You have proposed antenna and ground equipment improvements to an existing Personal Wireless Service Facility (PWSF). Your application is hereby approved per the findings noted below. Be advised, work cannot begin until you receive right-of-way and electrical permits. FINDINGS OF FACT 1. Applicant proposes to add three new Long Term Evolution (LTE) antennas to an existing PWSF on a Puget Sound Energy pole located on right-of-way adjacent to 31031 215t Place SW. Associated ground equipment will be added to an existing equipment enclosure on the above -referenced private property. 2. No material change or expansions are proposed within or surrounding the equipment cabinet and therefore zoning review of such improvements are exempt pursuant to Federal Way Revised Code 19.255.010(3)(g). 3. Existing PWSF location is the second prioritized location. The first prioritized location, BPA trail, is located outside of the needed service area and therefore was not considered. 4. New antenna equipment will increase the overall height of the PWSF from 53.5 feet to 61 feet. 5. Antennas are panel variety measuring eight feet in height. Three panels are needed for upgrade to 4g technology and historical amounts of data traffic in the area. 6. Panel antennas will be painted to match the wood pole and existing facility to mitigate aesthetic impacts. Color matching is a typical method to screen such facilities on utility poles. CONCLUSIONS OF LAW 1. The proposed improvements are not exempt from Use Process review as they do not meet criteria set forth in FWRC 19.15.020, Exceptions. Ms. Ausink Aril 25,-2012 Page 2 2. Process H "Site Plan Review" is the appropriate Master Land Use application as the improvements are to a developed site and exceed thresholds set forth in FWRC 19.15.030(1)(e). Proposed improvements are a material change to the approved architecture due to an increase in number of antennas and the height increase. 3. The proposed improvements are exempt from State Environmental Policy Act review as the scope of work meets categorical exemption WAC 197-11-800(25)(ii), PWSFs attached to an existing structure that is not a residence or school, and located in a commercial zone. 4. The Federal Way Comprehensive Plan and zoning designation for the subject property is Neighborhood Business (BN). Pursuant to FWRC 19.215.100, PWSFs are a permitted use in BN zones. 5. The proposed improvements meet Process II site plan criteria set forth in FWRC 19.60.050 and FWRC Chapter 19.255 `Personal Wireless Service Facilities.' 6. Right-of-way permit approval is required prior to constructing the improvements as the proposed alterations are subject to applicable regulations set forth in FWRC Chapter 4.25 `Rights -of -way.' 7. Electrical permit approval is required prior to constructing the improvements as the proposed alterations are subject to applicable regulations set forth in FWRC Chapter 13.50 `Electrical Code.' APPEALS The effective date of this decision is April 28, 2012. Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by May 12, 2012. Any appeal must be in the form of a letter delivered to the department with the established fee. As the applicant is the only person of record, you may waive your right to appeal in writing to the assigned planner below. The proposed modification consists of adding (3) new LTE antennas and ancillary equipment to the existing PSE utility pole. Proposed modifications do not change the use of the existing utility pole. AT&T proposes to increase the height from 53'-6" to 61'-0". There is no reduction, material change or adverse impact to landscaping, parking, utilities, approved architectural design, or environmentally critical areas as defined by FWRC 19.145. ANALYSIS OF STEALTH SCREENING FOR PROPOSED FACILITY PER FWRC_'19.226.020(4). The modification will not result in a change in visual impact, and is part of a technology upgrade being performed on AT&T/New Cingular Wireless's network, in order to improve service to its customers and strengthen reliability and capacity in its network. Pursuant to FWRC 19.255.020(20, PWSFs shall be screened or camouflaged through employing the best available technology and design. As proposed, the antennas are not overtly obtrusive. The proposed antennas will be painted to match the existing utility pole. The proposed equipment additions are exempt and no review is required as there are no material area expansions of the equipment area. Per the pre -application conference summary (#12-100713-00-PC), the submitted site plans do not need to depict existing landscaping around the existing enclosures. This is an existing wireless telecommunications facility located at the address referenced above. AT&T proposes to amend the facility to keep up with the demand while continuing to offer customers in the area quality service and access to greater and more advanced wireless services. The proposed change would add 4G technology to the site and would expand AT&T's 4G network footprint into and the immediate surrounding area. This proposed change would improve the on -street and in -car availability of 4G services (voice and data support for iPhone 4G phones for example) and would add in -building 4G services in the immediate vicinity of the site. Our current volume and payload data on this site shows a high amount of 3G data traffic. The new 4G technology will improve the overall internet/data experience of the customers in the area. This will mean faster data rate and higher efficiency. The proposed modification is part of an integrated network and if it is located too far or too close to an adjacent facility the network will not work. The location of the site was picked because it is an existing facility. The proposed modification is part of AT&T's network implementation plan to provide 4G LTE coverage in the Federal Way area. There are no alternative sites that would provide the needed height to allow for the proper functioning of the equipment. There are no multifamily, commercial, or industrial structures tall enough to meet the required height coverage for this site. Alternative sites that would provide the needed height coverage would mean that AT&T would need to propose a new wireless tower or utilization of a city light pole and locate its antennas on it or locate on a new multifamily structure and increase its height — these proposals would aesthetically be more detrimental to the neighborhood. A new facility would not be less intrusive than what is being proposed. The proposed location not only will provide the needed coverage for AT&T it will also lead to fewer adverse impacts on adjacent land uses. Here, collocating the replacing the antennas contains the impacts of the additional antennas to a single location, thus impacting fewer properties. In addition, utilizing the existing equipment lease area and ground equipment further reduces impacts to other properties in the area by avoiding duplicate ground installations at multiple locations, eliminating the need for extensive trenching between the existing ground equipment and alternative locations. In addition, the proposed facility is a passive use; there are no activities that will produce airborne emissions, odor, vibration, heat, glare, or noxious/toxic materials. The site will operate continually, 24 hours a day for seven days a week. The site will be unmanned, requiring only frequent visits by maintenance personnel, typically once a month. Due to the limited amount of traffic generated by the proposal, no off -site street improvements are required for this application. The facility will not require water or wastewater facilities or contribute to erosion due to storm water run-off. The construction valuation is $15,000.
