You have asked for the City's response as to whether one of the following uses would be allowed based on historical records that have been provided. 1. Two single family units upstairs, two offices downstairs and the detached building as office space. 2. Four single family units (two upstairs and two downstairs) and the detached building as office space. In the letter provided you noted that it has been difficult to locate information on this property but you were able to get records from the Assessor's Office. Based on the information you provided, converting the building into four units would not be allowed. The Assessor's records may state the building was converted into four units; however, the Assessor's records do not rnean the building was converted legally at the time. A building permit is the only way to determine the units were converted correctly and legally. Since a building permit for the four-plex conversion has not been found, we will have to assume it was done illegally. The City would allow the use to be converted back to two apartment units upstairs, two offices downstairs, and the detached building as an office space. Most recent City records indicate that we issued a business license for Mr. Rocz's jewelry repair shop on the first floor, knowing two apartment units were located upstairs. Therefore, we would allow commercial/office use on the first floor and the apartments can remain on the second floor. Federal Way Revised Code (FWRC) 19.220.050, Multi-zrnit housing, does allow apartment units above office or retail uses. However, it appears the building is a nonconforming development and does not meet the minimum floor -to -ceiling height requirements of 13 feet. Any plans to expand/add-on to the building will be required to meet FWRC 19.30.090, NonconfortningDeveloprnent, requirements. Specifically, all nonconforming aspects of a development must be brought into confonnance if: • An applicant proposes to add to the subject property either 2,500 square feet of new gross floor area or more, or 25 percent of the gross floor area or more of the building(s) on the subject property, whichever is less, within any consecutive 36-month time period commencing at the time of building permit issuance. 33325 8th Avenue South, Federal Way, WA 98003-6325 (253) 835-7000 www.cityoffederalway.com Mr. Navle February 26. 2016 Page 2 The building can be converted back to the historical use as described in #1 as long as the nonconforming thresholds above are not exceeded. FEB 0 4 2016 CITY OF FEDERAL WAY CDS Thank you for taking the time to review this property and helping us to solve issues with the building. The owner of the property,Larry Rocz,past away in 2015 and the executor for the estate has been working with me, Tad Navle (agent), to sell the property. In 2015 one of the tenants of the building made a complaint to the City of Federal Way that work was completed on the building without permits. My understanding is that building inspectors came out to the property and did a walk through. In the research of the property the building inspectors didn't see permits for the conversion to a 4 plex in the main building. They also didn't know what work was completed by the owner. At this point the City of Federal Way had the estate vacate the building and it has been sitting vacant ever since. So we started working hard on the research. It is hard to find information on a property when there are few records available. I went to King County to find permits. They have no building records prior to 1971. 1 went to L&I to see about the power boxes that are installed. They only keep records back 7 years. I went to the fire department and they had limited information. Finally we went to the Tax Assessor's office. This is where we got the answers. I have attached the records as addendum for your review_ What we are looking for is to have a formal response that allows the use of the building in one of its historical uses in its current condition. a) As two single family units upstairs, two offices downstairs and the detached building as office space b) As 4 single family rental units and the detached building as office space The history of the building shows both of these uses. It looks to me like option A is the most likely use to be approved since his last true use of the building from 1995 to 2015 was with one office downstairs and three SFR plus the detached building. Larry purchased the property in early 1995. 1 have attached documents that show his correspondence with the City and Federal Way. It looks like he installed a security gate on unit A that was not accepted as being to code in 1997. Larry used the property as three SFR units with one office in the main building with the detached being used as office or SFR. We do understand the historical use of the detached building has been as office space for many years and have no records of it being used for residential. The repairs Larry made prior to death was new carpet, paint, surface updating of the kitchen/baths in the downstairs units. Larry was cleaning up the property to have it ready to sell as he was very aware of his pending death. We see nothing to believe that work requiring permits was completed.
