.00 per hour). However, the $48.00 deposit paid at the time of application covers a portion of this fee. The applicant proposes to add a 14 x 8 foot drive-thru espresso stand building and install required landscaping at 2140 SW 356b' Street, Federal Way. Zoning for the subject site is Neighborhood Business (BN). This zoning district permits fast food restaurant uses pursuant to Federal way City Code (FWCC) Section 22-753. The proposal is subject to Process I, Director's Approval, as it does not meet the land use process exemptions under FWCC Section 22-32. 2. The proposed addition of the espresso stand is exempt from SEPA review pursuant to Washington Administrative Code (WAC) 197-11-800, "Categorical Exemptions." 3. The proposal has been reviewed for consistency with all applicable zoning regulations including FWCC Section 753 "Neighborhood Business, Fast Food Restaurant"; FWCC Article IV, "Nonconformance"; FWCC Article XVII, "Landscaping"; and Article XIX, "Community Design Guidelines." 4. Nonconformance: The proposal includes construction of an 8 x 14 foot structure to be used as a drive-thru espresso stand building. Since this structure is considered an expansion of gross floor area and is separate from the main building, the project must meet all current code requirements in the geographic portion of the site where the addition is proposed. This is achieved by installing landscape islands to separate the drive aisles from the proposed future parking lot that will be installed in conjunction with a future redevelopment project at Northshore Village. The cost of the proposed improvements, other than tenant improvement and normal maintenance, do not exceed 50 percent of the assessed value of the existing improvements on the site. All improvements proposed on the subject site do not exceed 25 percent of the assessed value of all structures on the subject property. 5. Landscaping: The applicant has proposed two 40' long landscape islands to be -installed on either side of the drive aisles. Pursuant to Community Design Guidelines FWCC Section 22-1634(g)(2) these islands will be landscaped with Type III landscaping. Foundation landscaping will be installed on the east and west sides of the espresso stand. The landscaping island separating drive aisles and the parking lot shall be a minimum six feet in width as required by FWCC Section 22-1567. Groundcover shall be planted in all landscaped areas. 6. Parking: The existing building is 27,596 square feet of retail use space. The FWCC requires 92 stalls. The site currently has 140 parking stalls. The proposed espresso stand requires two stalls based on one stall per 80 square feet of fast food restaurant use. The proposal meets minimum standard parking requirements, as there is sufficient parking to meet existing uses and the proposed use. However, pursuant to Uniform Building Code Chapter 11, section 1107, this development does require one fully van accessible parking space adjacent to the construction. The site plan shall be reconfigured to correctly accommodate the indicated disabled parking stall. 7. Community Design Guidelines Per FWCC Section 22-1632, subject applications for remodeling or expansion of existing developments shall meet only those provisions of design guidelines that are determined by the Director of Community Development Services to be reasonably related and applicable to the area of remodeling or expansion. Per FWCC Section 22-1634(g), drive -through windows and stacking lanes are not encouraged along facades of buildings that face a right-of-way. The proposed espresso stand has situated the drive -through windows and stacking lanes so that they are perpendicular to 21-'t Avenue SW, and has therefore satisfied this element of the Community Design Guidelines. Also, pursuant to FWCC Section 22-1634(g), the stacking lanes shall be physically separated from the parking lot by Type III landscaping and /or architectural elements. The proposed 40' long landscape islands separating the stacking lanes and parking lot shall be 6' wide. Overall design continuity on the subject site shall be achieved by using materials and colors that are similar to the existing building. 8. Pursuant to the Uniform Building Code Chapter 18, all structures to be occupied shall have restrooms. The applicant shall provide an accessible restroom in the espresso stand or provide written verification that an accessible restroom is in an adjacent building on the same lot as the espresso stand and will be available for use. 9. Pursuant to FWCC Section 22-395(b), and the forgoing findings, the proposal is found to be consistent with the Federal Way Comprehensive Plan; all applicable provisions of the FWCC; and with the public health, safety, and welfare, provided that the stated conditions of approval are met. The CDRC includes representatives from the Lakehaven Utility District and Federal Way Fire Department, and staff from the City's Planning and Building Divisions and Public Works Department. This letter summarizes our conference held on August 10, 2000, at which time members of the CDRC discussed development requirements as they apply to the proposal. Where appropriate, pertinent sections are noted. The items listed below do not include all regulations applicable to the subject proposal. In preparing your application, all pertinent portions of the Federal Way city Code (FWCQ must be consulted. PLANNING DIVISION — Jane Gamble, 253-661-4120 1. Zoning, Use, and Review Process— Zoning for the subject property is Neighborhood Business (8N). This zoning district permits fast food restaurants under FWCC Section 22- 722 (enclosed), pursuant to Process II, Site Plan Review. In this instance, the entire development for Northshore village is under Process III review; this proposed project will be considered as part of that review per your request. 2. Landscaping —A preliminary landscape plan prepared by a licensed landscape architect in accordance with FWCC Article XVII, "Landscaping" (enclosed), is required as part of site plan submittal. In that the proposed espresso stand would be considered as part of the overall site redevelopment and included in the requirements of Process III approval, plantings for foundation landscaping of the espresso stand should be consistent with the overall design and plant selection of the required landscaping for the entire site. 4. Design Guidelines— Conformance with FWCC Article XIX, "Community Design Guidelines," is required as part of the site plan submittal. Requirement Comments FWCC Section 22- Stacking lanes shall be physically separated from parking lot, 1634(g)(2) sidewalk, and pedestrian areas by Type III landscaping and/or Drive Through architectural features, or a combination thereof. Pedestrian Pedestrian pathways must be delineated by separate paved routes using a Circulation and variation in paved texture and color, i.e., stamped and colored Public Spaces concrete, pavers, etc. These pedestrian pathways should be protected from abutting vehicle circulation area with landscaping. Paint striping as a method of delineation is not acceptable. Mr. George W. Andrews Page 3 August 23, 2000 Requirement Comments FWCC Section 22- Provide design continuity with existing buildings, such as a similar 1634(a)(4) roof line, matching trim, etc. General Criteria FWCC Section22- Multiple buildings on the same site should incorporate public spaces. 1636(a)(4) These should be integrated by elements such as plazas, walkways, Building and etc. Consider situating the espresso stand on corner of pedestrian pedestrian plaza, thereby satisfying one of the building fagade modulation orientation options as define in FWCC Section 22-1635, and creating an overall design continuity as specified in FWCC Section 22-1634. 7. Signs— Article XVIII of the FWCC (enclosed) regulates signage on the site. One freestanding medium profile sign is permitted on the subject property per FWCC Section 22-1601(a)(2); maximum height for the freestanding sign is 12 feet. Wall mounted signs are permitted pursuant to FWCC Section 22-1601(b). The sign area for the wall mounted signs shall not exceed seven percent of the exposed building fagade to which it is attached, provided that no individual sign shall exceed 40 square feet. A separate sign permit is required before signs are installed. A sign application and handout are also enclosed. Please contact Betty Cruz, Code Compliance Officer, at 253-661-4017 with questions. Please submit a revised site plan for this project, including the following: 1) Necessary Type III landscape screening elements for stacking lanes. 2) Details regarding the design elements of the proposed drive-thru espresso stand in relation to the rest of the development. 3) Required pedestrian pathways as noted above. If the owner of the espresso stand is other than the underlying property owner of Northshore Village, please indicate whether or not a ground lease is involved.
