Dear Ms. Evans:
The Community Development Department has received your request to remove two (2) hazardous trees
behind your fence within Tract A of the Regency Woods Division 1 Plat. The larger tree is leaning on the
fence and has already caused damage to the fence. The smaller tree is also leaning and has potential to fall
on the fence. City staff conducted a site visit on December 8, 2015, to verify the condition of the trees.
According to the plat, Tract A is a Native Growth Protection Easement (NGPE) to be owned and
maintained by the Regency Woods Homeowner's Association (HOA). Note # I of the' Regency Woods
Division 1 plat states, "The vegetation within the easement may not be cut, pruned, covered by fill,
removed or damaged without express permission from King County, which permission must be obtained
in writing from the King County Building and Land Development Division or its successor agency"
("successor agency" is City of Federal Way).
Also, per the City's critical areas map, it appears the trees are located within 200 feet of a wetland.
Pursuant to Federal Way Revised Code (FWRC) 19.145.120(7), vegetation maintenance such as hazard
tree removal, requires written approval by the director after a vegetation maintenance plan prepared by a
certified arborist or registered landscape architect be submitted and reviewed. However, due to the
immediate danger of property and verification of damage already caused by the tree, the vegetation
maintenance plan requirement is waived. If you are granted permission by the HOA, the department
hereby approves the removal of the two hazardous trees.
This administrative decision shall not waive compliance with future City of Federal Way codes, policies,
and standards relating to this site. If you have any questions regarding this letter, please contact Becky

Hello Isaac,
I left a voice mail with you earlier this afternoon regarding a tree in the greenbelt adjacent to our property having fallen on our fence.
Attached is a photo of the status of the tree since the latest wind storm that came through last night. While I understand that the trees
are in a protected wetland I believe this tree and the tree next to it have reached a point when they need to be cut down.
I will give you another call soon as I am particularly concerned about the larger tree causing damage or injury.
