Earth Solutions NW, LLC (ESNW) is pleased to present this report titled "Geotechnical
Engineering Study, Proposed Boundary Line Adjustment, 43XX Southwest Dash Point Road,
Federal Way, Washington". Based on the results of our investigation, the proposed residential
development is feasible from a geotechnical standpoint. Our study indicates the site is underlain
primarily by advance outwash and transitionary glacial till deposits. During our subsurface
exploration completed on June 28, 2017, groundwater seepage was not encountered at the test
pit locations_ Nonetheless, it is our opinion the contractor should be prepared to discrete zones
of groundwater seepage during construction.
In our opinion, the proposed residential structures may be constructed on conventional
continuous and spread footing foundations bearing upon competent native soil, recompacted
native soil, or new structural fill. In general, competent native soil suitable for support of
foundations will likely be encountered within the upper two to three feet of existing grades. Where
loose or unsuitable soil conditions are exposed at foundation subgrade elevations, compaction
of soils to the specifications of structural fill, or overexcavation and replacement with suitable
structural fill, will be necessary.
At this time, given the predominance of relatively clean sands across the site, infiltration ma be
feasible from a geotechnical standpoint. Final site designs and/or grading plans, however, may
affect infiltration feasibility. With respect to the existing topography, base elevations of proposed
infiltration facilities should be designed so that stormwater does not infiltrate either into a
geologically hazardous area (GHA) or onto adjacent properties. The in -situ density of the native
sands should also be considered, as dense soils typically have a reduced infiltration capacity.
ESNW can provide further evaluation of, and recommendations for, stormwater infiltration design
and related feasibility during the appropriate phase of design.

Based on our field observations and testing, we recommend a 15-foot buffer be incorporated into
the puns. The buffer should be measured from the top of the steep slope (see Plate 2 for an
approximate delineation). In addition, we recommend a five-foot structural buffer setback feet be
incorporated into final designs. The structural buffer setback should be measured from the edge
of the GHA buffer.

4. Page 5 of the Earth Solutions NW report, revised Apri19, 2018, identifies the subject properties as
landslide hazard areas. Whereas, the April9, 2018 CES response letter states 'the site is not located within a
Landslide Hazard Area'. This is incorrect. As such, the properties are designated as landslide hazard areas and
a 50 ft. buffer measured from the edge of the landslide hazard area boundary shall be depicted per FWRC 19.
145.230. No third party review occurred at the time of this BLA review.
As a condition of approval, building permits on Parcel A (parcel # 112103-903 8) shall be subject to third
party review by the city's on -call consultant (at the expense of the applicant) in order to determine the extent
and classification of geologically hazardous area on site and appropriate buffer. The applicant may be
required to conduct test pits in the northern portion of the site to confirm the extent of the landslide hazard
area.

As a condition of approval, site plans submitted as part of a building permit shall include and
delineate all critical areas with their associated buffers and building setbacks. The applicant must
record a notice on title with the King County Recorder's office depicting the city approved buffer.l
Landslides have occurred along SW Dash Point Road, north of this site in 2018 and 2017.
FWRC 19.145.230(4) indicates, "Buffers and setbacks may be reduced ... when a qualified professional
demonstrates to the director's satisfaction that the improvements will not lead to or create any increased slide
hazard..."
ESNW in their Executive Summary, pages 1 and 2 of their updated Geotech Report dated April 9, 2018 state
they recommend a 15-foot buffer be incorporated into the plans. The buffer should be measured from the top of
the steep slope.
We have shown the 15-foot buffer on the BLA plans noted as "Landslide Hazard Buffer", and also incorporated
a 5-foot-structural setback also shown on the plan. I believe this addresses the issue per the code.

In order to proceed and get this BLA approved, it appears a geotechnical comments in my letter were not answered per
my discussion with your surveyor.
If you would like to stick with a 15 ft. landslide hazard -buffer the report must be peer reviewed and signed off by our on
call consultant per FWRC 19.145.080. If you do not peer review the report, the BLA will remain on hold. The landslide
hazard area must be distinguished from the other sloped areas. Landslide hazard areas on recorded documents included
BLA at the city are typically cross -hatched (something different on the legend), this does not apply to erosion hazard
areas. On short plats etc. all landslide hazard areas and buffers, except those subdivision utilizing lot size average
methods are required to put landslide hazard areas in a tract.
I cannot approve the BLA at this time until the landslide hazard area buffer is shown or a contract is made for our on call
to review the proposed buffer width and approve a reduced standard buffer. It is not clear where the landslide hazard
area ends and begins. Please see the attached BLA as an example of what the city expects. Providing the 50 ft. buffer
from the edge of the landslide hazard area and deferring the peer review to the construction plans is what can be
permitted at this time without a peer review.
Do note out code has changed since 2015 and CES's involvement in the Soundview Manor Plat. There have been several
substantial landslides in close proximity to this property along Dash Point Rd.
I hope we can proceed with showing the 50 ft. standard landslide buffer to get this BLA recorded, you will be able to
build within this if at the time of the construction permits the structural plans and geotech. report are peer reviewed at
the applicant's expense.

2. Find the enclosed BLA drawing redlines. The legend symbols remain unclear (clearly differentiate
between the wetland, wetland buffer, edge of the landslide hazard area, landslide hazard area buffer,
contour lines and stream edge etc.). The `stream' and `top of slope' look very similar. You may need
to provide a scaled inset drawing.
3. Depict the standard 50-foot landslide hazard buffer on the BLA. In order to depict a reduced buffer of
15 feet, third party review is required at the expense of the applicant prior to BLA approval and
recording. If you choose this route, the city's consultant must concur with your engineer's
recommendations. Alternatively, the standard 50-foot buffer may be depicted and the report peer
reviewed at the building permit.
4. A $1,600.00 environmental review fee remains outstanding (enclosed). A peer review of the Habitat
Technologies report by the city's consultant was required by Planning per FWRC 19.145.080. Staff
reviewed the submitted report and supporting site plan showing a wetland and stream and determined
a third party review was required. The city cannot issue the BLA approval until review fee payment.

standard 50 ft. landslide hazard area buffer per FWRC 19.145.230.1.
A landslide hazard area buffer may be reduced, at the discretion of the director. However, the width
of the buffer shall reflect the sensitivity of the landslide hazard area and the types and density of uses
proposed on or adjacent to the hazard (FWRC 19.145.230.3). At this time, the scale and impact of
future site improvements are unknown.
Per correspondence dated February 8, 2018, a peer review deposit remains outstanding to commence
a third party review to confirm the stream location shown. You may pay by phone to the Permit
Center at 253-835-2607 with a signed task authorization. Any unused fees will be refunded to the
applicant. The stream buffer is depicted as a straight line and no ordinary high water mark (OHWM)
is noted. Stream buffers, typically, are not straight (it is unclear if a biologist surveyed the site). The
BLA application will remain on hold until the city's consultant, Perteet, verifies the applicant's
waterway delineation'. The city's critical areas ordinance was updated in June of 2015 and prior
stream classifications are no longer valid.
a. Per FWRC 19.145.070 `critical area reports may be reviewed by the city's third party
consultant at the applicant's expense'.
b. Further, FWRC 19.145.070(1) states, `the actual presence/absence, type, extent, and
boundaries of critical areas shall be identified in the field by a qualified professionaP
according to the procedures and criteria established in this chapter [FWRC 19.145
`Environmentally Critical Areas]. 'The stream and stream OHWM must be accurately shown
on the documents recorded with King County.
c. Depict a 5 ft. BSBL from buffer. At the time of the building permit, a builder would be
required to install permanent and durable critical area signage in crushed rock. Staff will
confirm installation via an affidavit and site pictures before occupancy.
CLOSING
Once the revisions listed above are made, provide two (2) paper copies of the BLA document with the
enclosed resubmittal form for staff review to the City of Federal Way Permit Center.
Pursuant to FWRC 18.05.080, if an applicant fails to provide additional information to the city within 180
days of being notified that such information is requested, the application shall be deemed null and void
and the city shall have no duty to process, review, or issue any decisions with respect to such an
application.
' FWRC 19.05.150 states: `In any stream where neither mark nor mean high water can be found, the channel bank shall be
substituted. In braided channels and alluvial fans, the ordinary high water mark or substitute shall be located so as to include the
entire stream feature.'
2 FWRC 19.105.170.1 states: a "Qualified professional" means a person with experience and training in the pertinent scientific
discipline, and who is a qualified scientific expert with expertise appropriate for the relevant critical area subject in accordance
with WAC ; 1.t% ~(4). A qualified professional must have obtained a B.S. or B.A. or equivalent degree in biology,
engineering, environmental studies, fisheries, geomorphology, or related field, and two years of related work experience.
(1) A qualified professional for habitats or wetlands must have a degree in biology and professional experience related to the
subject species.

1. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the public
records or attaching subsequent to the effective date hereof but prior to the date the proposed insured acquires
for value of record the estate or interest or mortgage thereon covered by this Commitment.
2. Any facts, rights, interests, or claims that are not shown by the Public Records but that could be ascertained by
an inspection of the Land or that may be asserted by persons in possession of the Land.
3. Any rights, interests or claims of parties in possession not shown by the public records_
4. Any lien, or right to a lien, for services, labor, materials or equipment in connection with improvements, repairs or
renovations provided before, on, or after Date of Policy and not shown by the Public Records at Date of Policy.
5. Any encroachment, encumbrance, violation, conflict in boundary line(s), shortage in area, or adverse
circumstance affecting the title that would be disclosed by an accurate and complete land survey and/or physical

CONDITIONS
The term mortgage, when used herein, shall include deed of trust, trust deed, or other security
instrument.
2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse
claim or other matter affecting the estate or interest or mortgage thereon covered by this Commitment
other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to the
Company in writing, the Company shall be relieved from liability for any loss or damage resulting from
any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such
knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the
Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim
or other matter, the Company at its option may amend Schedule B of this Commitment accordingly,
but such amendment shall not relieve the Company from liability previously incurred pursuant to
paragraph 3 of these Conditions.
Liability of the Company under this Commitment shall be only to the named proposed Insured and
such parties included under the definition of Insured in the form of policy or policies committed for and
only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the
requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create
the estate or interest or mortgage thereon covered by this Commitment. In no event shall such liability
exceed the amount stated in Schedule A for the policy or policies committed for and such liability is
subject to the insuring provisions and Conditions and the Exclusions from Coverage of the form of
policy or policies committed for in favor of the proposed Insured which are hereby incorporated by
reference and are made a part of this Commitment except as expressly modified herein.
4. This Commitment is a contract to issue one or more title insurance policies and is not an abstract of
title or a report of the condition of title. Any action or actions or rights of action that the proposed

are subject to the provisions of this Commitment.

Dear Mr. Deaver:
The City of Federal Way's Community Development Department is in receipt of your December 29,
2017, Boundary Line Adjustment (BLA) application and January 12, 2018, resubmittal to adjust the
boundary line between the above -mentioned parcels to create buildable area for future development of a
single family residence. The site contains critical areas: a stream and geologically hazardous areas, as
well as both landslide and erosion hazard per the applicant's geotechnical report prepared by Earth
Solutions NW, LLC (dated July 25, 2017).
Pursuant to Federal Way Revised Code (FWRC) 18.10.040, within 28 days of receiving a BLA
application the city shall determine whether all information and documentation required for a complete
application has been submitted.
NOTICE OF COMPLETE APPLICATION
Please consider this correspondence as a Notice of Complete Application. The application is deemed
complete as of January 26, 2018, based on a review of your submittal relative to those requirements as
set out in FWRC 18.10.030. The submittal requirements are not intended to determine if an application
conforms to the City of Federal Way codes; they are used only to determine if all required materials have
been submitted.

2. Please find BLA drawing corrections enclosed.
3. Drawing Requirements — Please show the location of environmentally critical areas and their
buffers. The city is in receipt of a critical area site plan dated January 12, 2018.
a. Per FWRC 19.145.490(5), your stream delineation and mapping is subject to third party review
by Perteet, the city's consultant, at the expense of the applicant. The city forwarded Perteet

your application materials. A task authorization, quote (approximately $2,400.00) and invoice
will follow under separate cover; please sign and return the original to the city along with
payment.
Perteet will perform a field verification confirming the mapped location of the stream and stream
buffer and a follow-up memo as to whether they concur or do not concur with the applicant's
materials. They will also ensure there are no other critical areas on site associated with the stream,
such as fringe
wetlands. Per page 4 of Associate Becky Chapin's preapplication letter, in the case of this BLA
application the following applies:
"If the applicant does not want to delineate and rate the stream at this time, then the max buffer
width of 100 feet must be depicted on a separate exhibit document to make sure the buildable area is
outside the stream buffer. A note must be placed on the drawing that states the stream has not been
delineated as part of this BLA; a critical areas report may be required if any alterations are being
proposed within the stream or stream buffer. "
4. On the BLA drawing clearly depict the `landslide hazard area" with the standard 50-foot buffer from
the edge of the landslide area. Please remove 'I 5-ft. geological hazard buffer'. This is not a standard
buffer within our critical areas code and no specific building or improvements are proposed at this
time. Critical areas shall be shown accurately on recorded documents.
Buffers and setbacks may however be reduced or improvements may be located in a landslide hazard
area when a qualified professional demonstrates to the director's satisfaction that the improvements
will not lead to or create any increased slide hazard or be at risk of damage by the landslide hazard.
5. Please remove references to a short plat in the.geotechnical report.
6. On the BLA depict a 5 ft. BSBL from the edge of the stream buffer once approved by Perteet
(FWRC 19.145.160).
7. Per Associate Planner Becky Chapin's preapplication letter, as a condition of the BLA approval
building permits on tax parcels 112103-9013 and -9038 shall require a geotechnical report, which
will be peer reviewed by the City's consultant at the applicant's expensez. Note this condition on the
BLA drawing.
Please find Planning redlines enclosed with this letter.

10. Fire Flow — A Certificate of Water Availability including a hydraulic fire flow mode13 shall be
requested from the water district and provided at the time of building permit application.
11. Emergency Access — Fire apparatus access roads shall comply with all requirements of Fire Access
Policy 10.006littp:Hsoutlzkiligfire.orgMocumentCenter/HomeNiew/24.
Fire apparatus access roads shall be installed and made serviceable prior to and during the time of
construction.
12. Fire Sprinkler System — Fire sprinkler requirements, if any, will be determined at the time of
building permit application. A fire. sprinkler system on Parcel A may be required as a condition of
any construction.

14. There are existing sewer system facilities on the south side of this portion of SW Dash Point Rd that are
accessible for these parcels. Future development of parcels, regardless of the outcome of the land use
action, will require Lakehaven Sewer Certificate(s) of Availability, and subsequent sewer service
connections.
15. The applicant shall obtain King County Health District approval for private servicing/signed BLA
mylars if applicable prior to BLA recording.

property side pipes have been separated.

18. New water services will be installed by Tacoma Water after payment of the Service Construction
Charge and the Water Main Charge. New meters will be installed by Tacoma Water after payment of
the System Development Charge.
19. Customer is required to obtain private utility easements for any property -side water pipes leading
from the City of Tacoma meter to the building location on any portion(s) of the proposed parcels.
Parcel B will need property side pipe easement to Parcel A.

20. If a new fire hydrant is required at a location with an existing water main, the hydrant will be
installed by Tacoma Water after payment of an installation charge.
21. If existing water facilities need to be relocated or adjusted due to street improvements for this
proposal they will be relocated by Tacoma Water at the owners' expense.
22. Sanitary sewer mains and side sewers shall maintain a minimum horizontal separation of ten feet
from all water mains and water services. When extraordinary circumstances dictate the minimum
horizontal separation is not achievable, the methods of protecting water facilities shall be in
accordance with the most current State of Washington, Department of Ecology "Criteria for Sewage
Works Design".
23. For utilities other than sanitary sewer, the proposed facilities shall have a minimum horizontal
separation of five (5) feet and vertical separation of twelve (12) inches from Tacoma Water facilities.
CLOSING
Formal processing and review of your BLA application will now begin. A full set of technical review
comments from all city departments will follow under separate cover. Please wait until you receive
all comments and resubmit a complete project revision package, in order for the city to streamline
reviews.
A 120-day time line for reviewing the BLA application has started as of this date. The city's development
regulations allow the department 120 days from the date that an application is deemed complete to take
action on the application. However, the 120-day time line can be stopped any time the city requests
corrections and/or additional information.
