This proposal is in response to your request, dated January 2, 2020, and is based on a brief review of the information provided with your request in the Consultant Authorization form (attached) and LAI's experience on similar projects. LAI will fulfill the task scope elements requested on the Consultant Authorization form. Assumptions for the proposed scope of services are summarized below. Assumptions • The City will coordinate necessary access permission to the subject property, and the applicant will provide necessary access permissions to offsite properties, as necessary. • Onsite soil sampling test pits, if necessary, will be excavated by hand for comparison with conditions noted in the documents provided (attached). • Written responses to the original submitted documents and one iteration of resubmitted/ corrected documents will be provided in technical memorandum format. • A draft version of LAI's Third -Party Review technical memorandum will be provided for City review. A final version will be provided after addressing/incorporating City comments, as appropriate. • A meeting with the applicant's biologist, if requested, will occur at the time of LAI's initial site visit; costs for this meeting are included with this cost estimate. LAI's scope of services does not include delineation of waterways or wetlands. The estimated cost for the scope of services is $6,481, which consists of up to $4,752 for review of the initial application materials and up to $1,729 for review of revised documents, if necessary (see attached table). If project requirements change, or unforeseen conditions are encountered, that require services beyond the scope outlined above, LAI will bring these to the City's attention and seek approval for modification to the scope of services and budget, as appropriate. LAI will not exceed the total estimated cost for our services without prior authorization from the City. This letter summarizes the findings of the study and details applicable federal, state, and local regulations. The following documents are enclosed: • Wetland Reconnaissance Field Sketch ■ Wetland Determination Data Forms Findings Summary No wetland or streams were identified on the subject property. Aerial photographs show a ponded area to the east of the subject property. King County maps a stream associated with the ponded area. The ponded feature is the Belmor Regional Detention Facility, constructed by the City of Federal Way in 1998. No above -ground stream channel is present (or appears to have historically been present) near the subject property. These features would not likely be regulated according to the Federal Way Municipal Code. Pileated woodpecker, a state priority species, utilizes on -site habitat. Methods Public -domain information on the subject properties was reviewed for this reconnaissance study. Resources and review findings are presented in Table 1 of the "Findings" section of this letter. The subject property was evaluated for wetlands using methodology from the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Western Mountains, Valleys, and Coast Region Version 2.0 (U.S. Army Corps of Engineers 2010), as required by local, state, and federal regulations. Wetland presence or absence was determined on the basis of an examination of vegetation, soils, and hydrology. Characterization of climatic conditions for precipitation in the Wetland Determination Data Forms were determined using the WETS table methodology (USDA, NRCS 2015). The "Seattle Tacoma Intl AP" station from 1981-2010 was used as a source for precipitation data thttp://agacis.rcc-acis.org/). The WETS table methodology uses climate data from the three months prior to the site visit month to determine if normal conditions are present in the study area region. Findings The subject property is located in the Hylebos Creek drainage basin in the Puyallup Watershed, within the Puyallup -White River Water Resource Inventory Area (WRIA 10); Section 16 of Township 21N, Range 4E of the Public Land Survey System. Reviewed public -domain information on the subject property is summarized in Table 1 below. Additional publications relevant to the off -site detention pond reviewed and referenced are listed at the end of this report. The subject property contains several well-worn footpaths, homeless encampments, and garbage piles. An old building foundation is present on the west side; the site is otherwise undeveloped. Surrounding land use is residential and commercial. A golf course abuts the parcel on the east side. Aerial photographs and King County iMap show an open water pond and an associated stream on the golf course. No wetlands or streams are present on -site. It was created by the City of Federal Way in 1998 as a detention and water quality facility (City of Federal Way 2019) and is known as the Belmor Regional Detention Facility (Herrera 2013). Construction of the detention facility is apparent when comparing aerial imagery from 2000 and 1998 (Figure 1). Prior to construction, no wetland or stream features are visible in aerial images dating back to 1936 (Figure 2). The Belmor Regional Detention Facility was distinguished from jurisdictional wetlands in the same basin in Herrera's basin assessment and modeling analyses, which described the basin as containing "a series of interconnected natural wetlands, two regional detention ponds, and several smaller detention ponds and vaults distributed across the basin' (2013). This document also characterizes the outflow from the Belmor Regional Detention Facility as "an adjustable sluice gate that changes the storage capacity of the facility seasonally to better accommodate flow control demands in the basin" (Herrera 2013). No current or historic above -ground channels (or wetlands) are present in the vicinity of the subject property, adjacent to the Belmor Regional Detention Facility (Figures 1 and 2). Water exiting the detention pond may support steam flow elsewhere in the basin. Figure 1. Wetland, Stream & Habitat Report Pacific Ridge Project Updated December 2019 Page 5 Wildlife Habitat On -site habitat consists of forested vegetation that includes some mature conifer trees. The forest canopy is a mix of coniferous and deciduous tree species dominated by Douglas -fir, western red cedar, bigleaf maple, red alder, black cottonwood, and bitter cherry. Trees comprising the canopy were generally estimated to be between 12 and 25 inches in diameter at 4.5 feet from the ground (DBH) on average; however, several very large conifers are also present that exceed 30 inches DBH. The forest canopy consists of mostly a closed (>/= 70 percent cover), single story. The understory is disturbed and non-native and noxious weeds are prevalent in many areas. Where understory vegetation has not been trampled or removed, common species include Himalayan blackberry, invasive knotweed, beaked hazelnut, osoberry, English ivy, and sword fern. A complete list of observed native and invasive plants are listed by strata in Table 2 below. Special habitat features including standings snags and large downed logs are present throughout the site. Evidence of pileated woodpecker foraging was noted on one snag. The intensive use by transient people on the site and surrounding urban land uses combined with the lack of aquatic habitat features is expected to preclude use of the site by state- or federally listed species. Based on foraging sign, pileated woodpecker, a state priority species, utilizes the habitat available on -site occasionally. Table 2. On -site vegetation by strata. Wetland, Stream & Habitat Report Pacific Ridge Project Updated December 2019 Page 7 Local Regulations Wetlands, streams, and fish and wildlife habitat conservation areas (FWHCA) in the City of Federal Way are regulated under Federal Way Municipal Code (FWMC), Chapter 19.145 — Environmentally Critical Areas. While the Belmor Regional Detention Facility would likely meet wetland criteria with respect to vegetation, soils, and hydrology, it does not meet the City's definition of a wetland. Per FWMC 19.05.230 (bold emphasis added): "Wetland" or "wetlands" means areas that are inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs, and similar areas. Wetlands do not include those artificial wetlands intentionally created from nonwetland sites, including, but not limited to, irrigation and drainage ditches, grass -lined swales, canals, detention facilities, wastewater treatment facilities, farm ponds, and landscape amenities, or those wetlands created after July 1, 1990, that were unintentionally created as a result of the construction of a road, street, or highway. Wetlands may include those artificial wetlands intentionally created from nonwetland areas to mitigate conversion of wetlands. Additionally, artificially created detention facilities are exempt from the provisions of Chapter 19.145 — Environmentally Critical Area, per FWMC 19.145.110(3) as follows: (3) Development involving or near artificially created wetlands or streams intentionally created from non -wetland sites, including but not limited to grass -lined swales, irrigation and drainage ditches, detention facilities, and landscape features, except wetlands, streams, or swales created as mitigation or that provide habitat for salmonids. The facility appears to have been created from a non -wetland site and was not a mitigation project. Based on aerial photos, the detention facility is not located within or adjacent to the channel of an historic stream feature. The Belmor Regional Detention Facility is not known to provide habitat for salmonids. However, the facility drainage system does meet the physical criteria to support potential fish use (WDFW n.d.). Current fish use is likely precluded by numerous infrastructure barriers present between the Belmor property and South 348t" Street. Finally, water quality conditions of the detention facility — should salmonids have access — are not expected to provide suitable habitat conditions. Therefore, the off -site detention facility would be exempt from the provisions of Chapter 19.145 and there would be no critical area buffer that encumbers the subject property. Wetland, Stream & Habitat Report Pacific Ridge Project Updated December 2019 Page S Fish and Wildlife Habitat Conservation Areas FWHCAs include state priority habitats and areas associated with state priority species. The site has not been identified as a priority habitat by Washington State Department of Fish and Wildlife (WDFW). However, it does appear to be used by pileated woodpecker, a state priority species. Pileated woodpecker are closely associated with mature forest habitats. However, the species is known to utilize more urban environments where large trees and standing stags are present. The subject property provides good foraging habitat for pileated woodpecker. However, existing disturbance on and surrounding the property detracts from the site's nesting potential. Habitats that have a primary association with a sensitive species receive the following special protection measures (FWMC 19.145.400): (1) No development shall be allowed within a habitat conservation area or buffer where state or federally endangered, threatened, or sensitive species have a primary association, except that which is provided for by a management plan established by Washington Department of Fish and Wildlife or applicable state or federal agency. (2) Whenever activities are proposed adjacent to a habitat conservation area where state or federally endangered, threatened, or sensitive species have a primary association, such area shall be protected through the application of protection measures in accordance with a critical area report prepared by a qualified professional and approved by the city. Approval for alteration of land adjacent to the habitat conservation area or its buffer shall not occur prior to consultation with the Washington Department of Fish and Wildlife and other appropriate federal or state agencies. The FWMC does not provide a definition for the term "primary association' in this context. Evidence of foraging may or may not constitute a primary association. The foraging sign that was observed was located on one snag only. Woodpecker use of the snag was apparent, but not remarkably extensive (Figure 3). Furthermore, observed excavations did not appear to be recent. A number of snags were noted on -site which did not exhibit signs of woodpecker use. It is The Watershed Company's opinion that these observations do not constitute a primary association between pileated woodpecker and on -site habitat; use is too limited and infrequent. However, there is certainly potential for pileated woodpecker to use (or increase use of) the habitat available, based upon the vegetative structural conditions and special habitat features present at the site. Given the potential for pileated woodpecker use of the site, incorporation of WDFW's Pileated Woodpecker Management Recommendations (WDFW 2005) in project design is encouraged, although likely not required at this time.
