Dear Mr. Sary:
The City of Federal Way's Planning Division has completed an administrative land use review of the
proposed modification at the above -mentioned address to convert two parking stalls into a handicap van
accessible stall and a 25' sloped pathway to increase ADA accessibility. The Department of Community
Development hereby conditionally approves the Process I application.
Conditions
Construction of sloped pathway and handicap stall must meet all Building Division recommendations
found in the comments below.
Planning Division Findings
The subject property has 194 units and 284 parking stalls. Per FWRC 19.205.040, 330 parking stalls is the
minimum required (1.7 required stalls x 194 units). The property is deficient 46 stalls and is thereby
nonconforming with parking regulations. Per FWRC 19.30180, increasing nonconformance is prohibited.
While this proposal will result in the net loss of one parking stall and increase nonconformance, the
Department of Community Development has determined that the accessible ramp depicted in your land
use application is permissible under the reasonable modification provisions of the Americans with
Disabilities Act (ADA). In researching the proposal, staff identified that under the ADA, Subpart B of the
General Requirements, Part 35, Section 130, Paragraph (b)(7), public entities may make reasonable
modifications in policies, practices, or procedures where necessary to avoid discrimination on the basis of
disability.
Building Department Comments
• ADA parking shall meet minimum standards per 2009 ANSI 1171. Section 501.
• Access aisle shall be minimum 5' wide and extend the full length of the parking space.
• Access aisle shall be marked so as to discourage parking in them.
• The slope of the parking surface and access aisle shall be 1:48 maximum.
• Accessible parking stall shall be identified by a sign and the sign shall bear the International Symbol
of Accessibility. Such signage shall be minimum 60" from the floor of the parking space measured to
the bottom of the sign.
• Walking surfaces shall comply with 2009 ANSI 117.1 section 403 and have a running slope not
steeper than 1:20 slope with a maximum cross slope of 1:48.
• The clear width of a walking surface shall be 36" minimum.

Scope:
We will extend the existing concrete pathway in order to access the parking lot. A curb ramp will
be placed where the curb is to be removed and the parking space converted to a designated aisle. The
parking spot to the right of the aisle as pictured will be converted to s designated handicap parking
space. The parking spaces will be labeled with paint and the required handicap sign posted in front of
the parking space on a post.
The concrete pathway will meet ADA code requirements for size and slope. The goal will be to have no
section over a 1:20 rise, but certainly no more than a 1:12 slope for the rise. There will be less than
2000sq ft of concrete added and we will reduce the slop of the pathway as much as possible. Subase will
be compacted gravel and rebar/rebar mesh added as needed.
