Dear Mr. Navle:
The City of Federal Way's Community Development Department received your request for an
administrative decision. You have asked for the City's response as to whether one of the following uses
would be allowed based on historical records that have been provided.
1. Two single family units upstairs, two offices downstairs and the detached building as office space.
2. Four single family units (two upstairs and two downstairs) and the detached building as office space.
In the letter provided you noted that it has been difficult to locate information on this property but you
were able to get records from the Assessor's Office. Based on the information you provided, converting
the building into four units would not be allowed. The Assessor's records may state the building was
converted into four units; however, the Assessor's records do not rnean the building was converted legally
at the time. A building permit is the only way to determine the units were converted correctly and legally.
Since a building permit for the four-plex conversion has not been found, we will have to assume it was
done illegally.
The City would allow the use to be converted back to two apartment units upstairs, two offices
downstairs, and the detached building as an office space. Most recent City records indicate that we issued
a business license for Mr. Rocz's jewelry repair shop on the first floor, knowing two apartment units were
located upstairs. Therefore, we would allow commercial/office use on the first floor and the apartments
can remain on the second floor.
Federal Way Revised Code (FWRC) 19.220.050, Multi-zrnit housing, does allow apartment units above
office or retail uses. However, it appears the building is a nonconforming development and does not meet
the minimum floor -to -ceiling height requirements of 13 feet. Any plans to expand/add-on to the building
will be required to meet FWRC 19.30.090, NonconfortningDeveloprnent, requirements. Specifically, all
nonconforming aspects of a development must be brought into confonnance if:
• An applicant proposes to add to the subject property either 2,500 square feet of new gross floor
area or more, or 25 percent of the gross floor area or more of the building(s) on the subject
property, whichever is less, within any consecutive 36-month time period commencing at the
time of building permit issuance.

The building can be converted back to the historical use as described in #1 as long as the nonconforming
thresholds above are not exceeded. Be advised that improvement to the building, even interior tenant
improvements will require permits from the Building Division. Please contact the Permit Center at 253-
835-2607 or permitcenter a.cityoffederalway.com, for necessary permits. This letter is informational only
and does not authorize any improvement work to the building or property. If you have any questions

Thank you for taking the time to review this property and helping us to solve issues with the
building. The owner of the property,Larry Rocz,past away in 2015 and the executor for the
estate has been working with me, Tad Navle (agent), to sell the property.
In 2015 one of the tenants of the building made a complaint to the City of Federal Way that work
was completed on the building without permits. My understanding is that building inspectors
came out to the property and did a walk through. In the research of the property the building
inspectors didn't see permits for the conversion to a 4 plex in the main building. They also didn't
know what work was completed by the owner.
At this point the City of Federal Way had the estate vacate the building and it has been sitting
vacant ever since.
So we started working hard on the research. It is hard to find information on a property when
there are few records available. I went to King County to find permits. They have no building
records prior to 1971. 1 went to L&I to see about the power boxes that are installed. They only
keep records back 7 years. I went to the fire department and they had limited information.
Finally we went to the Tax Assessor's office. This is where we got the answers.
I have attached the records as addendum for your review_
What we are looking for is to have a formal response that allows the use of the building in one of
its historical uses in its current condition.
a) As two single family units upstairs, two offices downstairs and the detached building as
office space
b) As 4 single family rental units and the detached building as office space
The history of the building shows both of these uses. It looks to me like option A is the most
likely use to be approved since his last true use of the building from 1995 to 2015 was with one
office downstairs and three SFR plus the detached building.
Larry purchased the property in early 1995. 1 have attached documents that show his
correspondence with the City and Federal Way. It looks like he installed a security gate on unit A
that was not accepted as being to code in 1997.
Larry used the property as three SFR units with one office in the main building with the detached
being used as office or SFR. We do understand the historical use of the detached building has
been as office space for many years and have no records of it being used for residential.
The repairs Larry made prior to death was new carpet, paint, surface updating of the
kitchen/baths in the downstairs units. Larry was cleaning up the property to have it ready to sell
as he was very aware of his pending death. We see nothing to believe that work requiring
permits was completed.

After purchasing my building at 31101 18th ave So, Federal Way Wa, I had go -roved and inspmted
chances Nerformed prior to moving in Among these was a steel gate over the front entrance door which
ipMted pns approvedthe City of Federal Way lam in the Jewelry manufacturing business
(wholesale) closed to the public
Approximately one year later Mr Gordon Goodsell, Fire Prevention Specialist, Federal Way Fire
Department, informed me that we needed to install automatic electronic door unlock system from the
inside This was done by my alarm company, cost $450 00 (Security Lmk/Amentech) Mr Goodsell told
me at that time that thus is all that would be needed to be in compliance with codel Two months later Mr
Goodsell arrived again and informed me that it Federal Way Fire Department Key Box had to be installed,
with my iron gate key as well, as my front door key, inside of it I purchased the lock box, cost $50 00,
had it installed, cost $250 00 He again said thus is all that would be needed Not so three months later
he informed me that the already approved and inspected iron gate over my front door, may not be
acceptable and the building inspector would have to approve it I asked for copy of the code, I received a
typed interpretation of same and code did not apply directly to my situation
I then showed the Federal Way Building Inspector and Mr Goodsell the alarm system key pad The
alarm will not set if anyone is in the building, at this time this was their concern I contacted both of my
Insurance company's, American States Insurance and Jewelers Mutual to get their opinions about this,
they told me not to change anything about my iron gate as it would affect my insurance and possibly
cancell it
I then contacted The King County Crime Prevention Bureau, they came to my business and also told me
not to change my iron gate
I have been doing busines with Ben Bridge and Zales Jewelers to name a few for 25 years covering 5
states, both of these businesses have locked down iron grille gates and they do not have to have any
emergency releases I have contacted the Vice Preseident of Ben Bridge Jewelers with 64 stores in 5 states
and Hawaii, asked hun if they are required to have emergency releases for their iron gates, the answer was
NOI
Why should I be directed to be different, by the Federal Way Fire and Building Departments?
If the gate was put inside the building I would have to move the built-in counter 12-15" which would
block an existing doorway used for exiting the building creating more problems, block fire exit and be
another great unecessary expense -

On May 2, 1997, a Notice and Order to either remove or reconfigure the security gate at the front
entrance to your facility was issued The Notice & Order set a deadline of 60 days to comply In the
interim, you spoke with Interim Building Official Jim Chandler His September 30, 1997, letter in response
to your questions regarding; exiting standards in the Uniform Building Code (U13C) is enclosed for your
reference To reiterate, the requirement that exits be capable of being opened without special knowledge
(UBC 404 4 8) were added to the 1994 UBC This was done in response to tragedies which occurred
when gates similar to yours did not function properly as exits during a fire
This matter has also been reviewed with the city's new Building Official, Mary Kate Gamglto She has also
confirmed the gate must be removed or reconfigured to meet the exiting requirements of the UBC This
letter is sent as notice the matter will be referred to the City Prosecutor for review and citation at the end
of April The case file will be closed and the matter considered resolved if appropriate corrections are
made prior to Thursday, April 30, 1998 This will require the exit door be inspected by the City of Federal
Way Building Division to confirm the appropriate changes have been made

1994 Uniform Building Code which creates the requirement The City adopted and has been
enforcing this code since July 1, 1995 by state mandate

would probably explain why your friends in the business have not been asked to comply This code
change was prompted by deaths in Southern California, in the early 1990's, by bars or gnlles
installed that did not function as an exit door during a fire
