Boulder Tulsa, OK 74119 RE: File #18-102036-00-UP; PROCESS I `DIRECTOR'S APPROVAL' Walmart Online Grocery Pick -Up, 34520 16`h Avenue South, Federal Way Dear Sunday Bougher: The Community Development Department has completed a review of your Process I Master Land Use (MLU) application to modify fagades and site improvements for a proposed Walmart Grocery Pick -Up area received on May 11, 2018. Your application is hereby approved with conditions pursuant to the conclusions/findings noted below by the Department's Planning Division. CONCLUSIONS Various sections of the zoning and development code indicate that certain developments, activities, or uses are permitted only if approved using Process I — Director's Approval. Based on the findings below, the proposed improvements to the developed site meet the following Process I approval criteria and land use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020: 1. The proposed improvements are consistent with applicable chapters of F)VRC Title 19 including, but not limited to: Permits and Review Processes; Process I — Director's Approval; Community Design Guidelines; Commercial Enterprise; Nonconformance; and General Development Regulations. 2. The health, safety, and welfare of the citizens of the city are preserved. 3. The proposal is a `minor new construction' exempt from SEPA review per the City's flexible thresholds as no new parking spaces or gross floor area is proposed. FINDINGS OF FACT 1. Proposal — Installation of a canopy for covered parking for a new online grocery pick-up area with wall, directional, and parking stall signage on the western fagade of a Walmart Super Center. The applicant proposes to reduce the parking count from 897 to 894 parking spaces and establish eight (8) wider online pick-up parking spaces. 2. Comprehensive Plan & Zoning Designation — The zoning district and Federal Way Comprehensive Plan designation is Commercial Enterprise (CE). The proposed modification to an existing retail use is permitted pursuant to Federal Wary Revised Code (FWRC) 19.240.010. The applicant does not propose a change of use. 3. Environmental Review — The proposed improvements are exempt from environmental review. No new buildings, additional square footage, or parking stalls are proposed. Adjustments to parking lot include the removal of three spaces. Therefore, the improvements are consistent with the State Sunday Bougher June 1, 2018 Page 2 of 3 Environmental Policy Act (SEPA) definition of "minor new construction" as adopted in the city's flexible threshold exemptions in FWRC 14.15.030(1)(c). 4. Parking — Pursuant to FWRC 19.240.070, retail uses must provide 1 parking stall for each 300 square feet of gross floor area. The Walmart Super Center is 203,091 square feet and therefore 677 parking spaces are required. The current parking count at the Walmart Supercenter is 897 parking spaces and the applicant proposes 895 spaces, exceeding the required 677 spaces. The proposed layout also meets minimum stall dimensions outlined in Bulletin #042 Parking Lot Design Criteria. 5. Community Design Guidelines — The proposed retail modification complies with the provisions of FWRC Chapter 19.115, "Community Design Guidelines" that are reasonably related and applicable to the area of development as detailed below. a. Surface Parking Lots — The applicant proposes an enhanced parking and vehicle circulation area that is clearly delineated with directional signage. b. Pedestrian Circulation — One pedestrian walkway is incorporated, from the online pick-up area and the parking lot. The applicant depicts paint striping on the asphalt. Pursuant to FWRC 19.115.050(4)(a)-(b) pedestrian pathways and pedestrian areas should be delineated by separate paved routes using a variation in paved texture and color. Approved methods of delineation include: stone, brick or granite pavers; exposed aggregate; or stamped and colored concrete. As a condition of approval, the proposed pedestrian walkway must comply with FWRC 19.115.050(4)(a)-(b). Paint striping is not an approved method of delineation. c. CE District Guidelines — The proposed fagade modifications are consistent with the minimum requirements in the CE zoning district. The western fagade does not face a public right-of-way or residential use. 6. Fire Protection — South King Fire and Rescue will provide comments at the time of building permit review. CONDITIONS 1. The applicant shall apply for separate sign permits. Please contact the Permit Center at 253-835-2607. 2. The applicant shall maintain a minimum of 677 parking stalls on site. 3. The applicant shall revise the proposed pedestrian walkway depicted on the submitted plan and provide a separate paved route using a variation in paved texture and color. BUILDING PERMIT ISSUANCE REQUIRED The city is currently reviewing the building permit (File #18-102037-00-CO) associated with the exterior and parking lot improvements. No work may begin until the building permit is issued. Pursuant,to FWRC 19.55.050, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner within 14 calendar days by June 18, 2018. Any appeal must be in the form of a letter delivered to the Department of Community Development with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the director's decision, including the identification of specific findings and conclusions made by the director, disputed by the person filing. However, in that you are the only parry of record, your appeal period is waived (assuming you do not wish to appeal this decision), if the city a letter signed by the owner or owner's representative waiving the appeal. Waiver of the right to appeal does not affect the effective date of this decision. APPROVAL DURATION Unless modified or appealed, the Process I decision is valid for one year from the date of issuance of the decision. A one-year time extension to the decision may be requested prior to the lapse of approval following the provisions listed in FWRC 19.15.110. The improvements must be substantially completed within the one-year time period or the land use decision becomes void. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This Process I approval does not constitute approval of the building permit, which is still under review. The proposed On Line Grocery Service scope of work includes the installation of a canopy for dedicated On Line Grocery Pick Up service, the re -striping of existing parking in an alternate color for the designated parking, wall signage, directional signage and parking stall signage and a minor interior remodel. Customers order their groceries on-line and select an appointed hour to pick up their order. Upon arrival to the Walmart Neighborhood Market, the customer will be directed by way - finding signage to the On Line Grocery Pick Up service area. Upon arrival, a Walmart OGP Employee delivers their purchases and places it in the customer's vehicle. Please note there is a reduction of three (3) parking spaces for the On Line Grocery Pick Up service. The current parking provided at the above Walmart Supercenter 877 standard 9'x20' parking stalls, including 20 ADA accessible spaces, for a total of 897 spaces. We are proposing to widen 10 parking stalls to 12'x20' for the designated On Line Grocery Pick Up and as a result, three (3) parking spaces will be eliminated. The additional width is necessary for the OGP Employee to safely navigate around the vehicles. The reduction of the three (3) stalls is less than 1% of the existing parking and will have no impact on the current parking ratio.
