Dear Ms. Suarez:
The Community Development Department has received your November 28, 2018, Process l Master Land Use
(11 LU) application to modify the existing parking lot and a portion of a landscape island to construct an electric
vehicle charging station as depicted in the materials submitted with your application. The Process I 1v17.,U
application is hereby approved with conditions pursuant to conclusions based on Findings as follows below.
FINDINGS
■ The proposal, as depicted on the November 28, 2018, application materials, is to construct a Fenced
unmanned electric vehicle charging station within four existing parking stalls, and reduce the size of one
parking lot landscape island from approximately 260 square feet to 130 square feet in size. The area where
the landscape is removed would be used as one parking stall for the electric vehicle charging station.
0 Pursuant to Federal Way Revised Code (FWRC) 19.15.030(1), the proposed project is subject to a Use
Process I (UP 1) review. Upon review by the Planning Division, it has been determined that the Walmart
overall Type IV parking lot landscape area will still comply with the minimum parldng lot landscaping
space and area requirements of F%RC 19.125.070, following the proposed size reduction of 130 square
feet (one half of a single parking lot landscape island).
The proposal does not reduce the amount of required landscaping, parking, buffering, setbacks, or public
areas below minimum FWRC requirements. Based on the submitted site plan, the'subject property meets the
minimum parking spaces and parking lot landscape island area and is thereby in conformance with the
landscaping requirements of the Commercial Enterprise (CE) zone. Community design requirements are not
adversely impacted by the installation of the electric vehicle charging station and existing non -conforming
aspects of development are not required to be brought into conformance per FWRC 19.30.090.
CONDITIONS
The director approves the proposal based on compliance with the following two conditions:
A building permit is required for the proposed eight -foot tall fence enclosure. Chain -link fences visible
from public rights -of -way or adjacent properties, and not screened by Type I landscaping as defined by
Chapter 19.125 FWRC, shall utilize vinyl -coated mesh, powder -coated poles, dark color(s), and
architectural element(s), such as pole caps and/or decorative grid pattern.
2. Electrical permits, including plan review, are required for the project.

CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or uses
are permitted only if approved using Process I — Director's Approval. Based on the findings above, the
proposed improvements to the' #�velqVed site -meet the following Process I approval criteria and land use
review thresholds of FWRC I916.03A'and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but not
limited to: Permits and Review Processes; Outdoors, Yards and Landscaping; Process I — Director's
Approval; and Commercial Enterprise (CE) zone.
2. The proposal is a minor improvement, modification, or addition to a site that is exempt from SEPA review.
3. The health, safety, and welfare of the citizens of the city are preserved.
APPEALS
The effective date of this decision is January 11, 2019, or three days from the date of this letter. Pursuant to
FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative
decision may appeal the decision to the Federal Way Hearing Examiner by January 25, 2019. Any appeal must
be in the form of a letter delivered to the Community Development Department with the established fee. The
appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors
in the director's decision, including the identification of specific findings and conclusions made by the
director disputed by the person filing. You may waive your right to appeal, if desired, by writing the city a
letter to this effect.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval is valid for one year from the effective date of
this decision. If no further action is taken within one year, this decision will expire.

PROJECT DESCRIPTION
Electrify America, a subsidiary of Volkswagen Group of America, will invest $2 billion in Zero
Emission Vehicle technologies and programs over the next 10 years to drive the increased
adoption of Electric Vehicles (EVs).
In the first 30 months, Electrify America will invest in over 2,000 next generation high-speed
charging stations across 500 locations to create the Fueling Stations of the Future" at highly
trafficked retail properties in both metro areas and along highways. The Federal Way, Walmart
Supercenter location falls within this phase.
Electrify America will perform site selection, site development, installation and construction as
well as ownership and turnkey operation of next generation high-speed EV charging sites, with
the capabilities to provide 200 miles of electric refueling in under 15 minutes.
The EV Charging sites will be located at Preferred Property Owner Partnerships:

Benefits to Partner Property Owners:
• Electrify America will install, operate and maintain chargers at its sole expense,
including new utility service requirements and utility service accounts.
• The onsite high-speed chargers will drive visibility as a unique property amenity and
capture an increasingly larger mix of vehicle drivers as the EV market share grows.
• Charging stations are brand neutral and are designed to service all fast -charge capable
EVs now and into the future.
As a 10 year, fully funded entity, Electrify America will continue to invest in new
technologies to enhance the customer experience in collaboration with property owners and
vehicle manufacturers.

Electrify America (EA) proposes to install, maintain, and operate 3 Dispensers + 1 Level 2, and
it's associated control cabinets in the existing parking lot of the Walmart Supercenter — Federal
Way. The second drive aisle from the far east perimeter of the parking area has been assigned
by Walmart as the proposed location. Electrify America will modify the parking island and stalls
to accommodate the charging equipment by adjusting 8 existing parking stalls and creating a 4-
stall charge station. The proposed installation includes:
(3) 150KW BTC DISPENSERS. These measure approximately 96 inches tall, 22 inches
wide and 15 inches deep. The dispensers are proposed side by side between parking
stalls and accommodate diagonal parking. The dispensers are dimly lit and are clean
and simple in appearance. For safety, the dispensers are surrounded by bollards to
protect them from moving vehicles and can only be energized when securely connected
with the vehicle.
• (1) switch gear cabinet — this contains the circuit breakers for the installation. It
measures 92 inches tall, 140 inches wide and 40 inches deep. It is proposed to be
located on a concrete pad measuring 23'X13' 6" (feet).
• (3) - 150KW BTC Power Units measure 80 inches tall, 42 inches wide and 35 inches
deep. These units are proposed to be installed on the concrete pad, in the expanded
landscape island southwest of the proposed dispensers.
■ The equipment pad is proposed to be enclosed by a Winchester Grey, Trex Horizons
Fence measuring 8 feet in height.
A new electric utility transformer will be installed to the north of the equipment
enclosure as shown on the site plans.
• (1) 20' Pedestrian Light pole and LED fixture is proposed in the expanded landscape
island, providing lighting to the charge stalls.
• (1) Proposed Utility Meter mounted on an H-Frame is proposed on the west side of the
equipment enclosure.
■ (1) EV Charging Only sign measuring 12 inches X 18 inches will be installed on the south-
east corner of the landscape island facing the charging stall drive aisle.
Charging stations are available to drivers 24 hours a day, 7 days a week. This proposal is great
for EV drivers and advantageous for the City of Federal Way. Electrify America proposes to
start construction in January 2019.
