The project was granted Process IV approval on July 6, 2007, and subsequent site plan modification approval on December 12, 2011. A two-year conditional extension to the land use approval was granted until July 7, 2014. Due to the current economic conditions, the applicant has requested a modification to the original site plan approval that will reduce the scope of work to a 672 sq. ft. office and 1,360 sq. ft. garage. Other modifications to the site include revised driveway access, parking layout, landscaping, and stormwater detention area. DECISION The request for site plan modification is hereby conditionally approved. The overall impacts to the site have been reduced with the scaled down design. The modifications are less intrusive than what was approved and were reviewed administratively. There are no changes or increased impacts to the approved stream buffer modification plan. Pursuant to Federal Way Revised Code (FWRC) 19.15.090(3), the modification request is consistent with city codes. CONDITIONS OF APPROVAL- ■ The proposed 6-foot chain -link fence surrounding the property is visible from adjacent properties and shall utilize vinyl -coated mesh, powder -coated poles, dark color(s), and architectural element(s) such as pole caps and/or decorative grid pattern. Prior to building permit approval, please submit chain -link fence details. ■ Conditions regarding stream buffer mitigation, significant tree retention, and landscape plan set forth in the July 6, 2007, Hearing Examiner decision have not all been met and are still applicable. The city's updated response to each condition is italicized below. 1. The stream buffer boundaries established by the final site plan and buffer mitigation/enhancement plan shall be reflected on the applicable construction drawings and permits. This condition has been met. In addition, prior to issuance of a construction permit, the applicant shall provide the City a landscape plan for approval for planting appropriate stream buffer vegetation adjacent to the Mr. Hovland June 13 2013 Page 2 perimeter retaining wall. Installation of the plantings shall be completed prior to issuance of a certificate of occupancy for the vehicle service and tow yard facility. The retaining wall is no longer proposed; however, the buffer mitigation area will remain the same. Please resubmit as part of the building permit application, a stream buffer vegetation planting plan for approval. 2. As required by the Director of Community Development Services, prior to issuance of a certificate of occupancy for the proposed service and tow yard, the applicant shall complete all elements of the proposed mitigation. When the mitigation plan has been approved and planting installed, please contact Becky Chapin, Assistant Planner, at 253-835-2641, for a final landscape/buffer mitigation inspection. As required by the Community Development Director, in order to minimize adverse impacts to the wetland and stream habitat, the applicant shall retain significant trees to the maximum extent possible on the developable portion of the site. As required by the Director of Community Development Services, prior to issuance of a construction permit, the applicant shall submit for the City's review and approval a plan for retention and preservation of significant trees on site. Please revise the landscape plan, sheet LI.0 submitted with the building permit application, to depict the retention and preservation of significant trees. CLOSING This modification. approval does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This approval does not constitute approval of a building permit. The associated commercial building permit is currently under review. A copy of the originally approved site plan is attached for reference. The original name of the project property was Fife Service and Towing. The original project was dropped due to the economic downturn a few years ago. We now propose to develop the site in scaled down manner. The modifications to the site include: • Revised driveway to property ■ Revised site layout and parking s Reduced building size • Revised storm/water treatment — Overall impacts to the site have been lessened dramatically through a more creative grading approach and the fact the project will house a less intense use.
